AN ORDINANCE APPROVING AND CONFIRMING THE ASSESSMENTS AND
ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO.33 WHICH
HAS BEEN CREATED AND ESTABLISHED FOR THE PURPOSE OF PAYING
A PART OF THE COST OF IMPROVING FERN DRIVE,CROUSE STREET,
SYBEL LANE,AND BEMIS STREET IN BENNETT ADDITION BY INSTALL-
ING A SANITARY SEWER MAIN AND MANHOLES IN THE CITY OF MOSES
LAKE AS PROVIDED liY ORDINANCE NO.788,AND LEVYING AND ASSESS-I ING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS,TRACTS,
PARCELS OF LAND AND OTHER PROPERTY SHOWN ON SAID ROLL.
WHEREAS,the assessment roll levying the special assessments against properties
located in Local Improvement District No.33 in the City of Moses Lake,Washington,
created under Ordinance No.788 has been filed with the City Clerk of the City of
Moses Lake as provided by law;and
WHEREAS,notice of the time and place of hearing thereof and of making objections
and protests to said roll was duly published at and for the time and in the manner
provided by law,fixing the tige and place of hearing thereon for the llth day of
October -1 t-theshour of ß:09 q'gógk p.m.in the Council Chambers in the City
Hall,Moses Lake,Washington,and further notice thereof was duly mailed by theCityClerktoeachpropertyownershownonsaidroll;and
WHEREAS,at the time and place fixed and designated in said notice the hearing wasdulyheldandallprotestsmadeinwritingwerereadandsubmittedtotheCityCouncil
and were by it overruled,
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN
AS FOLLOWS:
Section 1 That the assessments and assessment roll of Local Improvement District
No.33 which has been created and established for the purpose of paying a part of
the cost of improving Fern Drive,Crouse Street,Sybel Lane and Semis street in theiBennettAdditionbyinstallingsewermainsandmanholesintheCityofMosesLake
as provided in Ordinance No.788 as the same now stands,be and the same as hereby
in all things and respects approved and confirmed.
Section 2 The each of the lots,tracts,parcels of land and other property shown
upon the said roll is hereby determined and declared to be specially benefited by
said improvements in at least the amount charged against the same and the assessmentappearingagainstthesaneisinproportiontotheseveralassessmentsappearinguponsaidroll.There is hereby levied and assessed against each lot,tract,parcel oflandandotherpropertyappearinguponsaidrolltheamountfinallychargedagainst
the same thereon.
Section 3 That the assessment roll as approved and confirmed shall be filed with
the Treasurer of the City of Moses Lake for collection and that said City Treasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinherhandsforcollectionandthatpaymentofanyassessmentthereon
or any portion of said assessment can be made at any time within thirty (30)days
from the date of the first publication of said notice without penalty,interest,orcost,and that thereafter the sum remaining unpaid may be paid in ten equal annualinstallmentswithinterestthereonofsevenpercent(7%)per annum.The firstinstallmentofassessmentsonsaidassessmentrollshallbecomedueandpayableduringthe30-day period succeeding the date one year after the date of first
publication by the City Treasurer of notice that the assessment roll is in her hands
i for collection and annually thereafter each succeeding installment shall become dueandpayableinlikemanner.

If the whole or any portion of the assessment remains unpaid after the first 30-day
period,interest upon the whole unpaid sum shall be charged at a rate of seven per
cent (7%)per annum and each year thereafter one of said installments,together with
interest due on the whole of the unpaid balance,shall be collected.Any installment
not paid prior to the expiration of the said 30-day period during which such install-
ment is due and payable shall thereupon become delinquent.All delinquent install-
ments shall be subject to a charge for interest of seven per cent (7%)per annum
and for an additional charge of nine per cent (9%)penalty levied upon both principal
and interest due upon such installment or installments.The collection of such
delinquent installments shall be enforced in the manner provided by law.
Section 4 This ordinance shall take effect and be in force five (5)days after its
passage and publication as provided by law.
PASSED by the City Council at a regular meeting thereof and APPROVED by the Mayor
of the City of Moses Lake,Washington,this 25th of October ,1977.
