730_00001ORDINANCE NO.730 AN ORDINANCE AMENDING SECTION 1.36.24 OF CHAPTER 1.36 OFTHEMOSESLAKECITYCODE,ENTITLED,"PARK REGULATIONS"BYCHANGINGTHEPROCEDUREFORISSUINGCONCESSIONPERMITS. THE CITY COUNCIL OF THE CITY OF MOSES LAKE,DO ORDAIN AS FOLLOWS: Section 1.That Section 1.36.24 of Chapter 1.36 of the Moses LakeCityCodeisherebyamendedtoreadasfollows: Section 1.36.24 Commercial Activity: 1.No person shall sell or attempt to sell any merchándiseorserviceoroperateanyconcessioninaparkwithout apermit.A permit may be issued authorizing the selling ofmerchandiseorservicesortheoperatingofaconcessioninaparkifitisdeterminedtobereasonableandinthebestinterestoftheCity. Reasonable conditions may be included in said permit andsaidpermitmayberevokedifthetermsofthepermitareviolated,or a permit may be denied to a person or personswhohaveviolatedthetermsofapermitwithinthepreviousyear. I 2.No person who holds avalid permit issued under this sectionshallsellmerchandiseorserviceswithinaparkinviolationofanyconditionsstatedinthatpermit. 3.All requests for permits from profit making groups ororganizationsshallbereviewedandapprovedordenied bytheCityCouncil.All requests for permits from non-profit groups or organi2ations shall be reviewed andrecommendationsmadebytheParkandRecreationDepartmentstafffortheCityManager's approval or denial.If anapplicationforapermitisdenied,the applicant mayappealthedecisiontotheCityCouncil.Such appeal maybeheardatthenextregularlyscheduledCityCouncilmeeting. Section 2.That it is the intention of this Ordinance to change only thesectionsetforthhereinandnottoaffectorchangeanyothersectionofChapter1.36 of the Moses Lake City Code. Section 3,This ordinance shall he effective five (5)days after itspassageandpublication. PASSED by the City Council and APPROVEDby its Mayor,this 23rd day ofSeptember,1975.
