720_00001ORDINANCE NO.720 AN ORDINANCE AMENDING ORDINANCE NO.433 WHOSE TITLE IS "THE COMPREHENSlVE ZONING ORDINANCE OF THE CITY OF MOSES LAKE,WASHINGTON,"BYREZONING THE REALESTATE HEREINAFTER DESCRIBED. NOW,THEREPORE,THE CITY COUNCIL OF THE GITY OP MOSES LAKE, WASHINGTON,DO ORDAIN AS FOLLOWS: Section 1.That Ordinance No.433 of the City of Moses Lake,Washington, passed May 9,1961,and the official zoning map adopted thereby,be amended in the folla thngpparticulars,scrib as: That portion of the NE¼of Section 23,TWP 19N,Range 28 E.W.M., Grant County,Washington,described as:Beginning at the N¼ corner of said section;thence 8 0°22'54"W a distance of 40 feet o the true point of beginning,thence continuing S 0°22'54"W a tance of 1369.6 feet more or less to a point on the North right-of-way line of Lark Avenue,to be designated Point "A". rl Beginning again at the true point of beginning,thence N 89°48'00" ,o E a distance of 590 feet more or less,thence S 0°12'00"E a distance of 385 feet,thence S 36°55'30"W a distance of 120.33 feet,thence S 32°00'W a distance of 386.85 feet,thence along a curve to the left with a delta of 122°00',Radius 200 feet a distance of 425.86 feet,thence South a distance of 335'more or less to the North right-of-way line of Lark Avenue,thence along said North right-of-way line to the previously designated point "A". be and the same is hereby changed from R-3,Multi-Pamily Residential to CM,Community Business. I Section 2 .That it is the intention of this ordinance to change the zoneclassificationofonlylandhereindescribedandshalludfiffectorchange any other zones of land as described in Ordinance No.433. Section 3.That if a building permit is not obtained by Mall Centers,Inc., for the Grant County Mall on the property described above within one (1) year after the passage of this ordinance,the property described above shall revert back to its original R-3 zone,unless Mall Centers,Inc.,requests anadditionalextensionofone(1)year;if a building permit is not obtained with- in the one (1)year extension,the property shall revert back to its original R-3 zone, Section 4.That this ordinance shall take effect and be in force five (5)days after its passage and publication as provided by law.
