830_00001ORDINANCE NO.830 AN ORDINANCE REPEALING SECTION 6.28.08,6.28.16,6.28.32 AND 6.28.36OFCHAPTER6.28 OF THE MOSES LAKE CITY CODE ENTITLED "SECOND HANDDEALERS",ENACTING A NEW SECTION 6.28.16 AND 6.28.32 AND AMENDING SECTION 6.28.12. THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FOLLOWS: Section 1 -Specific Repeal Section 6.28.08,6.28.16,6.28.32 and 6.28.36 ofItheMosesLakeCitycodeareherebyrepealedintheirentirety. Section 2 -Section 6.28.16 There is hereby enacted a new section 6.28.16 totheMosesLakeCityCodewhichshallreadasfollows: 6.28.16 License -Revocation Any license issued under the provision of thischaptershallhesubjecttorevocationforanyviolationoftheordinanceof the City of Moses Lake,laws of the State of Washington,or laws of the United States.The licensa shall be revoked by the Finance Director after his determing that a violation has occurred.Personal notice of,and the particulars of,theallegedviolationshallbegiventhelicenseeatleastthree(3)days before therevocationdate.Licensee may file a notice of appeal within ten days after receipt of notice.Such appeal will be heard by the City Council at the next regularly scheduled Council meeting. Section 3 -Section 6.28.32 There is hereby enacted a new section 6.28.32 to the Moses Lake city Code which shall read as follows: 6.28.32 Penalties Every second-hand dealer or clerk,agent or employee of such second-hand dealer shall be guilty of a misdemeanor if that person shalli (1)Fail to make an entry of any material matter in his book or recordkeptasprovidedinsection6.28.20; (2)Make any false entry therein;or,I (3)Falsify,obliterate,destroY,or remove from his place of business such book or record;or (4)Refuse to allow the City Attorney or any peace officer to inspect the same,or any goods in his possession,during the ordinary hoursofbusiness;or, (5)Report any material matter falsely to the Chief of Police;or (6)Having forms provided therefor,shall fail before noon of eachdaytofurnishtheChiefofPolicewithafull,true and correct transcript of the record of all transactions had on the previousday,it being the intent of this section that Saturday's business may be reported on Monday;or, (7)Fail to report forthwith to the Chief of Police the possessionofanypropertywhichhemayhavegoodcausetobelievehas beenlostorstolen,together with the name of the owner,if known, and the date when,and the name of the person from whom the same was received by him;or, (8)Remove,or allow to be removed from his place of business,exceptbytheownerthereof,any property received,within four days i after the receipt thereof shall have been reported to the Chief of Policer or (9)Receive any property from any person under the age of eighteen years,any common drunkard,any habitual user of narcotic drugs, any habitual criminal,any person in an intoxicated condition, any known thief or receiver of stolen property,or any knownassociateofsuchthieforreceiverofstolenproperty,whethersuchpersonbeactinginhisownbehalforastheagentofanother. Section 4 -Amendment to Section 6.28.12 Section 6.28.12 of the Moses lake City Code is amended by deleting the phrase "of $8.00 per year",and Section 6.28.12 is further amended by deleting the phrase "Section 6.4.24",and inserting, in its stead,the phrase "Section 6.4.32". Section 5 -Repealing Conflicting Ordinances Any and all ordinances or parts of ordinances in conflict herewith are hereby repealed. Section 6 -Severability The invalidity of any part of this ordinance shall not effect the validity of any other part which can be given effect without such in- valid part or parts. Section 7 -Effective Date This ordinance shall take effect and be in force five (5)Days after its passage and publication as provided by law.
