AN ORDINANCE AMENDING CHAPTER 9.10 OF THE MOSES LAKE CITYCODEENTITLED"WATER AND SEWER RATES AUD REGULATIONS FORILARSONAIRFORCSBASEPROPERTY"DY INCREASING THß WATERANDSEWERRATESANDMODIFYINGPROCEDURES.
NOW,THEREFORE,TKB CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTONDO ORDAIN ASFOLLOWs:
Section 1.That Chapter 9.10 of the Moses Lake Municipal Code entitled "Water and SewerRatesandRegulationsforLarsonAirForcaBacoProperty",section 9.10.04,"ResidentialWaterRates",be amended as follows:
9.10.04 RESIDENTIAL WATER RATES
(1)The following shall be the monthly rate charged for water from the munici-pally owned water system for single family dwellings and each unit of aduplexwithseparatemeters:

(3)The master metering of the entire housing area will be permissible withwatersoldthroughaprogramofmastermeteringbaseduponthecommercialratestructure.In addition to the commercial rate through master meters,a flat rate of four dollars and fifty cents ($4.50)per month will bechargedforeachoccupiedlivingunitforwaterservices.The City may,at its option,require individual metering.

9.10.12 RESIDENTIAL SEWER RATES
(1)The following shall be the monthly rate charged for sewer service from themunicipallyownedsewersystemforsinglefamilyresidencesandeachunitofaduplexthatiseitherunmoteredorhasseparatemeters:
Flat Rate -$6.50 per month
Section 4.That Chapter 9.10 of the Moses Lake Municipal Code entitled "Water and Sewer
Rates and Regulations for Larson Air Force Base Property",be amended to read asfollows:
9.10.14 COMMERCIAL SEWER RATES
(1)The following shall be the monthly rate charged for all chargeable waterdischargedintothemunicipallyownedsewersystembycommercialusers anddwellingswithtwoormorelivingunitsservedbyonemeter:

(2)For purposes of calculating sewer charges,chargeable water shall be
defined as follows:
Chargeable water shall be measured by the water consumed on the premise
whatever the source of such water,and the same will be metered either
by a public utility meter or one installed and maintained by the owner
the premises at his own expense and approved by the City.Where the us
of water is such that a portion of all the water used does not flow into
the sewer system,but is lost by evaporation,irrigation,sprinkling,or
is used in manufacturing or in a manužactured product,and the person in
control provides proof of this fact and installs a meter or other measur-
ing device approved by the City to measure the amount of water so used and
so lost,this water may be deducted from the actual water consumption used
in calculating the sewer charge.
The sewer charges for duplexes and apartments,mobile home parks,schools,
hospitals,and other commercial establishments with increased usage for
irrigation,only if their landscaping exceeds 5,000 sq.ft.,shall be 222
computed on the average consumption during the previous non-irrigation.M-
season,unless the user elects to install,at his expense,an approved (3
measuring device to measure water not entering the sewer system.When 4-A
user has a swimming pool or cooling units discharging to the sanitary og
sewer,he must install an approved meter to determine the amount of watmeg
exempt from sewer charggs during..the irrigation season.The irrigation
season shall be defined as the period in which statements are mailed.för
the April through October billing cycles.
(3)Special Commercial Sewer Rates:Sewer rates for commercial uses discharged
into the sewer system may be separately determined by the City Council,
based upon both volume and chemical characteristics of the sewage.The
City Council reserves the privilege to require pretreatment of any material
disgharged into the sewerage system,or to prohibit discharge into the
.system of indistrial wastes that,because of either volume or concentra-
tion will overload existing sewerage facilities.
(4)Air Conditioning and Refrigeration:All air conditioning and refriger n
units that are installed,replaced,or that have capacity increased af
the effective date of the ordinance codified in this chapter shall be
required to install recirculating units.Disposal may not be accomplished
by discharging into the sanitary sewer system.

(5)The foregoing charges in no way alter or repeal any other rules and/orregulationspreviouslyenactedbyordinancesregardingthesewersystem.I section 5.That chapter 9.10 of the Moses Lake Municipal Codo entitled "Water and SowerRatesand.Regulations for Larson Air Force Base Property",Section 9.10.16,"Paymentof.Accounts",be amended as follows:
9.10.16 PAYMEMTOF ACCOUMTS
Water and sewer bills shall be the responsibility of and billed directlytothepropertyowner,and the same shall be due and payable on or beforethetenthdayofeachmonthandshallbecomedelinquentonsaiddate.Thepropertyownersofcommercialaccountsand,governmental agencies may signagreementsrequbstingtheirmonthlystatementsbemailedtoserviceaddresses,
The City reserves the right to cut off the water supply from the premisesandthewatersupplymaybecutoffifeitherthewaterchargeorthesewerchargeisdelinquent,or both,and should the water supply be turnedoffforfailuretopaythesewerchargeand/or water charge,when due,thewatersupplyshallnotbeturnedonuntilalldelinquentchargeshavebeenpaidinfull.The sum of six dollars as a turn-on charge shall be addedtotheamountdueandpayable.
The city shall have a lien against the premises for unpaid water and sewerchargesasprovidedbythelawsoftheStateo£washington.
Section.G.That chapter 9.10 of the Moses Lake Municipal Code entitled "Water and SewerRatesandRegulationsforLarsonAirForceBaseProperty",section 9.10.24,"TemporarilyVacantorUnoccupiedPremises",he amended as follows:
9.10.24 TEMPORARILY VACANTOR UNOCCUPIED PREMISES
I The minimum water and/or sewer service shall continue until an order inwritingtodiscontinueservicehasbeengiven.The water shall not heturnedonoroffuntilarequestinwritingisgivenfortheturningon oroffof.the service on forms furnished by the City.The sem of six dollarsasaservicechargeshallbeaddedforeachturn-on or for each change ofservicetoanotheroccupant.
When utility services are resumed or commenced during the last 15 days ofthebillingcycle,water and sewer shall be charged for only a half of the.month where half the minimum water usage is not exceeded for said period.
Section 7.That chapter 9.10 of the Moses Lake Municipal Code entitled "Water and SewerRatesandRegulationsforLarsonAirForceBaseProperty",Section 9.10.31,"EffectiveDate;he meended to read as follows
9.10.31 EFFECTIVE DATE
The effectiva date of Sections 9.10.04,9.10.08,9.10.12,9.10.14,9.10.16ond9.10.24 shall be May 15,1977.All statements mailed after June 15,1977,shall be,billed at the rate established in this Ordinance.
Section 8.The city Manager shall be authorized to establish procedures for the admini-stration of this ordinance.
Section 9.The invalidity of any part of this Ordinance shall not effect the validityofanyotherpartofthisOrdinancewhichcanbegiveneffectwithoutsuchinvalidpartorparts.PASSED by the City Council and APPROVED by its M this 10th day of Ma ,1977.
