AN ORDINANCE AMENDING CERTAIN SECTIONS OF CHAPTER 9.6
I OF THE MOSES LAKE COUE ENTITLED "WATER AND SEWER RATES"
(CITY SYSTEM)BY INCREASING RATES AND MODIFYING PRO-
CEDURES.
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS
FOLLOWS:
Section 1.That Chapter 9.6 of the Moses Lake Municipal Code entitled "Water andSewerRates",Section 9.6.04,"Residential Water Rates",be amended to read as follows:
9.6.04 RESIDENTIAL WATER RATES
(1)The following shall be the monthly rate charged for water from the citywatersystemforsingle-family dwellings and each unit of a duplex with
separate meters:

Section 2.That Chapter 9.6 of the Moses Lake Municipal Code entitled "Water and SewerRates",section 9.6.08,"Commercial water Rates",be amended to read as follows:

(1)The following shall he the monthly rate charged for water from the City
water system for commercial users and dwellings with two or more livingunitsservedbyonemeter:

9.6.12 RESIDENTIAL SEWER RATES
The following shall be the monthly rate charged for sewer service fromtheCitysewersystemforsinglefamilydwellingsandeachunitofa,duplex with separate meters:
Flat Rate -$3.80 per month
Section 4.That Chapter 9.6 of the Moses Lake Municipal Code entitled "Water andSewerRates"be amended to read as follows:
9.6.13 COMMERCIAL SEWER RATES
(1)The following shall be the monthly rate charged for all chargeable waterdischargedintotheCitysewersystembycommercialusersanddwellingswithtwoormorelivingunitsservedbyonemeter:

(2)For purposes of calculating sewer charges,chargeable water shall hedefinedasfollows:
Chargeable water shall be measured by the water consumed on the premises,whatever the source of such water,and the same will be metered eitherbyapublicutilitymeteroroneinstalledandmaintainedbytheowner ofthepremisesathisownexpenseandapprovedbytheCity.Where the useofwaterissuchthataportionofallthewateruseddoesnotflowintothesewersystem,but is lost by evaporation,irrigation,sprinkling,orisusedinmanufacturingorinamanufacturedproduct,and the person incontrolprovidesproofofthisfactandinstallsameterorothermeasur-ing device approved by the City to measure the amount of water so used and
so lost,this water may be deducted from the actual water consumption usedincalculatingthesewercharge.
The sewer charges for duplexes and apartments,mobile home parks,schools,hospitals,and other commercial establishments with increased usage forirrigation,only if their landscaping exceeds 5,000 sq.ft.,shall hecomputedontheaverageconsumptionduringthepreviousnon-irrigation
season,unless the user elects to install,at his expense,an approvedmeasuringdevicetomeasurewaternotenteringthesewersystem.When auser.has a swimming pool or cooling units discharging to the sanitary
sewer,he must install an approved meter to determine the amount of water -
exempt from sewer charges during the irrigation season.The irrigation
season shall be defined as the period in which statements are mailed fortheAprilthroughOctoberbillingcycles.
(3)Special Commercial Sewer Rates:Sever rates for commercial uses dischargedintothesewersystemmaybeseparatelydeterminedbytheCityCouncil,
based upon both volume and chemical characteristics of the sewage.The
City Council reserves the privilege to require pretreatment of any material
discharged into the sewerage system,or to prohibit discharge into thesystemofindustrialwastesthat,because of either volume or concentra-tion will overload existing sewerage facilities.
(4)Air Conditioning and Refrigerationā¢All air conditioning and refrigerationunitsthatareinstalled,replaced,or that have capacity increased after
the effective date of the ordinance codified in this chapter shall berequiredtoinstallrecirculatingunïts.Disposal may not be accomplishe
by discharging into the sanitary sewer system.

i .(5)The foregoing charges in no way alter or repeal any other rules and/or
regulations previously enacted by ordinances regarding the sewer system
of the City of Moses Lake.
Section 5.That Chapter 9.6 of the Moses Lake Municipal Code entitled "Water and Sewer
Rates",Section 9.6.14,"Surcharge",be amended as follows:
9.6.14 sURCHARGE
In addition to the charge for water services set forth in Sections 9.6.04
and 9.6.08,and in addition to the charge for sewer service set žorth in
Section 9.6.12,a twenty-five percent surcharge shall be assessed for
water service and sewer service furnished outside the City Limits ofMosesLaketodefraytheaddîtionalexpenseincurredinservicingthe
accounts.
There shall be no surcharge imposed or collected from any municipalcorporationorgovernmentagencyforwaterorsewerservicefurnished
outside the City Limits of Moses Lake.The municipal corporation orgovernmentalagencyshallpayforwaterandsewerserviceinaccordancewiththescheduleofchargesset.forth in Sections 9.6.04 and 9.6.12.
Sewer rates for industrial or processing plants may be separately deter-mined by the City Council,based upon both volume and chemical character-istics of the sewage.
Section 6.That Chapter 9.6 of the Moses Lake Municipal Code entitled "Water and Sewer
Rates",Section 9.6.16,"Payment of Accounts"he amended as follows:
9.6.16 PAYMENT.0F ACCOUNTS
Water and sewer bills shall be the responsibility of and billed directlytothepropertyowner,and the same shall be due and payable on or before
the tenth day of each month and shall become delinquent on said date.The property owners of commercial accounts and governmental agencies maysignagreementsrequestingtheirmonthlystatementsbemailedtoservice
addresses.
The City reserves the right to cut off the water supply from the premisesandthewatersupplymaybecutoffifeitherthewaterchargeorthe
sewer charge is delinquent,or both,and should the water supply be turnedoffforfailuretopaythesewerchargeand/or water charge,when due,thewatersupplyshallnotbeturnedonuntilalldelinquentchargeshavebeenpaidinfull.The sum of six dollars as a turn-on charge shall be addedtotheamountdueandpayable.
The City shall have a lien against the premises for unpaid water and sewerchargesasprovidedbythelawsoftheStateofWashington.
Section 7.That chapter 9.6 of the Moses Lake Municipal Code entitled "Water and SewerRates*,Section 9.6.24,"Temporarily Vacant or Unoccupied Premises",he amended as£ollows:
9.6.24 TEMPORARILY VACANT OR UNOCCUPIED PREMISES
The minimum water and/or sewer service shall continue until an order inwritingtodiscontinueservicehasbeengiven.The water shall not beturnedonoroffuntilarequest.in writing is given for the turning onorofftheserviceonformsfurnishedbytheCity.The sum of six dollarsasaservicechargeshallbeaddedforeachturn-on or for each changeofservicetoanotheroccupant.
I When utility services are resumed or commenced during the last 15 daysofthebillingcycle,water and sewer shall be charged for only a hal£of the month where half the minimum water usage is not exceeded for saidperiod.

Section 8.That Chäpter 9.6 of the Moses Lake Municipal Code entitled "Water and SewerRates"be amended to read as follows:
9.6.31 EFFECTIVE DATE
The effective date of Section 9.6.04,9.6.08,9.6.12,9.6.13,9,6.14,9.6.16 and 9.6.24 shall he May 15,1977,All statements mailedafterJune15,1977,shall he billed at the rate established in thisordinance.
Section 9.The City Manager shall be authorized to establish procedures for theadministrationofthisOrdinance.
Section 10.The invalidity of any part of this ordinanze shall not effect the validityofanyotherpartofthisordinancewhichcanbegiveneffectwithoutsuchinvalidpartorparts.
