AN ORDINANCE APPROVING AND CONFÏRMING THE ASSESSMENTS ANDASSESSMENTROLLOFLOCALIMPROVEMENTDISTRICTNO.29,WHICHEASBEENCREATEDANDESTABLISHEDFORTHEPURPOSEOFPAYINGAPARTOFTHECOSTOFIMPROVINGBFAUMONTDRIVEBYGRADING,GRAVELING,CONSTRUCTING AND INSTATaLING STORM DRAINS,SIDE.LATEPAL SEWER CONNECTIObTS,CURBS,SIDEWALKS AND.ASPEALT CON-CRETE PAVEMENT,IN THE CITY OF MOSES 7.AKE AS PROVIDED BYORDINANCENO.771,AND LEVYING AND ASSESSING THE AMOUNTTHEREOFAGAINSTTHESEVERALLOTS,TRACTS,PARCELS OF IANDANDOTHERPROPERTYSHOWNONSAIDROLL.
WHEREAS,the assessment roll levying the special assessments against propertieslocatedinLocalImprovementDistrictWo.29 in the City of Moses Lake,Washington,created under Ordinance No.771 has been filed with the city Clerk of the city ofMosesLakeasprovidedbylaw;and
HERTAS,notice of the time and place of hearing thereof and of making objectionsandproteststosaidrollwasdulypublishedatandforthetimeandinthemannerprovidedbylaw,fixing the time.and place of hearing therson for the L4th day ofJune,1973 at the hour of 8:00 o'clock p.m.in the Council Chambers in the CityHall,Moses Lake,Washington,and further notice thereof was duly mailed by theCityClerktoeachpropertyownershownonsaidroll;and
WHEREAS,at the time and place fixed and designated in said notice the hearingwasdulyheldandallprotestsmadeinwritingwerereadandsubmittedtothecityCouncilandwerebyitoverruled,
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAINasfollows:
Section 1.-That the assessments and assessment roll of Local Improvement DistrictNo.29 which has been created and .established for the purpose of paying a part ofthecostofimprovingBeaumontDrivebygrading,graveling,constructing and in-stalling storm drains,side lateral sewer connections,curbs,sidewalks andasphaltconcretepavementintheCityofMosesLakeasprovidedinOrdinance No.771 as the same now _stands,he and the same as hereby in all things and respectsapprovedandconfirmed.
Section 2.That each of the lots,tracts,parcels of land and other property shownuponthesaidrollisherebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveralassessmentsappearinguponsaidroll.There is hereby levied and assessed against each lot,tract,parceloflandandotherpropertyappearinguponsaidrolltheamountfinallychargedagainstthesamethereon.
Section 3.That the assessment roll as approved and confirged shall be filed withtheTreasureroftheCityofMosesLakeforcollectionandthatsaidCityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinherhandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)daysfromthedateofthefirstpublicationofsaidnoticewithoutpenalty,interest,orcost,and that thereafter the sum remaining unpaid nay be paid in ten equal annualinstallmentswithinterestthereonofseven(74)per cent per annan.The first in-sta11ment of assessments on said assessment roll shall become due and payable duringthe30-day period succeeding the date one year after the date of first publication bytheCityTreasurerofnoticethattheassessmentrollisinherhandsforcollectionandannuallythereaftereachsucceedinginstallmentshallbecomedueandpayableinlikemanner.

If the whole or any portion of the assessment remains unpaid after the first30-day period,interest upon the whole unpaid sum shall be charged at a rateof7¾per .annum and each year thereafter one of said installments,togetherwithinterestdueonthewholeoftheunpaidbalance,shall he collected..Any ,installment not paid prior to the expiration of the said 30-day period .during
which such installment is due and payable shall iclyareupon become delinquent.
All delinquent installments.shall be subject.to a charge for interest of 7¾per
annum and for an additional charge of 974 penalty levied upon both principal andînterestdueuponsuchinstallmentorinstallments.The collection of suchdelinquentinstallmentsshallbeenforcedinthemannerprovidedbylaw.
