815_00001ORDINANCE No.815 AN ORDINANCE RELATING TO THE ADMINISTRATION OF THE CITY, CREATING DEPARTMENTS,OFFICES,AND POSITIONS OF EMPLOYMENT, DETERMINING THE POWERS AND DUTIES THEREOF AND REPEALING CERTAIN INCONSISTANT CKAPTERS OF TITLE ONE OF THE MOSES LAKE CITY CODE. I THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FOLLOWS: Section l SPECIFIC REPEAL Chapters 1.1 excepting existing section 1.1.04,1.14,1.15,1.24,1.28,1.30,and 1.32 are hereby repealed in their entirety. Section 2 ADMINISTRATIVE CODE The following shall be the Administrative Code for theCityofMosesLake. CEAPTER 1.2 -CITY MANAGER 1.2.04 POWERS AND DUTIES OF CITY MANAGER The City Manager shall have such powersanddutiesasareconferreduponhimbystatutes,city ordinances and resolutions,and those authorized from time to time by motion of the City Council at an official meeting. CKAPTER 1.4 -DEPARTMENTS ESTABLISHED 1.4.04 DEPART¾ENTS ESTABLISHED The following departments of the City of Moses Lake are hereby established: A.Finance Department B.Public Works Department C.Community Development Department i D.Park and Recreation Department E.Police Department F.Fire Department CKAPTER 1.5 -FINANCE DEPARTMENT 1.5.04 DEPARTMENTAL POWERS AND DUTIES The Department shall be responsible to theCityManagerforeffectiveadministrationandshallhaveallthepowersandperform such other duties as provided by the law of the State of Washington,the Moses LakeCityCode,ordinances gnd resolutions,and the City Manager. 1.5.08 APPOINTMENT AND DUTIES OF DIRECTOR The City Manager shall appoint the Finance Director who shall be the best trained and qualified person available. The Director shall be responsible to the City Manager for management of the Finance Department,supervision of departmental employees,and for effective administrationoffinancialactivities. The Director shall be designated City Treasurer and City Clerk to perform in suchcapacitywheneverthelawsofthestateortheordinancesofthecitymakereferencetosuchpositions. I The City Manager may appoint subordinate employees from the Finance Department toassistintheperformanceofthedutiesofCityTreasurerandCityClerkandtoactintheabsenceoftheDirector. CHAPTER l.6 -PUBLIC WORKS DEPARTMENT 1.6.04 DEPARTMENTAL POWERS AND DUTIES The Department shall be responsible to theCityManagerforeffectiveadministrationandshallhaveallthepowersandperformsuchotherdutiesasprovidedbythelawoftheStateofWashington,the Moses LakeCityCode,ordinances,and resolutions,and the City Manager. 1.6.08 APPOINTMENT AND DUTIES OF DIRECTOR The City Manager shall appoint the Public Works Director who shall be the best trained and qualified person available. The Director shall be responsible to the City Manager for management of the Public Works Department,the supervision of departmental employees,and for effective adminis- tration,construction,and development of public work and related public facilities. The Director shall be designated City Engineer and Street Supervisor to perform in such capacity whenever the laws of the State of Washington or the ordinances of the city make reference to such positions. The City Manager may appoint subordinate employees from the Public Works Department .to assist in the performance of the duties of City Engineer and Street Supervisor and to act in the absence of the Director. CHAPTER 1.7 -COMMUNITY DEVELOPMENT DEPARTMENT 1.7.04 DEPARTMENTAL POWERS AMD DUTIES The Department shall be responsible to the City Manager for effective administration and shall have all the powers and perform such other duties as provided by the law of the State of Washington,the Moses Lake City Code,ordinances,and resolutions,and the City Manager. 1.7.08 APPOINTMENT AND DUTIES OF DIRECTOR The City Manager shall appoint the Community Development Director who shall be the best trained and qualified personavailable. The Director shall be responsible to the City Manager for management of the Community Development Department,supervision of departmental employees,and for the effective administration of Community Development activities. CHAPTER 1.8 -PARK AND RECREATION DEPARTMENT 1.8.04 DEPARTMENTAL POWERS AND DUTIES The Department shall be responsible to the City Manager for effective administration and shall have all the powers and perform such other duties as provided by the law of the State of Washington,the Moses Lake City Code,ordinances,and resolutions,and the City Manager. 1.8.08 APPOINTMENT AND DUTIES OF DIRECTOR The City Manager shall appoint the Park and Recreation Director who shall be the best trained and qualified person available. The Director shall be responsible to the City Manager for management of the Park and Recreation Department,supervision of departmental employees,and for the effective administration,construction,and development of the public park and recreation system. CHAPTER 1.9 -POLICE DEPARTMENT 1.9.04 DEPARTMENTAL POWERS AND DUTIES The Department shall be responsible to the City Manager for effective administration and shall have all the powers and perform such other duties as provided by the law of the State of Washington,the Moses Lake City Code,ordinances,and resolutions,and the City Manager, 1.9.08 APPOINTMENT AND DUTIES OF CHIEF The City Manager shall appoint the Police Chief after certification by the Moses Lake Civil Service Commission. The Chief shall be responsible to the City Manager for management of the Police Depart- ment and the supervision and training of departmental employees. CHAPTER 1.10 -FIRE DEPARTMENT 1.10.04 DEPARTMENTAL POWERS AND DUTIES The Department shall be responsible to the City Manager for effective administration and shall have all the powers and perform such other duties as provided by the law of the State of Washington,the Moses Lake City Code,ordinances,and resolutions,and the City Manager. 1.10.08 APPOINTMENT AND DUTIES OF CHIEF The City Manager shall appoint the Fire Chief after certification by the Moses Lake Civil Service Commission. The chief shall be responsible to the City Manager for management of the Fire Department and the supervision and training of departmental employees. Section 3 REPEALING CONFLICTING ORDINANCES Any and all ordinances or parts ofordinancesinconfÏictherewitareherebyrepealed. Section 4 SEVERABILITY The invalidity of any part of this ordinance shall not effect the validity of any other part which can be given effect without such invalid part or parts. Section 5 EFFECTIVE DATE This ordinance shall take effect and be in force five(5)days after its passage and publication as provided by law.
