AN ORDINANCEADOPTING THE WASHINGTON MODELTRAFFIC
ORDINANCEAND OTHERTRAFFIC STATUTES TO REGULATE
TRAFFIC ON THE HIGHWAYS OF THE CITY OF MOSES LAKE
AND REPEALING PORTIONS OF ORDINANCE NO.629 AND ALL
OTHERORDINANCES AND SECTIONS OF ORDINANCES IN
CONFLICT THEREWITH.
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FOLLOWS:I Section 1,ADOPTION BY REFERENCE.The "Washington Model Traffic Ordinance,"Chapter46.90 RCW,hereinafter referred to as the "MTO,"and RCW46.32.088,46.61,072,46,61,202,46.61.215,46.61.261,46.61.264,46.61.266,46.61.269,46.61.520,46,61.540,46.61.606,46,61.608,46.61.614,and 46,64.017 are hereby adopted by reference as and for thetrafficordinanceofthisCityasifsetforthinfullherein.
Section 2,PENALTIES.Unless another penalty is expressly provided by law in the MTO
or in the statues that are adopted by reference therein,any person who is convicted
of violating or failing to comply with any of the provisions of this ordinance shallbepunishedbyafineofnotmorethan$500 or by imprisonment not to exceed ninety
(90)days,or both.
Section 3,DISPOSITION OF TRAFFIC FINES AND FORFEITURES.All fines or forfeitures
collected upon conviction or upon the forfeiture of bail of any person charged with
a violation of any of the provisions of this ordinance shall be paid into the generalfundoftheCity.
Section 4,OFFICIAL MISCONDUCT.Failure,refusal,or neglect on the part of any judicial
or other officer or employee receiving or having custody of any such fine or forfeitureofbail,either before or after a deposit in said general fund,to comply with theprovisionsofSection3shallconstitutemisconductinofficeandshallbegroundsforremovaltherefrom,provided appropriate removal action is taken pursuant to statelawrelatingtoremovalofpublicofficials.
I Section 5,FILING OF ORDINANCE.Incident to the adoption of the MTOby reference,by this ordinance,copies of the text of the adopted MTO and of other adopted statutesshallbefiledasrequiredbyRCW35.21.180 for use and examination by the public.
Section 6,REPEAL.Ordinance No.629,and all ordinances or parts of ordinances in conflict
herewith,with the exceptions of Sections 141,142,209,230,236,237,241,249,251,256,257,258,259,260,261,271,289,291,292,and 304;are hereby repealed.
Section 7,SKVERABILITY CLAUSE.If any provision of this ordinance or its applicationtoanypersonorcircumstanceisheldinvalid,the remainder of the ordinance,or theapplicationoftheprovisiontootherpersonsorcircumstancesisnotaffected.
Section 8,EMERGENCY CLKUSE.This ordinance is necessary for the immediate preservationofthepublicpeace,heaith,and safety,and the support of the City Government;anamergencyisdeclaredtoexist;and this ordinance shall take effect immediately.
