861_00001ORDINANCE NO•861 AN ORDINANCE APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO.30,WHICH HAS BEEN CREATED AND ESTABLISHED FOR THE PURPOSE OF PAYING A PART OF THE COST OF IMPROVING MARINA DRIVE AND ORCHARD AVENUE BY INSTALLING SEWER MAINS,WATER MAINS,AND FIRE HYDRANTS IN THE CITY OF MOSES LAKE AS PROVIDED BY ORDINANCE NO.772,AND LEVYING AND ASSESSING THE AMOUNT THEREOFiAGAINSTTHESEVERALLOTS,TRACTS,PARCELS OF LAND AND OTHER PROPERTY SHOWN ON SAID ROLL. WHEREASr the assessment roll levying the special assessments against properties located in Local Improvement District No.30 in the City of Moses Lake,Washington, created under Ordinance No.772 has been filed with the City clerk of the City of Moses Lake as provided by law;and WHEREAS,notice of the time and place of hearing thereof and of making objections and protests to said roll was duly published at and for the time and in the mannerprovidedbylaw,fixing the time and place of hearing thereon for the 11th day ofOctober1977,at the hour of 8.00 o'clock p.m.in the Council Chambers in the cityHall,Moses Lake,Washington,and further notice thereof was duly mailed by theCityClerktoeachpropertyownershownonsaidroll;and WHEREAS,at the time and place fixed and designated in said notice the hearing wasdulyheldandallprotestsmadeinwritingwerereadandsubmittedtotheCityCouncil and were by it overruled, NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FOLLOWS: Section 1 That the assessments and assessment roll of Local Improvement District Ro.30 which has been created and established for the purpose of paying a part ofthecostofimprovingMarinaDriveandOrchardAvenuebyinstallingsewermains,I water mains,and fire hydrants in the City of Moses Lake as provided in Ordinance No.772 as the same now stands;be and the same as hereby in all things and respectsapprovedandconfairmed. Section 2 That each of the lots,tracts,parcels of land and other property shown upon the said roll is hereby determined and declared to be specially benefited bysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessment appearing against the same is in proportion to the several assessments appearing upon said roll.There is hereby levied and assessed against each lot,tract,parceloflandandotherpropertyappearinguponsaidrolltheamountfinallycharged against the same thereon. Section 3 That the assessment roll as approved and confirmed shall be filed withtheTreasureroftheCityofMosesLakeforcollectionandthatsaidCityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinherhandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)daysfromthedateofthefirstpublicationofsaidnoticewithoutpenalty,interest,orcost,and that thereafter the sum remaining unpaid may be paid in ten equal annualinstallmentswithinterestthereonofsevenpercent(7%)per annum.The firstinstallmentofassessmentsonsaidassessmentrollshallbecomedueandpayableduringthe30-day period succeeding the date one year after the date of first publica-tion by the City Treasurer of notice that the assessment roll is in her hands forcollcayeandanuamnthereaftereachsucceedinginstallmentshallbecomedue Ordinance No. Page 2 If the whole or any portion of the assessment remains unpaid after the first 30-day period,interest upon the whole unpaid sum shall be charged at a rate of seven per cent (7%)per annum and each year thereafter one of said installmets,together with interest due on the whole of the unpaid balance,shall be collected,Any installment not paid prior to the expiration of the said 30-day period during which such install- ment is due and payable shall thereupon become delinquent.All delinquent install- ments shall be subject to a charge for interest of seven per cent (7%)per annum and for an additional charge of nine per cent (9%)penalty levied upon both principal and interest due upon such installment or installments.The collection of such delinquent installments shall be enforced in the manner provided by law. Section 4 This ordinance shall take effect and be in force five (5)days after its passage and publication as provided by law.
