804_00001ORDINANCE NO.804 i AN ORDINANCE REPEALING SECTIONS 6.26.12,6.26.16,6.26.24,6.26.28,6.26.32 and 6.26.40 OF CHAPTER6.26 OF THE MOSES LAKE CITY CODE,ENTITLED PAWNBROKERS,AND ENACTING NEW SECTIONS 6.26.12,6.26.16,6.26.24,6.26.28 AND 6.26.40 TO SAID CHAPTER THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DOORDAINASFOLLOWS: SECTION 1 -PKWNBROKERS.The pawnbroker chapter of the MosesLakeCityCodeisamendedasfollows: 6.26.02 -SPECIFIC REPEAL.Sections 6.26.12,6.26.16,6.26.24,6.26.28,6.26.32 and 6.26.40 are hereby repealed in their entirety. 6.26.12 -RECORDS.It shall be the duty of every pawnbrokertomaintainathisplaceofbusinessabookorotherpermanentrecord,in which shal'1 be legibly written,in the Englishlanguageatthetimeofsuchloan,purchase or sale,a recordthereofcontaining: 1.The date of the transaction; 2.The name of the person or employee conducting the same; i 3.The name,age,street and house number,and the generaldescriptionofthedress,complexion,color of hair andfacialappearanceofthepersonwithwhomthetrans-action is had; 4.The name and street and house number of the owner ofthepropertyboughtorreceivedinpledge; 5.The street and house number of the place from which thepropertyboughtorreceivedinpledgewaslastremoved; 6.A description of the property bought or received inpledge,which,in the case of watches,shall containthenameofthemakerandthenumberofboththeworksandthecase,and in case of jewelry shall contain adescriptionofalllettersandmarksinscribedthereon; 7.The price paid or the amount loaned; 8.The name and street and house numbers of all personswitnessingthetransaction; I 9.The number of any pawn tickets issued therefor. Anyone who pledges,sells or consigns any property to or with a pawn shop or pawnbroker shall sign the records required to be kept by such dealer with his true nameandshallincludehiscorrectresidenceaddress. (0.209 83--1953) 6.26.16 -TRANSCRIPT OF RECORD FURNISHED TO POLICE.It shall be the duty of every pawnbroker,before twelve (12)o'clock noon,of every business day,to report to the Chief of Police on blank form,to be furnished by the Police Department,afull,true and correct transcript of the record of all trans-actions had on the preceding day.It shall also be the duty of any pawbroker having good cause to believe any property in his possession has,been previously lost or stolen,to report such fact to the chief of Police,together with the name of the owner,if known,and the date of an name of the person from whom the same was received by such pawnbroker. 6.26.24 -RATES OF INTEREST AND SALE.All pawnbrokers areauthorizedtochargeandreceiveinterestandotherfeesat the following rates for money loaned on the security of personal property actually received in pledge: (1)The interest shall not exceed:(a)For an amount loaned up to $19.99 =interest at $1.00 per month; (b)For an amount loaned from $20.00 to $39.99 =interest at the rate of $1.50 per month; (c)For an amount loaned from $40.00 to $75.99 =interest at the rate of $2.00 per month; (d)For an amount loaned from $76.00 to $100.99 =interest at the rate of $2.50 per month; (e)For an amount loaned from $101.00 to $125.99 =interest at the rate of $3.00 per month; (f)For an amount loaned from $126.00 or more =interest at the rate of three percent (3%)a month; (2)The fee for the pagaration of documents,pledges or reports required under laws of the United States of America,the State of Washington,Grant County or the City,shall not exceed: (a)For the amount loaned up to $4.99 =the sum of $.50; (b)For the amount loaned up to $5.00 to $9.99 =the sum of $2.00; I Ordinance No.804/Pg.3 (c)For the amount loaned from $10.00 to $19.99 =the sumiof$3.00;(d)For the amount loaned from $20.00 to $39.99 =the sumof$4.00;(e)For the amount loaned from $40.00 to $74.99 =the sumof$5.00;(f)For the amount loaned from $75.00 to $99.99 =the sumof$7.50;(«g)For the amount loaned from $100.00 or more =the sumof$9.00; (3)The fee for the care,maintenance,insurance relating to,preparation for storage of,and storage of personalpropertyactuallyreceivedinpledge,shall not exceed:(a)For precious jewels,jewelry,or other personal propertyhavingavalue$100.00 to $299.99,an amount equal toone-tenth (1/10)of one percent (1%)of the value thereof as agreed upon in writing between the pledgor and thepledgee;(b)For precious jewels,jewelry,or other personal propertyhavingavalueexceeding$299.99,an amount equal toone-twelfth (1/12)of one percent (1%)of the value thereof as agreed upon in writing between the pledgor and pledgee; (4)Fees under subsections (2)and (3)may be charged one timeonlyduringthetermofapledge,and every person who shall ask or receive a higher rate of interest or discannt or other fees on any such loan,or on any actual or pre-tended sale,or redemption of personal property,or who shall sell any property held for redemption within ninety (90)days after the period for redemption shall haveexpired,shall be guilty of a misdemeanor. 6.26.28 -GOODS NOT TO BE REMOVED FROM PAWN.SHOP.It shall be unlawful for any pawnbroker to remove any goods,articles or thing purchased by him,in pledge,from hisstoreorplaceofbusinessuntiltheexpirationoffour(4)days after the receipt thereof shall have been reportedtotheChiefofPoliceashereinprovided,except when redeemed by the owner thereof. 6.26.40 -PENALTIES.Every pawnbroker and every clerk,agent,or employee of a pawnbroker shall be guilty of a misdemeanor,who: .1.Fails to make an entry of any material matter in his 2. _reck rds ofalse entry therein;or 3.Falsifies,obliterates,destroys or remov s fromhisplaceofbusinessanybookorrecord;or 4.Refuses to allow the prosecuting attorney or any peaceofficertoinspecthisrecords,or any goods in his possession,during the ordinary hours.of business;or 5.Reports any material matter falsely to the Chief ofPolice;or 6.Having forms provided therefor,-fails to before noonofeachdaytofurnishtheChiefofPolicewithafull, true and correct transcript of the record of all trans-actions had on the previous day,it being the intent of this section that Saturday's business may be reported on Monday)or 7.Fails to report forthwith to the Chief of Police thepossessionofanypropertywhichhemayhavegoodcause to believe has been lost or stolen,together with the name of the owner,if known,and the date when,and the name of the person from whom the.same was received by him;or 8.Removes or allows to be removed from his place of business,except upon redemption by the owner thereof, any property received,before four (4)days have elapsed since the receipt thereof was reported to theChiefofPolice;or. 9.Receives any property from any person under the age of eighteen (18)years,any common drunkard,any habitual user of narcotic drugs,any habitual criminal,any person in an intoxicated condition,any known thief or receiver of any stolen property,or any known assoc- iate of such thief or receiver of stolen property, whether such person be acting in his own behalf or astheagentofanother. SECTION 2 -GENERAL REPEAL.Any and all Ordinances and parts of Ordinances in conflict herewith are hereby repealed. SECTION 3 -SEVERABILITY.If any provision of this ordinance or its application to any person or circumstance is held invalid, the remainder of the Ordinance,or the application of the pro- vision to other persons or circumstances is.not affected. i i Ordinance No.804/Pg.5 SECTION 4 -EFFECTIVE DATE.This Ordinance shall take effectandbeinforcefive(5)days after its passage and publication as provided by law.
