AN ORDINANCE ESTABLISHING A UNIFORM FENCINGCODEFORTHOSEAREASOFTHECITYOFMOSESLAKETHATHAVESIDEWALKSCONSTRUCTEDNEXTTOTHECURB
i THE CITY COUNCIL OF THE CITY OF MOSES LAKE DOES ORDAIN AS FOLLOWS:
When a sidewalk is constructed next to a curb,the building of afence,wall,or hedge next to the sidewalk,on City right-of-way,will be permitted,provided it complies with the followingconditions:
1.The fence,wall,or hedge shall comply with all heightregulations
2.The fence,wall,or hedge shall not create a traffichazardbyobstructingviewoftrafficandshallnotobstructpedestrianmovement
3.The City of Moses Lake and other public services shallhavetherighttodigupthefence,wall,or hedge placedonCityright-of-way for repair or replacement of utilityservices.The owner of said fence,wall,or hedge shallbearallcostsifhesodesirestoreinstallsaidfence,wall,or hedge.
4.The fence,wall,or hedge shall be constructed a minimumoffive(5)feet behind the curb in areas of the Citywherecurbingwasinstalledwithoutsidewalks.I 5.The fence,wall,or hedge shall be constructed so as toavoidplacementoverwater,gas,sewer,or other utilitylines,and shall be approved by the City Engineer.
PASSED by the City Council of the City of Moses Lake,Washington,and APPROVED by its Mayor this 14th day of September,1976.
