AN ORDINANCE REPEALING CHAPTER 1.19 OF THE MOSES LAKE CITY
CODE ENTITLED "RESERVE POLICE"AND ENACTING A NEW CHAPTER
1.19 ENTITLED "POLICE RESERVES".
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FOLLOWS:
Section 1.SPECIAL REPEAL Chapter 1.19 entitled "Reserve Police"is repealedinitsentirety.I Section 2.NEW CKAPTER ENACTED Chapter 1.10 entitled "Police Reserves"isenactedasfollows:
1.19.04 Reserves -Number and Appointment The Moses lake Police Reserve Unit
may be composed of up to thirty members.Each member shall be appointed by theChiefofPolicewiththeapprovaloftheCityManager.The Moses Lake Police
Reserves shall function under the general supervision of the Chief of Police.
1.19.08 Membership To be eligible for membership in the Moses Lake Police
Reserves,each candidate must file an application with the chief of Police;indicata a willingness to serve a minimen of twenty hours per month;meet theminimumqualificationsprescribedformembershipintheregularpoliceforce;complete the training program;be appointed by the Chief of Police;take anoathofoffice;and be sworn in.
1.19.12 Membership Card and Badge The City of Moses Lake will furnish eachmemberofthepolicereserveswithamembershipidentificationcardandabadge.The membership identification card is to be carried by each member at all times.Gius police badge is to be worn only when the reserve police officer is authorized
to wear the ,prescribed uniform.
1.19.16 Revocation of Membershig Membership of any person in the Moses LakePolicereservesmayberevokedatanytimebytheChiefofPolice.Any memberofthepolicereservesmayresignuponnotificationoftheChiefofPolice.Upon
separation from the organisation,all equipment issued by the City of Moses Lakemustbeturnedinimmediately.
I 1.19.20 Members Not City Employees No member of the Moses Lake Police Reserves
shall be regarded as a City employee for any purpose subject to Police Civil
Service rules and regulations,nor entitled to benefits of the Law Enforcement
and Fire Fighters Retirement System.
1.19.24 Powers and Duties Members of the Moses Lake Police Reserves shallhaveallthosepowersandshallperformallthedutiesthattheChiefofPoliceshallofficiallyauthorize.Under no circumstances shall a reserve Police Officerexerciseanypowerwhilenotintheperformanceofdutiesotherthanthoseauthor-imed by the Chief of Police or by a regular police officer.
1.19.28 Compensation Members of the Moses Lake Police Reserves shall serve with-out compensation,but the City of Moses Lake shall pay the cost of furnishinguniformsandequipment.
1.19.32 Insurance Insurance coverage for members of the Moses Lake PoliceReservesforinjuriesordeathintheperformanceofdutyshallbeprovided underStateIndustrial.False arrest insurance shall be provided by the City of MosesLake.
Section 3.SEVERABILITY The invalidity of any part of this ordinance shallnoteffectthevalidityofanyotherpartwhichcanbegiveneffectwithout suchinvalidpartorparts.
Section 4.EFFECTIVE DATE This ordinance shall take effect and be in force five(5)days after its passage and publication as provided by law.
