AN ORDINANCE REPEALING EXISTING CHAPTER3.32 (ORDINANCE
NO.715)OF THE CITY CODE AND ENACTING A NEW CHAPTER 3.32
REFERRED TO AS THE "FIRE CODE"BY ADOPTING THE 1976 EDITION
OF THE UNIFORMFIRE CODE,EXCEPT AS DELETED,MODIFIED OR

AMENDEDBY THIS ORDINANCE.
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,DO ORDAIN AS FOLLOWS:
3.32 UNIFORM CODE ADOPTED
The City Council of the City of Moses Lake adopts the 1976 Edition of the Uniform
Fire Code.The code is adopted in the whole,including appendices,save and except
such portions that are deleted,modified,or amended by this ordinance.Three copies
of the 1976 Edition of the Uniform Fire Code are now on file in the office of theClerkoftheCityofMosesLakeandthesameareadoptedandincorporatedasfully
as if set out at length herein.
3.32.16 AMENDMENTS MADE IN THE UNIFORMFIRE CODE
The Uniform Fire Code is amended and changed in the following respects:
A.Section 12.102,and Section 12.103 are hereby repealed.
B.Section 15.704 (F)is amended to read as follows:
Special Type Dispensers
All self-service dispensers of gasoline or other flammable liquids shall be
installed in such a manner that they necessitate re-activation by the attendantaftereachdeliveryofproduct.Each self-service shall also be protectedibyanemergencyshut-off switch.
Location of emergency shut-off switches and switches to re-activate dispensersshallbeacceptabletoauthorityhavingjurisdiction.
Where full service islands are operated in addition to the self-service;anadditionalemergencyshut-off switch shall be installed at the full service
island.
There shall be at least one qualified attendant on duty while the station is
open to the public.
The attendants primary function shall be to supervise,observe and control thedispensingofClassIliquidswhilesaidliquidsarebeingdispensed.It shall
be the responsibility of the attendant to prevent the dispensing of Class Iliquidsintoportablecontainersnotincompliancewithsection15.703 (d),control sources of ignition,and to immediately handle accidental spills andfireextinguishersifneeded.
1.The attendant or supervisor ou duty shall be capable of performing thefunctionsandassumingtheresponsibilitiescoveredinthissection.
2.Instructions for the operation of dispensers shall be conspicuously posted,

use so that dispenser cannot be activated without the knowledge of theattendant.
C.Section 35,101.In no event shall fruits or vegetables of the tree or vinestoredinbuildingsorwarehouses,constitute combustible stock for the purposeofapplicationoftheUniformFireCode.

FILING
That three copies of the Uniform Fire Code together with amendments thereto,asamendedandhereinmodified,shall be filed for use and examination by the public
in the Office of the Clark of the City of Moses Lake prior to the adoption hereof,
and said copies of said codes as amended,shall remain in said office for use and
examination by the public at all times subsequent to the adoption of this ordinance,
together with all amendments thereto as hereafter amended.
VIOLATIONS AND PENALTIES
Any person,firm,or corporation who violates,disobeys,omits,neglects or refuses
to comply with or who resists the enforcement of any of the provisions of this
pydinance shall be deemed guilty of a misdemeanor and shall be fined in any sum
not.more than five hundred dollars ($500)or imprisoned in the county jail for a
term not exceeding ninety (90)days,or both for each such offense.Each separate
day or any portion thereof during which any violation of this Code occurs or continues
shall be deemed to constitute a separate offense,and upon conviction thereof shall
be punishable as herein provided.The issuance or granting of a permit or approval
of plans and specifications shall not be deemed or construed to be a permit for,
or an approval of,any violation of any of the provisions of the Code.No permit
presuming to give authority to violate or cancel the provisions of this Code shall
be valid,except insofar as the work or use which it authorized is lawful,
REPEALING CONFLICTING ORDINANCES
Any and all ordinances or parts of ordinances in conflict herewith are hereby repealed.
VALIDITY
The invalidity of any part of this ordinance shall not effect the validity of any
other part which can be given effect without such invalid part or parts.
EFFECTIVE DATE
This ordinance shall take effect and be in force five (5)days after its passage
and publication as provided by law.
