AN ORDINANCE REPFALING CHAPTER 2.1 OF THE MOSES LAKE MUNICIPALCODEENTITLED,"UNIFORM COMMUNITY STANDARDS"AND ENACTING A NEWCHAPTER2.1 ENTITLED "COMMUNITY STREET AND UTILITY STANDARDS",BYADOPTINGSYREFERENCETHESTANDARDSPECIFICATIONSFORMUNICIPALPUBLICWORKSCONSTRUCTIONOFTHEWASHINGTONSTATECHAPTEROFTHEAMERICANPUBLICWORKSASSOCIATION,PUBLISHED IN 1977 AND MAKINGAMENDMENTSTHERETO.
I THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FOLLOWS:
Section 1 SPECIFIC REPEAL Chapter 2.1 is hereby repealed in its entirety.
Section 2 NEW CHAPTER ENACTED Chapter 2.1 entitled "Community Street and Utility
Standards"shall be as follows:
2.1.04 STANDARDS ADOPTED In order to provide for a uniform community standard forallworkperformedforthecityorupontheirbehalf,the City of Moses Lake does herebyadoptbyreferenceallthetermsandconditionsoftheStandardSpecificationsforMunicipalPublicWorksConstructionoftheWashingtonStateChapteroftheAmericanPublicWorksAssociationpublishedin1977andtheamendmentstheretowhichareentitledCommunityStreetandUtilityStandards.Three copies of said Standard SpecificationsforMunicipalPublicWorksConstructionandCommunityStreetandUtilityStandardsareonfilewiththeCityClerkoftheCityofMosesLake.All contracts and agreementshereinafterenteredintobythecityorupontheirbehalf,shall be in compliance withtheseStandardsunlessadditionsordeletionsareapprovedbythecityinwriting.
2.1.08 CONDITIONS FOR CONSTRUCTION It shall be unlawful for any person,firm,orcorporationtocommenceworkorconstructiononanypublicright-of-way or to disturbanyexistingcityutilitywithoutoneormoreofthefollowingconditions:
A.An approved Performance Bond
B.A Street Obstruction Bond and the required permitiC.An approved Subdivision Bond or surety and a street Obstruction Bond with therequiredpermit.
D.A franchise approved by the City Council.
2.1.12 EXEMPTIONS ALLOWED Small maintenance contracts by the city to existing facili-ties,day labor and emergency work may be exempted by the city from the requirementsofthisordinance.
2.1.16 VIOLATION -PENALTY Any perso¤«firm,or corporation who shall violate or failtocomplywiththeprovisionsofthisordinanceshallberesponsibleforallliabilityresultingforhisactionsortheomissionofhisactionsandshallmakefullrestitutiontothecityofMosesLakeandbeitfurtherprovidedthatthesameshallbedeemedguiltyofamisdemeanor.
Section 3 EFFECTIVE DATE This ordinance shall take effect and be in force five (5)days after its passage and publication as provided by law.
