AN ORDINANCE AMENDING CHAPTER 9.2 OF THE CITY OF MOSES LAKE CITY CODE
.ENTITLED "WATER AND SEWER CONNECTIONS"
TES CITY COUNCIL OF THE CITY OF ¾OSES LAKE DO ORDAIN AS FOLLOWS:
That chapter 9..2 of the Moses Lake City Code antitled "Water and Sewer Connections"isamendedasfollows:
Section 1.9.2.06 WATER MAIN.CONNECTION CHARGES -GEMERAL There shall he twotypesofwaterutilitiesreferredto:(A)subdivider installed water utilities or (B)public funded installed water utilities.These shall be maintained and repaired by theCityofMosesLake.All cost and expense of connecting the service line to the watermainandinstallingthemetershallbebornebythepropertyownerrequestingwaterservices.
Where water utilities have been installed at the expense of the subdivider or privateownersthroughoradjacenttosubdividedareas,other than the property within boundariesofthesubdivisionforwhichthewaterutilitywasrequired,the property owners outsidetheboundariesofsaidsubdivisionshallnotbeallowedtoconnecttothewaterutility .until the platter,subdivider or private owners have been reimbursed as approved by theEngineer.These connection limitations shall be enforced for a period not to exceedfifteenyears.Should the City Clark be unable to locate the subdivider or privateownersbyregistered.or certified mail prior to fifteen years after acceptance ofutilitiesbytheEngineer,the limitation for connection shall cease.
Where water utilities have been installed at the expense of the subdividers.or privateownersthroughoradjacenttoareasnotsubdividedorundeveloped,the subdivider orprivateownersshallbereimbursedasapprovedbytheEngineerpriortothefinalplatofsábdivisionofsaidunplattedpropertyand/or prior to any water utility connectionsbeingpermitted..These connection limitations shall be enforced for a period not to ..exceed fifteen years..Should the City Clerk be unable to locate the platter,subdivideriorprivateownersbyregisteredorcertifiedmailpriortofifteenyearsafter.acceptanceoffacilitiesbytheEngineer,the limitation for connection shall cease.
Where water mains have been installed with public funds through or adjacent to plattedareas,the property throughwhich the water mains are extended or whieh are adjacentthereto.shall he permitted a connection to the city water main only after a payment hasbeenmadetothecityofMosesLakeinaccordancewiththe.schedules established in thefollowîngsections.
Where public funded water mains are through or adjacent.to unplatted areas,the platterofthoseunplattedareasshallberequired,as a part of the platting procedure,to re-imburse the City for that portion of the water main through or adjacent to the propertytobeplatted.That reimbursement shall also be in accordance with the schedulesestablishedinthefollowingsectionsofChapter9.2.
Section 2.Any ordinance in conflict herewith is hereby repealed.
Section 3.This Ordinance will take effect and be in force five (5)days after passageandpublication.
