THE CITY COUNCIL OF THE CITY OF MOSES LAKE DO ORDAIN AS FOLLOWS:

ZONING CODE
3.24,105 Title,Purpose and Scope
This Chapter shall be known as "The 2oning Ordinance"of the City of Moses Lake.
B.Purpose
1.This Chapter is adopted for the purpose of promoting the health,safety,and generalwelfareoftheCity's population,and to promote an orderly balanced use of land,and to guide the City's future growth through comprehensive,consistant and carefulplanning.
2.To most effectively accomplish these purposes,this Chapter divides the City intozoneswhereinthelocation,height and use of buildings,the use of land,the sizeofyardsandotheropenspace,and the provision of advertising signs,off-streetparkingandloadingareregulatedandrestrictedinaccordancewithacomprehensiveplanfortheuseoflandintheCityofMosesLake.These zones and regulationsaremadewithdueconsiderationofeconomicsandfinancialresources,physicalpatternofthelands,environment,cultural,and basic needs of the citizens oftheCity,and among other things,the particular character of each more and itssuitabilityforspecificuse,keeping foremost in mind the effect of noise,odor,i dust,glare,and safety hazards affecting adjoining zones.Also,remembering thereasonandneedforsuchuses,the common rights and interests of all within thezoneaswellasthoseofthegeneralpublic,and with the view of encouraging themostappropriateuseoflandthroughoutthecity.
1.2oning regulations in this Chapter apply to every building and use within the CityofMosesLake.Hereafter,no building or structure shall be areeted,reconstructed,enlarged,or relocated and no building structure or land shall be used in any zoneexceptincompliancewiththeprovisionsofthisChapterandthenonlyaftersecuringallrequiredpermitsandlicenses.
2.Any building,structure,or use lawfully existing at the time of passage of thisChaptermaybecontinuedasprovidedinSection3.24.205 of this Chapter.
3.All land or territory hereafter annexed to the City,unless otherwise classifiedbyordinanceshallimmediatelyuponannexationbeclassifiedasbeinginthe"Ag"Zone,and the Zoning Map shall be so amended without additional procedure.
4.Any use of property in any zone shall be.subject to all city ordinances andregulations,including the abatement of nuisances.The fact that a use is listedasapermitteduseinthevariouszoneclassificationsshallnotbedeemedtoauthorisesuchusetotheunduedetrimentofotherpropertiesbecauseoftheemîssionofsmoke,dust,noise,vibration,fumes,odora,glare,or other objec-
.tionable factors or which constitutes a hazard to health,mora1s,safety,orgeneralwelfare.
3.24,110 De£1nitions
3.24.110.005 General:The term "Council"when used shall mean the City Council of the City of MosesiLake,"Commission"shall mean the Planning Commission of thel City of Moses Lake,and"Board of Adjustiment"shall mean the Moses Lake Board of Adjastment.The word "shall"is always mandatory,the 'word "may"is permissive,subject to the judgement of thePlanningCommission,
3.24.110.010 Agriculture:The use of land for agricultural purposes including farming,dairying,pasturage,agriculture,herticulture,floriculture,vitacultute,aviaries,and animalandpoultryhusbandry,and the necessary accessory uses for storing produce;providedtheoperationofsuchaccessoryuseshallbeincidentaltothatofnormalagriculturalactivities.
3.24.110.015 Apartment Building:A building which contains three (3)or more dwelling units.
3.24.110.020 g:A public way twenty feet (20')in width between property lines,which affords asecondarymeansofaccesstoabettingproperty.
I 3.24.110.025 Accessory Uses:A detached subordinate use which is secondary to the uses of the inain 'building on the same lot and appurtenant thereto.
3.24.110.030 Auto Wrecking Yard:Any lot or area used for the dismantling or disassembling of motorvehiclesortrailers,or the storage,sale or dumping of four (4)or more dismantled,partially dismantled,obsolete or wrecked vehicles,or their parts.
3.24.110.035 Billboard (off Premise Sign):Any structure,board,fence,or vehicle used for advertisingpurposesofgoods,services,businesses,or activities noi on the same lot as the saidadvertisingstructure;or any structure,board,fence,or vehicle used for advertisingpurposesofgoods,services,businesses,or activities which are located more than twohundredfeet(200')from said structure.
3.24.110.040 Board of Adjustment:A 3oard consisting of five (5)members which shall he responsibleforhearingallappealsforvariancesofthestrictapplicationoftheprovisionshereincontained.
3.24.110.045 3oarding or LodginA House:A dwelling or part thereof,other than a hotel,motel,ormulti-family dwelling where lodging,with or without meals is provided,for compensation,for three (3)or more persons.
3.24.110.050 3uilding Coverage:The land area covered by all buildings on a lot,including all projec-tions except eyes.
3.24,110.055 Building Height:The vertical distance measured from the average grade to the highestpointontheroof,ridge,or parapet wall.
3.24.110.060 g:An association of persons,religious or otherwise,for a commonpurposa,butnotincludinggroupswhichareorganizedprimarilytorenderaservice,carried on.asabusinessforaprofit.
3.24.110.065 Clinic:A place where group medical services are peržormed not including the overnightihousingofpatients.
3.24.110,070 Density:The number of dwelling units within a given unit of land.
3.24.110.075 Development:The construction or alteration of structures,dredging,dumping,filling,or removal of earth of any temporary or permanent nature,
3.24.110.080 District:As used in this Ordinance shall maan 2oning District unless otherwise defined.
3.24.110.085 Dwelling:Any building or portion thereof designed or used for a residence or sleepingplaceofoneormorepersons:
A.Dwelling,Single Family:A building designed or used for a residence by not morethanone(1)family and containing only one (1)dwelling unit.
B.Dwelling,Two-family,or Duplex:A buildi 5 designed or used for residential purposesbynotmorethantwo(2)families and containing two (2)dwelling units.
C.DwellinA,Multi-family:A building or portion there of designed or used as a residencebymorethantwo(2)families,and containing more than two (2)dwelling units.3.24.110.090 Dwelling Unit:One (1)or more rooms designed as a unit with kitchen facilities therein,for occupancy by one (1)family for living and sleeping purposes.
3.24.110.095 Factory Built Housing;Any structure,or portion thereof,designed primarily for residentialoccupancybyhumanbeings,other than a mobile home,the structure or any room or componentofwhichiseitherentirelyorsubstantiallyprefabricatedorassembledataplaceotherthanabuildingsica.All Factory Built Housing must bear a state insignia from theDepartmentofLaborandIndustries,showing compliance with the Factory Built HousingLaw(RCW 43,22.450 -RCW43.22.490).
I 3.24.110.100 Family,One (1)person living alone;or two (2)or more persons related by blood,marriage,or legal adoption,or a group not exceeding five (5)persons living as a single housekeepingunit.
3.24.110.105 :A lot or area used for the feeding and fattening of animals for market.
3.24.110.110 Fire Hydrant:A fire hydrant meeting the standards of construction,mounting,andlocationoftheCityofMosesLake.
3.24.110.115 Garage,Commercial:A building,other than a private garage,used for the parking,repair,er servicing of motor vehicles.
I 3.24.110.120 Garage,Private:A building accessory to a dwelling or portion of a building designed'and/or used only for the shelter of,or storage of,vehicles under ten thousand (10,000)ton groes vehicle weight espacity by the occupants of the dwelling,including a coveredparkingspaceorcarport.
3.24.110.125 General Plan:.The General Plan of the City of Moses Lake as adopted by the City Council(same as Comprehensive Plan),
3.24.110.130 Guest House:An accessory,detached dwe11îng without kitchen facilities designed forandusedtohousetransientvisitorsornon-paying guests of the occupante of the maindwelling.
3.24.110.135 Grade (Ground Level):The average of the finished ground level at the center of allwallsofabuilding.In the case where walls are parallel to and/or within five feet(5')of a sidewalk,alley,or public way.
3.24.110.140 Gross Floor Area:The Brass floor area shall include all floor area within the exteriorwallsofabuilding,including areas in halls,storage,and partitions.
3.24.110.145 Home Occupation:An occupation carried on entirely within a residence by the occupantsthereofwhichactivityisclearlyincidentaltotheuseofsaidresidenceasadwallinganddoesnotchangetheresidentialcharacterthereof,is conducted in such a mannerastonotgiveanyoutwardappearancenormanifestanycharacteristicofabusiness intheordinarymeaningoftheterm,and does not infringe upon the right of the neighboringresidentstoenjoyapeacefuloccupancyoftheirhomesforwhichpurposetheresidentialsonewascreatedandprimarilyintended.An occupation which does not meet the abovedefinitionorwhichisincapableofordoesnotcomplywithallthefollowingcriteriashallnotbedeemedahomeoccupation:
A.There shall be no structural alteration to accomodate the occupation.Entrance tothespacedevotedtotheoccupationshallbefromwithintheresidence,except whenotherwiserequiredbylaw.I B.The use,including all storage space,shall not occupy more than twenty-five per cent(252)of the residence's floor area which is finished for living purposes and innocasemorethantwohundredsquarefeet(200').No home occupation shall occupyanaccessorybuilding.
C.Only members of the family who reside on the premises and in any case no more thanthree(3)persons in any dwelling unit shall be engaged in said occupation(s).
D.There shall be no window display nor shall sample commodities be displayed outsidethebuilding.
E.No material or mechanical equipment shall be used which will be detrimental to theresidentialuseofsaidresidenceoradjoiningresidencesbecauseofvibration,noise,dust,smoke,odor,interference with radio or television reception,or other factor.
F.Materials or commodities delivered to or from the residence which are of such bulkorquantityas.to require delivery by a commercial vehicle or a trailer,or theparkingofcustomer's automobiles in a manner or frequency causing disturbance orinconveniencetonearbyresidencesorsoastonecessitateapublicparkinglotshallbeprima-facie evidence that the occupation la a primary business,and not a homeoccupation,
G.Examples of uses which g normally satisfy the above criteria are:barbers,customfloristry,beauticians,professional services,dressmakers,photographers,home canning,watch repairing,and similar uses.
H.The following uses shall not be deemed home occupations:nursing homes,massageparlots,toutîst homes,woodworking and cabinet shops,repairing of household appliances,furniture and cabinet size radios,televisions,fumigation processes,upholstering,car repair,small engine repair,and similar uses.I 3.24.110.150 g:Any building containing six (6)or more guest rooma intended or designed to beused,or which are used,rented,or hired out to be occupied for sleeping purposes byguestsandshall.include hotels,lodging and rooming houses,dormitories,bachelor hotels,studio hotels,motels,public and private clubs,and any other building used for a similaruse,exeept where human beings are housed or detained under local restraint.3.24.110.135 Houseboat:A boat containing a dwelling unit.
3.24.110.160 Junkvard:Any lot or structure where waste,discarded or salvaged materials are exchangedstored,or handled,but excluding the following which shall not be considered junkyards:pawn shops,second hand stores,used furniture stores,and establishments salvaging paperandragewhenallactivityandstorageareconductedwhollywithinanenclosedbuilding,and establishments for the sale of used motor vehicles and machinery which are in operativecondition.
3.24.110.165 Kennel:Any lot or premises on which four (4)or more dogs over four (4)months of ,age are kept.
3.24.110.170 Landscaped:An area in lavn,shrubbery,wood chips,rock,or other material that ismaintainedandkeptfreeofdebrisandothernuisances.
3.24.110.175 g:A parcel of land under one (1)ownership used or capable of being used under theregulationsofthisOrdinance,including both the building site and all required yardsandopenspacesasdefinedherein:
A.Lot,Corner:Any lot which is located at the intersection of two (2)or more streets.The shorter street frontage of such a lot shall constitute the front of the lot.
E.Lot,Inside:A lot other than a corner lot.
C.Lot,Through:A lot which has frontage on two (2)parallel or approximately parallelstreets,or a lot that has a body of water er other natural barrier at the rearofthepropertywhichisparalleltothestreet.
D.Lot Depth:The horizontal distance between the front and rear property linesmeasuredinthemeandirectionofthesidepropertylines.
E.Lot Width:The horizontal distanca between the side property lines measuredatrightanglestothedepthatapointwhichistherequiredminimumbuildingsetbacklineinthatzoneinwhichthelotislocated.
3.24.110.180 Maintain:Maintain shall mean to preserve and care for a structure,improvement,orareatosuchanextentthatitremainsattractive,safe,and presentable and carriesoutthepurposeforwhichitwasinstalledorconstructed,
i 3.24.110.185 Mobile Home:A structure designed and built to comply with the Washington State DepartmentofLaborandIndustriesRulesandRegulationsforMobileHomes.
3.24.110.190 g:See Hotel.
3.24.110.195 Non-Conforming Structure:A structure conforming with respect to use,but does notconformwithrespecttoheight,setback,coverage,or other requirements of thisOrdinanceregulatingstructures.
3.24.110.200 Non-Conforming Use:The use of any land or building which does not conform to theuseregulationsofthisOrdinanceforthezoneinwhichitislocated.
3.24.110.205 ParkinR Lot:Any area of land,a yard or other open space area,used for or designatedfortheparkingofmotorvehicles.
3.24.110.210 Parking Space:An off-street space with a minimum of nine feet (9')in width andtwentyfeet(20')in length used for or designated for the parking of motor vehicles,together with the area required to provide reasonable access to and from each space.
3.24.110.215 g:A hard surfaced area of portland cement or asphaltic concrete with a baseapprovedbytheCityEngineer.
3.24.110,220 Property Line,Front:The line separating the street from the front of the lot asshownontheofficialrecordedplatoftheproperty,and as modified by any subsequentvacation,condemnation,or conveyance for public purposes.In the case of unplatted -property,a front line shall be designated by the Suilding Inspector before issuanceofabuildingpermit.A through lot shall be considered to have a front propertylineoneachoftheoppositestreetsuponwhichsaidlotabuts.
3.24.110.225 Private Street:A way that is privately built and maintained which affords the primarymeansofaccesstoaResidentialUnitDevelopment(RUD),Mobile Home Park,or RecreationaliVehiclePark.
3.24.110.230 Service Station:A retail business establishment supplying gasoline,oil,accessories,and minor service for automobiles.
3.24.110.235 Setback:The distance between the property line and permitted building line as requiredinthisOrdinance.
3.24.110.240 g:Any outdoor advertising display or outdoor advertising structure,or anyindooradvertisingdisplayorindooradvertisingstructuredesignedandplacedso astobereadableprincipallyfromtheoutside.
3.24.110.245 Storager The keeping of a quantity of goods,merchandise,or other materials in amannerorlocationwhichwillrequirethemtoberearrangedorrelocatedbeforeuseorretailsalesofsaidgoods,merchandise or other materials.
3.24.110.250 g:That portion of a building included between the surface of any floor and thesurfaceofthefloornextaboveit,or if there be no floor above it,then the spacebetweensuchflootandtheceilingnextaboveit.Any portion of a building exceedingfourteenfeet(14')in height,shall be considered as an additional story for eachfourteenfeet(14')or major fraction thereof.If the finished floor level directlyabovethebasementorcellarismorethansixfeet(6')above grade such basement orcellarshallbeconsideredastory.
3.24,110.255 Street:A public right-of-way sixty feet (60')or more in width which provides theprimatymeansofaccesstotheabuttingproperty.
3.24.110.260 Structure:That which is built or constructed:edifice or building of any kind oranypieceofworkartificiallybuiltuporcomposedofpartsjoinedtogetherinsomedefinitemanner,which requires location on the ground or attached to something locatedintheground,including swimming and wading pools,and covered patios,exceptingoutdoorareassuchaspavedareas,walks,tennis courts,and similar recreation areas.3.24.110,265 Structural Alteration:Any change in the supporting members of a building such asbearingwalls,columna,beams,girders,floor joints,ceiling joists,or roof rafters.
3.24.110.270 Utility Easement:A nonrestrictive easement granted to the City for the express useoflocatingpublicutilities.
3.24.110.275 Yard,Front:The required open space adjoining the front property line and extendingacrossthefullwidthofthelottoadepthequaltotheminimumpermittedhorizontaldistancebetweenthefrontpropertylineandanypartofabuildingonthelotsaveaselsewhereexceptedinthisChapter.
3.24.110.280 Yard,.Rear:The required open space adjoining the rear property line and extendingacrossthefullwidthofthelotoninsidelots,and from the side yard flanking apublicstreettotheoppositesidepropertylineoncornerlotsandhavingadeýthequaltotheminimumpermittedhorizontaldistancebetweentherearpropertylineandanypartofthemain.building on the lot,save as elsewhere excepted in this Chapter.For triangular or pie shaped lots,the rear yard shall be the area of the lot lyingwithinacirclehavingaradiusequaltothedepthoftherequiredrearyardanditsIcenteratthepointhereindefinedastherearpropertylineforsuchlots.
3.24.110,285 :The required open space adjoining the side property line and extendingfromtherequiredfrontyardtotherequiredrearyardoninsidelots,and to the rearpropertylineoncornerlotsalongthesideflAnkingapublicstreet,or in the absenceofsuchrequiredyardstothefrontorrearpropertylines,and having a width equaltotheminimumpermittedhorizontaldistancebetweenthesidepropertyline,and anypartofthemainbuildingonthelotline.
3.24.110.290 Zoning Administrator:The person who is charged,by the City Manager,with the adminis-tration and enforcement of this Ordinance.
3.24.110,295 Zoning Ordinance:Shall mean the 2cning Ordinance of the City of Moses Lake.
3.24.115 ZONINGDISTRICT CLASSIFICATIONS
For the puposes of this chapter the City of Moses Lake is dividedintothefollowingZoningDistricts:
"Ag"-Agricultural
"R-1"-Residential,Single Family
"R-2"-Residential,Single Family and Duplex
"R-3"-Residential,Multi-Family
"C-1"-Commercial,Central
"C-2"-Commercial,Limitedi"C-3"-Commercial,Neighborhood
"C-4"-Commercial,Tourist
"C-5"-Shopping center
"I-1"-Industrial
"C-R"-conservation and Reelemation
"P"-Public
3.24.120 AG,AGRICULTURAL
3.24.120.10 Intent:The Agriculture Zona is designed to encourage the use of agriculturally suitableilandstobeusedforfarminganddiscouragethedivisionoffarmlandsintourbandevelop-ments.These lands should keep the agricultural zoning designation until the area can beadequatelyservedbyCityservicesandcanbeproperlydevelopedforamoreintensiveuse.3.24.120.15 Permitted Uses:
A.Single family dwelling
E.Duplex
C.Factory Evilt Housing
D.Vield and crop farming,gardening,fruit growing,nurseries
E.Selling of products raised on the premises
F.Agricultural buildings,such as barns,storage sheds,coops,and similar buildingscommonlyutilizedinfarmingoperations
G.Reeping of livestock,poultry,rabbits,and bees provided they comply with Section 3.24.120.30
H.Resping of househould pets,not exceeding three (3)in number,which are four (4)monthsofageorolder
I.Accessory uses appurtenant to any permitted use
J.Rome occupations as defined herein
R.Other uses ruled by the Planning Commission to be similar to the specified permittedusesandnototherwiseprohibited.
3.24.120.20 Conditional Uses:i A.Recreational uses including golf courses,race tracks,and camping
B.cemeteries
C.Commercial greenhouses
D.Removal of sad,soil,or other natural materials for the purpose of sale or use asfillmaterialoffpremises
3.24,120.25 Prohibited Uses:
A.Multi-family residences
3.Commercial uses other than home occupations
C.Industrial uses
D.Feed lots
E.Junkyards
F.Mobile homes
3.24.120.30 Keeping of Animals:Animals shall be kept in the following manner:
A.Livestock,rabbits,poultry,and bees shall not be raised commercially.
2.No animals other than household pets,such as dogs and cats,shall be raised on any .parcel of land less than two (2)acres in size.
C.Pens,barns,coops,and similar structures shall be at least forty feet (40')fromIadjoiningresidentialuses.
D.Fences shall be maintained and shall he located a minimum of forty feet (40')fromanyadjoiningresidentialuse.Electric fences will not be permitted in any mone.E.No more than three (3)animals shall he kept per acre of irrigated pasture.
F.Animals shall he cared for in such a manner as will not create a nuisance to adjacentuses.
3.24.120.35 Property Development Standards:
A.Density:The density in the "Ag"District shall not exceed two (2)dwelling unitsIperten(10)acres.
B.Setbacks:
Front yard:25 feet minimumSideyard:5 feet minimumRearyard:5 feet minimum
3,24.125 R-1,SINGLE FAMILY RESIDENTIAL
3.24.125.05 Intent:The R-1 Zone is intended to provide for single family residents with medium andlowdensity.The zone is quite restrictive as it allows no uses which are not entirelyresidentialinnature.The R-1 Districts should be designed and located so that theycanbeservedbyarteriaiswithoutbeinginterruptedbytrafficandbefreeofencroachmentbycommercialorindustrialuses.R-1 Districts shall not be developed without meetingstandardsforsewerandwaterintheareatobedeveloped.
3.24.125.10 Permitted Uses:
A.Single family residences
B.Factory Built Housing
C.Household pets,not exceeding three (3)in number which are four (4)months old or older.
D.Accessory uses appurtenant to permitted uses are permitted.One (1)private gatagehousingnotmorethanfour(4)cars,for each residence is permitted.
E.Residential Unit Developments which comply with Section 3.24.200.
F.Recreational equipment including camping trucks,motor homes,and camping trailers,i not exceeding twenty-five (25)feet in length,boats,boat trailers,and similarequipmentmaybeparkedorstoredonthepremises.Equipment stored or parked withinsideyardsetbacksshallhepermissableprovidedtheoccupantsoftheadjoiningpropertyconsentsthereto.The parking of all such vehicles shall comply with Section3.24.185.
G.Other uses ruled by,the Planning Commission to be similar to the specified permittedusesandnototherwiseprohibited.

3.24.125.25 Property Development Standards:

Corner lots measuring sixty-five feet (65')or more in width shallprovideasideyardnotlessthantwenty-five feet (25')in widthalongthesidestreet.
Houses built on corner lote having at least a dimension of sixty-fivefeet(65')or g may encroach to within twenty feet (20')along thesidestreet,or conform to existing structures within two hundredfeet(200')along either street,but in no case shall a buildingbepermittedlessthanfifteenfeet(15')to a property line adjoiningastreet,
Rear yard:25 feet minimum
Corner lots having their least dimension of seventy feet (70')orgreatershallhaveaminimumrearyardofnotlessthanfifteenpercent(15%)of the total depth of the lot.Corner lots havingtheirleastdimensionoflessthanseventyfeet(70')shall haveaminimumrearyardofnotlessthantenpercent(10%)of thetotaldepthofthelot.
B.Lot size:Lot area shall not be less than seven thousand square feet (7,000')with aiminimumdepthofonehundredfeet(100')and minimum width of sixty-five feet (65')forasinglefamilyresidence,except that lots platted prior to 1961 shall have a minimumlotsizeofsixthousandsquarefeet(6,000')and a sixty foot (60')frontage.
C.Curved Streets:Where a lot fronts on a curved street,the minimum frontagerequiredofresidentiallotsmaybereducedtonotlessthanfortyfeet(40')providedthelotarearequiredinthezonewherethelotislocatedisobtainableinthefrontonehundredandtwentyfeet(120')of said lot.
D.Building Heights.No building shall be constructed over two and one half (2½)storiesorthirtyfeet(30'),whichever is higher.
E.Large Lot Developments:All residential developments over two (2)acres shall beconstructedasaResidentialUnitDevelopment(Section 3.24.200).
7.Fences,Walls,and Hedges:Fences,walls,and beages shall not exceed four feet(4')abova finished ground level in any front yard,or exceed six feet (6')inanysideorrearyard.

A.The use furthers the intent of the zone in which it will be located and conforms tothegeneralplan.
2.The use will not create undesirable traffic congestion or parking problems.
C.The use will not be detrimental to surrounding properties or their uses because ofappearances,noise,use,or other undesirable features.
D.The use will meet all standards and regulations for the zone in which it is to belocated.
E.The use will not create undesirable environmental problems:
1.The Commission can make special requirements in conjunction with its decisionfollowingaPublicHearingiftheyarenecessarytomorecloselyfulfilltheIintentofthezoneinwhichadevelopmentispermitted.
2.Conditions,if any,which may be imposed on any proposed project requiring aconditionalusepermit,shall be endorsed on the conditional use permit and failuretocomplytherewithshallbegroundsforrevocationoftheconditionalusepermit.Revocation of the conditional.use permit shall he final after thirty (30)dayswrittennoticeoftheviolationisgivenbycertifiedmailtotheownerand/oroccupantofthelandorimprovementsforwhichtheconditionalusepermitwasissued,if in the meantime,the violation is not corrected.
3.24.180.15 Unmentioned Uses:Unmentioned uses which are not deemed similar to permitted uses bytheZoningAdministratorshallbepermittedonlybyaPublicHearingbeforethePlanningCommissionandtheirfindingthat:
A.The use is similar in nature to the uses permitted in the zone and is dissimilar tothoseprohibited.
3.The use furthers the intent of the zone in which it will be located and conforms tothegeneralplan.
C.The use will not create undesirable traffic or parking conditions.
D.The use will not be detrimental to surrounding properties or their uses.E.The use will meet all standards and regulations for the zone in which it is to belocated.
F.The use will not create undesirable environmental problems.
The Commission may make special requirements following its hearing and reviewiftheyarenecessarytomorecloselyfulfilltheintentofthedistrictinwhichauseispermitted.
3.24.185 OFF-STREET PARKING ANDLOADING
3.24.185.10 Off-Street Parki A and Loading --Mandatory:Every building hereafter erected,enlarged,converted,or talocated shall provide useable permanent off-street parking and loading .areas as required by this chapter,except that no off-street parking shall be requiredforhomeoccupationsnotforbusinesseslocatedwithintheC--1,Central Business District.Saîd parking and/or loading areas shall have reasonable access and a capacity accordingtotheuseofthebuildgglistedinthefollowingsections.Where a use is not listed,the City Planner shall determine the required parking and/or loading space based on similarusesforwhichtherequirementsarespecified,Ulhen an existing building is occupied byanewusewhichwouldrequiregreaterparkingand/or loading space than is provided withinithebuilding,the City Planner may waive the additional parking requirement provided hefindsexistingdevelopmentrenderscompliancewiththerequirementimpractical.

I 3.24.185.30 Improvement of Parking Lota:Hereafter,all parking lots established in an "R"zone,or on a lot adjacent to a lot in an "R"sone,or adjacent to an existing paved street,shall he improved as follows:
A.The required front yard shall he planted or maintained in lawn or shrubbery.
B.Screening shall be provided along the property line(s)which adjoin any lot in an"R"zone,except along the front yard.Said screening shall comply with the fencerequirementsofthezone.
C.Any of the lot which is to be driven on by automobiles shall be maintained in hardsurfacepaying.A six inch (6")by six inch (6")inner curb between drives located onthepropertylineadjoiningastreetshallherequiredforservicestationsinallzones.

3.24.185.45 Location of Loading Area:The required off-street loading area shall be located on thesamelotwiththeuseitisintendedtoserveandmayoccupyanysideorrearyardthereonprovidedthatitshallbeenclosedwhenrequiredbythisChapter.Off-street parkingareasusedtofulfilltherequirementsofthisordinanceshallnotbeusedforloadingandunloadingoperationsexceptduringperiodsofthedaywhennotrequiredtocareforparkingneeds.
3,24.190 SIGNS AND BILLBOARDS
3.24.190.10 General Standards:
A.No commercial signs shall be constructed or installed on City right-of-way
B.No commercial signs shall interfere with traffie controle.
C.All signs shall meet construction standards of the Uniform Building Code.
3.24.190.15 Signs in Commercial and Industrial Districts:
A.Off-Premise Signs:

B.On-Premise Signs:

2.The total area of signs shall not exceed one (1)square foot of area for each footofdevelopedbusinessfrontagealongthesidetowhichthesignisdirected,with atotalareanottoexceedonehundredandfifty(150)square feet.Businesses withfrontagesoflessthantwenty-five feet (25')may construct a sign with an area nottoexceedtwenty-five (25)square feet.
3.Signs shall not project more than ten feet (10')above the building containing thebusinesswhichthesignidentifies,or have an overall height not to exceed twenty-five feet (25')for a free standing sign,except in the C-4 Zone,where free standingsignscanbeamaximumofforty-five feet (45')high.
4.Signs projecting out over city right-of-way more than eight inches (8")shall notexceedfoursquarefeet(4')and must have a minimum height of eight and one halffeet(8½')from the ground level.

1.Those signs permitted in the R-1 and R-2 Districts.
2.The Planning Commission may permit on-premise signs not to exceed the standardspermittedintheC,1,C-2,or C-3 Districts after it has been shown that suchsignwillnotadverelyaffectadjacentresidentialuses.3.24.190.25 Non-Cenforming Signs and Billboards:Any non-conforming sign or billboard existing atthetimeofthepassageofthisOrdinancemaybeorderedremovedbytheBuildingInspectorthree(3)years after the date of the passage of this Ordinance or according to anamortizationschedulepreparedbythesignowners,whichever is greater.
3.24.195 MOBILE HOMEPARKS
3.24.195.10 Property Development Standards:I A.Minimumarea shall be,two (2)acres
B.Density:No more than ten (10)spaces per acre for permanent dwelling units oreighteen(18)spaces per acre for temporary units shall be permitted.
1.Every mobile home park shall be connected to city sanitary sewer,or other disposalsystemapprovedbytheCityEngineer.
2.Each permanent space shall be provided with a connection to said sewer.3.Permanent restroom facilities shall be provided for every ten (10)spaces fortemporaryunits.
1.Every mobile home park shall be connected to a supply of potable water for domesticIuse.
2.Each permanent space shall be provided with a connection to said water.
E.Utilities:All utilities shall be installed underground except for access terminals.
F,Recreational Area:Not less than eight per cent (8%)of the total gross area of the parkshallbedesignedandmaintainedasarecreationalareaforoccupantsofthepark.
G.Setbacks:
15 feett .between dwelling units10feet:from roadways15feet:from street or other right of way
E.Fences,Valls,.and Hedges:The park shall be enclosed on all sides with permanentlymaintainedsolidfence,concrete wall,or buffer of trees or shrubs a maximum ofsixfeet(6')in height on all sides not fronting on a public right·-of way and amaximumoffourfeet(4')in height on all aides fronting on a public right-of-way.
I.Access and Roadways:
1.There shall be vehicular and pedestrian access from a dedicated and improved streettothePark.Said vehicular access shall he drained and paved to a width of notlessthantwenty-four feet (24'),
2.Roads within the park shall be paved according to the following minimum standBfdS:
a.Twenty feet (20')where no on-street parking is allowed.
b.Twenty-eight feet (28')whera on-street parking is allowed only on one sideoftheroad.I c.Thirty-nix feet (36')where parking is permitted on both sides of the -road.
3.All roads and streets within the park shall be named as approved by the City -Planning Comission.The owner or operator of the park shall furnish,installandmaintainstreetsignsofatypeapprovedbytheCityEngineer.
A.All spaces in the park shall be numbered in accordance with the Moses Lake Municipalcode.
3.24.195.15 Site Review:Three (3)copies of the sita plan shall be submitted to the Zoning Administrator.No building or other permit shall be issued for any development or expansion within aparkuntilasiteplanisapprovedbythePlanningCommission.The Zoning AdministratorshallforwardacopyofthesiteplantotheCommunityDevelopmentDirectorandtheFireChief.The site plan aba11 include:
A.Park boundaries
B.Location of all dwelling spaces and structures with floor plans of all structures.
C.Location and grade of all existing and proposed roads within and bordering the park.
D.Location and sizes of all improvements and utilities,including fire hydrants andstandpipes.
E.Location and size of parking spaces.
F.Landscaping,walls,and fences.
G.Other auch data as may be required to make required findings.
I 3.24.200 RESIDENTIAL UNIT DEVELOPMENTS
3.24.200.10 Residential Unit Developments (RUD):Residential Unit Developments may be developed intheR-1,R-2,and R-3 Districts after approval of the Planning Commission in accordancewiththerequirementsofthedistrictinwhichitinlocatedandthefollowingadditionalminimumrequirements:
3.24.200.15 General Standards:In granting approval for an RUD,the Planning Commission will be guidedbythepoliciasoftheCityaswellasstandardsandrequirementsinthissection.
A.The RUD shall conform with the comprehensive Plan of the City.
8.The RUD shall be compatible with adjacent land uses and will not adversely affectthecharacteroftheareainwhichitislocated.
C.The RUDwill be designed to adequately handle the traffic it generates through street

A.The parcel shall contain a minimum of two (2)acres.,
B.The RUD shall have permanent access to a public street that is designed to adequatelycarrythetrafficitgenerates.
3.24.200.25 Density Standards:
A.Residential unite of any type (i.e.single family,duplex,townhouse,etc.)or combina-tions of types which meet the City Building Codes may be constructed within an RUD.
B.The gross density of an RUD cannot exceed six (6)units per acre in an _R-1 or R-2District,or ten (10)units per acre in an R-3 District.
3.24.200.30 Roadways and Parking:
A.All roadways within an RUD shall be paved
B.Off-street parking spaces shall be provided as specified in Section 3.24.185.20 ofthisChapter.
C.Roadways within the RUD shall be designed to carry emergency vehicles.
D.Dedicated street right of way may be required for through streets.
3.24.200.35 Utilities:
i A.All utilities and roadways shall be installed as stated in the plan before buildingpermitsareissued.
B.All utilities,including electricity and telephone shall be installed undergroundexceptforaccessterminals.
C.Sewer lines shall be installed to City standards and connected to City sewer or otherdisposalsystemapprovedbytheCityEngineer.
D.Water lines shall be installed to City standards and capable of providing enough waterforfireprotection.
E.Storm sewers shall he installed when requirecÌby the City Engineer.
3.24.200.40 Ground Surfaces:Ground surfaces shall be landscaped and maintained in a manner thatwillnotcreatedustyormuddyconditions.
3.24.200.45 Preliminary Plans Required:The applicant shall submit a may drawn to scale showing thežollowing:
A.Boundaries of proposed RUD
B.Location of roadways and streets within and adjacent to the proposed RUD.
C.Location and dimensions of all buildings
D.Off-street parking spaces
i E.Landscaping
F.Written statement outlining the general time schedule for proposed development.
3.24,200,50 gagCogingio Rgig gndggvg:Upov receiving an application for an RUD,thefollowingstepsshallhetaken:
A.The Planning Comission shall set a Public Hearing
3,The Planning Commission,following the Public Hearing,reviews the proposal in termsoftheguidelinesandregulationsinthesection.
C.The Planning Commission after reviewing the application may give preliminary approval,give preliminary approval subject to specific changes,or deny the applicationIasnotmeetingtherequirementsorstandardsofthisOrdinance.
D.If no major changes have been made in the preliminary plans,the Zoning Administratormaygrantfinalapproval.If any major changes are made from the preliminary plans,revised plans shall be presented to the Planning Comission for final approval.Approved RUD's shall he indicated on the official City 2oning map.2,Certificates of occupancy shall not he issued within an RUD until final approval hasbeengranted,or a bond has been posted to cover the uncompleted work.
3.24.200.55 Maior Changes or Construction:No major changes or construction may be made within an RUDafterithasreceivedfinalapprovalwithoutapprovalofthePlanningCommission.3.24.200.60 Preliminary Approval:Preliminary approval of an RUD shall expire twelve (12)months fromthedateitwasgrantedifabuildingpermithasnotbeenissuedforconstruction.
3.24.205 NON -CONFORMING USES
3.24.205.10 Continuation of Non-Conforming Use.The lawful use of land existing at the time of thepassageofthisOrdinance,although such use does not conform to the provisions hateof,may continue provided,however,that non-conforming businaas and industrial uses beingoperatedonopenlandorinbuildingshavinganassessedvalueoftwohundreddollars($200)or less may be continued for a period of not longer than two (2)years afterthisOrdinancebecomeseffective,and if such non-conforming use is abandoned,or isdiscontinuedforaperiodofsir.(6)months or more,subsequent use of said land shallbeinconformitywiththeprovisionsofthisordinance.The extension of a non-conformingusetoaportionofastructurewhichwasarrangedordesignedforthenon-conforminguseatthetimethisOrdinancebecomeseffective,shall not be considered an extensionofanon-conforming use.
3.24.205.15 Non-Conforming Structure:A structure conforming with respect to use but non-conformingwithrespecttoheight,satback,or coverage may be altered or extended if the alterationiorextensiondoesnotdeviatefurtherfromthestandardsofthisOrdinance,unless otherwisestatedinthischapter.
3.24.205.20 Change of a Non-conformiñA Use:If a non-conforming use is replaced by another use,thenewuseshallconformtothisOrdinanceandshallnotsubsequentlybereplacedbyanon-conforming use.
3.24.205.25 Change of District:The foregoing provisions shall also apply to non-conforming usesindistrictshereafterchanged-or established and any time limit for the suspension ofanon-conforming use of land shall date from the date of the enactment of this Ordinanceoranyamendmentofdistrictboundaries.
3.24,205.30 Remodeling a Non-Conforming Use:Recognizing that there are non-conforming buildingsorstructureswhicharenowexistingwhichshouldbeupgradederimprovedbyreplacement,rebuilding,or additon thereto,the City Council may,after a Public Eearing before thePlanningCommission,issue a permit for the replacement,rebuilding,or addition to anexistingnon-conforming building or structure.As a condition to the issuance of thepermit,the City Council shall require plans and specifications of the proposed replacement,rebuilding,or addition be filed and that a bond in an amount to be set by the Council bepostedtoassurecompliancewiththeplansandspecificationssofiled.No permit shallbeissuedunlesstheCityCouncilfindsthattheproposedreplacement,rebuilding,oradditionwillbecompatiblewiththelotortractoflandinvolvedand,further,that itwillnotbedetrimentaltothehealth,safety,or welfare of the surrounding area.
3.24.210 PU3LIC HEARING PROCEDURES
3.24.210.10 Public Hearing:Nherever a Public Rearing is required by this Ordinance,it shall beheldbeforethedesignatedbodyinthefollowingmanner:
A.Time of Heating:Upon the filling out of an application for an action requiringiaPublicHearing,the Chairman of the hearing body shall set a hearing date.Thehearingshallbewithinforty(40)days of when the application is filed.
8.Notice'Notice of the hearing shall he given by publishing the same twice in theofficialnewspaperofthecityofMosesLake.Said publications shall be at laaetseven(7)days apart and the last publication shall be made not more than three (3)I days prior to the date of the hearing.Notices shall be posted on the site of theproposedaction.Said notices shall state the date,time,place of hearing,and thegeneraltermsoftherequest.Notices shall be sent by mail to adjoining propertyownersaslistedentheGrantCountAssessorsrolesforallzonechangerequests andconditionaluserequests.
C.g:The application for any action requiring a hearing shall be accompanied by atwenty-five dollar ($25)fee to cover costs of the hearing.The fee for all sone ,change requests and conditional use requests shall he fifty dollars ($50),
D.Records:The proceedings of all hearings and the reasons for the ensuing decisionsshallbemadeapartoftheminutesofthehearingbody,
3.24.215 APPEALS
3.24.215.10 Right of Appeal:Rulings made by any administrative officer,board or commission încarryingouttheprovisionsofthisChaptermaybeappealedwithinten(10)days thereafterbyanypersonaggrived,
3.24.215.15 Appeal of Administrative Rulings:Rulings of the 2oning Administrator may be appealedtothePlanningCommission,which shall have the power to affirm,overrule,or altersaidrulings.
3.24.213.20 Appeal of Commission Rulings:Rulings of the Planning Commission may be appealed to theCityCouncilwhichshallhavethepowertoaffirm,overrule,or alter said rulîngs.3.24.215.25 Appeal Procedure:Within ten (10)days after a ruling has been appealed,the appellantshallsubmitawrittennoticeoftheappealstatingthegroundsthereoftothebodyhearingtheappealandacopyofsaidnoticetothepersonerbodywhoserulingisbeingappealed.The body hearing the appeal may request such additional evidence asisrelevanttotheappeal,
i 3.24.213.30 Appeal Stay of Proceedi¤¾s:An appeal stays all proceedings in furtherance of the actionappeaiedfrom.
3.24.220 ZONING BOARDOF ADJUSTMENT
3.24.220.10 zoning Board of Adiustment Orp,anization:The Zoning 3oard of Adjustment shall consistoffive(5)members appointed by tha City Manager.One (1)Board member shall be selectedfromtheappointedmembersofthePlanningCommission,and four (4)from other citizensatlarge.All appointments shall be for terms of five (5)years subject to imediate termina-tion by the City Managet for malpractice or non-performance of duties.All members of the3eardshallservewithoutcompensation,The 3oard shall elect its own Chairman.The CommunityDevelopmentDirectorshallserveastechnicaladvisortotheBoard.3.24.220.15 Meetings:Meetings of the Zoning 3oard of Adjustment shall be scheduled by the BoardChairmanatsuchtimesashedetermines,Notice of 'all meetings shall be given to Eoardmembersatleastforty-eight (48)hours before the meeti.ng is scheduled.All meetingsandtheminutesthereofareopentothepublic.
3.24.220.20 Jurisdication and Duties:Where in specific cases due to exceptional conditions peculiartothepropertyinquestion,the literal application of the provisions of this Chapterwillresultinunnecessaryhardship,the Board shall have the power to grant a.variancefromthestrictletterofthisChapter,so that the spirit of the Chapter will be observedandsubstantialjusticedone.Such variance may be granted by the Board after a PublicHearingandafindingthatthevariancewillnotbedetrimentaltoadjoiningpropertiesorcontrarytothepublicinterest,and that it will alleviate a clearly demonstrated hard-ship approaching confiscation,as distinguished from a special privilege of convenienceorincreasedfinancialreturnsoughtbytheowner.However,the 30erd shall not vary anyoftherules,regulations,or provisions of the Chapter unless it shall find that bothofthefollowingconditionsexistineachcaseofarequest:i A.That the plight of the owner is due to unique circumstances which are not the generalconditionoftheneighborhood,or zone in which it is located and are not the resultoftheowner's action.
2.That the use requested by the appellant,if established,will not be of generalclassificationdifferingfromtheessentialuseprovisionsofthezoneinwhich thelandand/or structure is located.
3.24.220.25 Decisions:A favorable vote of three (3)members shall be required to grant a variance infavoroftheapplicant.Decisions of the Board shall be final,subject only to appealtothecourtsoftheStateofWashingtonasprescribedbylaw.Decisions made by theZoningBoardofAdjustmentshallheincludedintheminutesoftheBoard.Reasonasupportingdecisionsshallalsobemadeapartoftheminutes.
3.24.225 AMENDMENTSAND ZONE CHANGES
3.24.225.10 Amendments and 2oning Change Procedures:The regulations,classifications,or zone boundaryilinesmaybeamendedbyordinanceinthefollowingmanner:
A.The Planning Commission,upon receipt of an amendment or zone change request,or afteramotionofitsownshallinvestigatethemeritsoftherequestandmaysetaPublicRearingdateatwhichtimetherequestcanbeconsidered.
B.Following the hearing,the Planning Commission shall forward its recommendation andfindingstotheCityCouncil
C.After receiving a recommendation from the Planning Commission and after a PublicHearinghasbeenheldbeforetheCouncil,the Council may consider the request.If the Council finds the amendment is in the public interest,benefits the publicwelfareofthecommunity,and is consistant with the City General Plan,it shallsoamendthisChapter.
3.24.230 20NE BOUNDARIES
Zone boundaries,unless otherwise indicated,are lot lines or the center line of streetsandalleysasshownontheOfficialZoningMap.Where the street layout actually on thegroundvariesfromthatshownontheZoningMap,the designatione shown on the map shallbeappliedtothestreetsasactuallylaidoutsoastocarryouttheintentandpurposesofthisChapter.Where the location of the zone boundaries are shown on the 2oning Maptobeotherthanstreet,alley,et Lot lines,the depth of the zone shall be the same asthatmeasuredbyscaleontheOfficialZoningNap.
If a zone boundary line cuts a property having a single ownership as of record at the timeofthepassageofthisChaptet,the property may be used in conformance with the zoningdesignationsandboundariesasshownontheOfficial2oningMap.A property owner in thiscasemayappealtothePlanningCommissionforavariancetopermithimtoapplythelessrestrictivezonato811hisproperty,i 3.24.235 CERTIFICATE OF OCCUPANCY
Eefore any use is established upon land or within a building,it shall be the responsibilityoftheownerofsaidlandorbuildingtoinquireofthe2oningAdministratorastowhetherornotsuchuseconformstotheregulationsofthezonewhereitistohalocated.
Upon written request of the owner,the toning Administrator shall,after inspection,issueacertificateofOccupancyforanybuildingorlandstatingwhethertheuseconformstotheprovisionsofthisChapter,or is a lawful non-conforming use.
3.2A.240 VIOLATION AND PENALTIES
Any person,firm,or corporation who violates,disobeys,omits,neglects,or refusestocomplywithorwhoresiststheenforcementofanyoftheprovisionsofthisChaptershallhedeemedguiltyofamisdemaanorandshallbefinedinanysumnotmorethanthreehundreddollars($300).or imprisonad.fa,the city jkilf fer a term &t exceedingninety(90)days,or both for each such offense.
3.24.245 SEVERABILITY
Should any section,clause,or prevision of this Chapter be declared by the ciourts tobeinvalid,the same shall not affect the validity of the Chapter as a whole or anypartthereof,other than the part so declared to be invalid,
