775_00001CITY OF MOSES LAKE,WASHINGTON ORDINANCE NO.775 AN ORDINANCE of the City of Moses Lake,Wash-ington,providing for a new Civic Center ComplexattheexistingCivicCentersitebydemolishingiexistingbuildings,preparing the site,remodel-ing the City Hall,constructing and equippingadditionstosuchCityHall,constructing andequipping.a new Police Station,Council roomandJusticeCourtfacilities,County officesandaccommodationsformuseumartifacts,con-structing and equipping a new Fire Station andlandscapingandprovidingparkingspacesforsuchCivicCenterfacilities;declaring the estimatedcostthereofasnearlyasmaybe;providing fortheborrowingofatotalof$1,200,000 and issuingandsellingnegotiablegeneralobligationbonds topaythecostthereof,such bonds to be payablebyannualtaxleviestobemadewithoutlimitationastorateoramount;declaring an emergency;andprovidingforthesubmissionofthepropositionofincurringsuchindebtednessandissuingsuchbondstothequalifiedvotersoftheCityataspecialelectiontobeheldonNovember2,1976,in conjunction with the State general electiontobeheldonthesamedate. I WHEREAS,the City is in urgent need of providing a new Civic Center Complex,as hereinafter set forth,and the City does not have available sufficient funds to meet the estimated cost thereof;NOW,THEREFORE, THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON, DOES ORDAIN as follows: Section 1.The City of Moses Lake,Washington,(here- inafter called the "City")upon ratification of the proposition by the qualified electors of the City as provided in Section 4 of this ordinance,shall provide for a new Civic Center Complex at the existing Civic Center site by demolishing existing buildings, preparing the site,remodeling the City Hall,constructing and equipping additions to such City Hall,constructing and equippingianewPoliceStation,Council room and Justice Court facilities, county offices and accommodations for museum artifacts,constructing and equipping a new Fire Station,and landscaping and providing parking spaces for such Civic Center facilities,.the estimated cost of which,including the cost of issuance of the general -1- obligation bonds herein authorized,is hereby declared to be as nearly as may be the sum of $1,200,000.00. Section 2.The City shall borrow the total sum of $1,200,000.00 on the credit of the City and issue and sell its negotiable general obligation bonds therefor for strictly municipal - capital purposes,other than the replacement of equipment,for the purpose of providing the funds required to carry out the improve- ments specified in Section 1 hereof. Section 3.The general obligation bonds herein authori- zed to be issued shall be serial in form and shall bear interest at a maximum effective rate not to exceed 8%per annum,which, except for the first interest coupon,if the City Council so determines,shall be payable semiannually,and shall mature in from two to not more than twenty years from date of issue,the life of the improvements to be acquired by such bonds being at least twenty years,in such amounts as nearly as practicable annu- ally as will result in a difference of not more than $5,000.00 between the highest and lowest annual payment of principal and interest,excluding the first two years from date of issue,com- puted on such anticipated effective interest rate as the City Council of the City shall,in its discretion,determine will be borne by such bonds and shall be paid by annual tax levies sufficient in amount to pay both principal and interest when due, which annual tax levy shall be made without limitation as to rate or amount,and the bonds shall so provide.The bonds shall be redeemable at the option of the City at such times as shall be hereafter determined by ordinance.The date of issue,interest irateorrates,maturities,form and covenants of such bonds shall be hereafter fixed by ordinance of the City Council of the City,and the bonds shall be issued and sold when the proceeds thereof may be required. -2- r Section 4.The City Council finds that an Emergency exists requiring a new Civic Center Complex for the City as herein set forth,and that as a result of the existence of such an emer- gency,it is necessary to call a special election and a special ep1rcv ed ltheren tree,2hneredby calNeo e boebr 7 ,n heeon nyctason with the State general election to be held on the same date, at which there shall be submitted to the qualified voters of the City for their ratification or rejection the following proposi- tion in the form of a "ballot title"as follows: Shall the City incur a general indebtedness andissueandsellnottoexceed$1,200,000.00 ofgeneralobligationbondstopaythecostofpro-viding new Police,Fire and Court facilities alongwithremodelingandadditionstoCityHall,suchbondstobepaidbyannualtaxleviestobemadewithoutlimitationastorateoramount,and to matureseriallyinfromtwotonottoexceedtwentyyearsfromdateofissue,as provided in Ordinance No.775passedonSeptember14,1976? BONDS ...YES __BONDS ...NO i The Auditor of Grant County,Washington,as ex officio Supervisor of Elections,is hereby requested to concur in the findings of such emergency and to call and conduct such special election in the manner required by law.The City Clerk shall deliver to the Auditor of Grant County,Washington,as ex officio Supervisor of Elections,at least forty-five days prior to the requested election date,a certified copy of this Ordinance show- ing its passage and including the ballot title herein set forth. Section 5.The provisions of Section 17,Ordinance No. 474,are hereby waived.This Ordinance shall be read only once before its passage and shall take effect immediately after passage and publication.
