AN ORDINANCE AMENDING CHAPTER 9.10 OF THE MOSES LAKE CITY CODE
ENTITLED "WATERAND SEWER RATES"(BASE SYSTEM)BY ADJUSTINGDUPLEXRATESANDMODIFYINGPROCEDURES.
THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FOLLOWS:
I Section 1.That Chapter 9.10 of the Moses Lake Municipal Code entitled "Water
and Sewer Rates",Section 9.10.04,"Residential Water Rates",be amended to readasfollows:
9.10.04 RESIDENTIAL WATER RATES
1.The following shall be the monthly rate charged for water from the City watersystemforsingle-family dwellings and each unit of a duplex with separate meters:
Amount Used Water Rate0-500 Cu.Ft.$3.60 per month
501 -3,000 Cu.Ft.$0.30 per 100 Cu.Ft.or portion thereofOver3,000 Cu.Ft.$0.15 per 100 Cn.Ft.or portion thereof
2.The following shall be the minimum monthly amounts charged according to eachmeterinservice:

3.The master metering of the entire housing area will be permissible with waterisoldthroughaprogramofmastermeteringbaseduponthecommercialratestructure.In addition to the commercial rate through master meters,a flat rate of FourDollarsandFiftyCents($4.50)per month will be charged for each occupied livingunitforwaterservices.The City may,at its option,require individual metering.
Section 2.That Chapter 9.10 of the Moses Lake Municipal Code entitled "WaterandSewerRates",Section 9.10.08 "Commercial Water Rates",be amended to readasfollows:
9.10.08 COMMERCIAL WATER RATES
1.The following shall be the monthly rate charged for water from the City watersystemforcommercialusersanddwellingswiththreeormorelivingunitsservedbyonemeter:

Section 3.That chapter 9.10 of the Municipal Code entitled "Water and Sewer
Rates",Section 9.10.09 be added to read as follows:
9.10.09 DUPLEX WATER RATES
1.The following shall be the monthly rate charged for water from the city system
for duplexes with only one meter serving two living units or for two houses on a
single lot served by one meter:

1,001 -6,000 Cu.Ft.50.30 per 100 Cu.Ft.or portion thereof
Over 6,000 Cu.Ft.$0.15 per 100 Cu.Ft.or portion thereof
2.The following shall be the minimum monthly amounts charged according to the
size of each meter in service to duplexes with only one meter to the living units
or for two houses on a single lot served by one meter:

Section 4.That Chapter 9.10 of the Municipal Code entitled "Water and Sewer
Rates",Section 9.10.10,be added to read as follows:
9.10.10 DUPLEX SEWER RATES
The following shall he the monthly rate charged for sewer service from the
city sewer system for duplexes with only one meter serving two living units or
for two houses on a single lot served by one meter:
Flat Rate -$13.00 per month
Section 5.That chapter 9.10 of the Moses Lake Municipal Code entitled "Water
and Sewer Rates",section 9.10.12,"Residential Sewer Rates",be amended to read
as follows:
9.10.12 RESIDENTIAL SEWER RATES
The following shall be the monthly rate charged for sewer service from the
City sewer system for single fonily dwellings and each unit of a duplex with
separate meters:
Flat Rate -$6.50 per month C:
Section 6 That chapter 9.10 of the Moses Lake Muñicipal Code entitled "Water
and Sewer Rates and Regulations for Larson Air Force Base Property",be amended
to read as follows:
9.10.14 COMMERCIAL SEWER RATES
1.The following shall be the monthly rate charged for all chargeable water
discharged into the city sewer system by commercial users and dwellings with
three or more living units served by one meter:

O -1,000 Cu.Ft.$6.00 per month minimum
1,001 -30,000 Cu.Ft.$0.45 per 100 Cu.Ft.or portion thereof
Over 30,000 Cu.Ft.$0.35 per 100 Cu.Ft.or portion thereof
2.For purposes of calculating sewer charges,chargeable water shall be defined
as follows:
Chargeable water shall be measured by the water consumed on the premises,what-
aver the source of such water,and the same will be metered either by a public
utility meter or one installed and maintained by the owner of the premises at his
own expense and approved by the City.Where the use of water is such that a portion
of all the water used does not flow into the sever system,but is lost by evapora-

tion,irrigation,sprinkling,or is used in manufacturing or in a manufacturedproduct,and the person in control provides proof of this fact and installs a meterorothermeasuringdeviceapprovedbytheCitytomeasuretheamountofwatersousedandsolost,this water may be deducted from the actual water consumption usedincalculatingthesewercharge.
I The sewer charges for triplexes and apartments,mobile home parks,schools,hospitals,and other commercial establishments with increased usage for irrigation,only if their landscaping exceeds 5,000 sq.ft.,shall be computed on the averageconsumptionduringthepreviousnon-irrigation season,unless the user elects toinstall,at his expense,an approved measuring device to measure water not enter-ing the sewer system.When a user has a swimming pool or cooling units dischargingtothesanitarysewer,he must install an approved meter to determine the amountofwaterexemptfromsewerchargesduringtheirrigationseason,The irrigationseasonshallbedefinedastheperiodinwhichstatementsaremailedforthe AprilthroughOctoberbillingcycles.
3.Special Commercial Sewer Rates:Sewer rates for commercial uses dischargedintothesewersystemmaybeseparatelydeterminedbytheCityCouncil,based uponbothvolumeandchemicalcharacteristicsofthesewage.The City Council reservestheprivilegetorequirepretreatmentofanymaterialdischargedintotheseweragesystem,or to prohibit discharge into the system of industrial wastes that,be-cause of either volume or concentration will overload existing sewerage facilities.
4.Air Conditioning and Refrigeration:All air conditioning and refrigerationunitsthatareinstalled,repiaced,or that have capacity increased after theeffectivedateoftheordinancecodifiedinthischaptershallberequiredto in-stall recirculating units.Disposal may not be accomplished by discharging intothesanitarysewersystem.
-Section 7.That chapter 9.10 of the Municipal Code entitled "Water and SeweriRatesandRegulationsforLarsonAirForceBaseProperty,"Section 9.10.31,"EFFECTIVE DATE"be amended to read as follows:
9.10.31 EFFECTIVE DATE
The effective date of Section 9.10.04,9.10.08,9.10.09,9.10.10,9.10.12,and9.10.13 shall be November 15,1977,and statements mailed December 15,1977,andthereaftershallbebilledattheratesestablishedinthisordinance.
Section 8.The foregoing charges in no way alter or repal any other rulesand/or regulations previously enacted by ordinance regarding the water and sewersystemsoftheCityofMosesLake.
Section 9.The city Manager shall be authorized to establish procedures for theadninistationofthisOrdinance.
Section 10.The invalidity of any part of this ordinance shall not effect thevalidityofanyotherpartofthisordinancewhichcanbegiveneffectwithoutsuchinvalidpartorparts.
