AN ORDINANCE REPEALING CHAPTER 12,08 OF THE MOSES LAKE MUNICIPALCODEENTITLED"UNIFORM CONUENITY STANDARDS"AND ENACTING A NEWCHAPTER12.08 ENTITLED "COMMUNITY STREET AND UTILITY STANDARDS"BY ADOPTING BY REFERENCE THE STANDARD SPECIFICATIONS FOR MUNICIPALPUBLICWORKSCONSTRUCTIONOFTHEWASHINGTONSTATECHAPTEROFTHEAMERICANPUBLICWORKSASSOCIATIONPUBLISHEDIN1977ANDBAKINGIAMENDMENTSTHERETO.
THE CITY COUNCILOF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FOLLOWS:
Section 1.SPECIFIC REPEAL Chapter 12.08 is hereby repealed in its entirety.
Section 2.NEW CHAPTER ENACTED Chapter 12.08 entitled "Community Street andUtilityStandards"shall be as follows:
12.08.010 STANDARDSADOPTED In order to provide for a uniform communitystandardforallworkperformedfortheCityorupontheirbehalf,the CityofMosesLakedoesherebyadoptbyreferenceallthetermsandconditionsoftheStandardSpecificationsforMunicipalPublicWorksConstructionoftheWashingtonStateChapteroftheAmericanPublieWorksAssociationpub-lished in 1977 and the amendments thereto which are entitled CommunityStreetandUtilityStandards.Three copies of said Standard SpecificationsforMunicipalPublicWorksConstructionandCommunityStreetandUtilityStandardsareonfilewiththeCityClerkoftheCityofMosesLake.AllcontractsandagreementshereinafterenteredintobytheCityorupontheirbehalf,shall be in compliance with these standards unless additions ordeletionsareapprovedbytheCityinwriting,
12.08.020 CONDITIONS FOR CONSTRUCTION It shall be unlawful for any person,firm or corporation to commence work or construction on any public right ofway,to install any new water and sewer facilities,or to distrub any exist-i ing City utility without one or more of the following conditions as requíredbytheCity:
A.An approved Performance Bond.
B.A Street Obstruction Bond and the required permit.
C.An approved Subdivision Bond or surety and a Street Obstruction Bond withtherequiredpermit.
D.A franchise approved by the City Council.
12.08.030 EZEMPTIONS ALLOWED Small maintenance contracts by the City toexistingfacilities,day labor and emergency work may be exempted by theCityfromtherequirementsofthisordinance.
12.08.040 VIOLATION -PENALTY Any person,form or corporation who shallviolateorfailtocomplywiththeprovisionsofthisordinanceshallberesponsibleforallliabilityresultingforhisactionsortheomission ofhisactionsandshallmakefullrestitutiontotheCityofMosesLakeand beitfurtherprovidedthatthesameshallbedeemedguiltyofamisdemeanor.
Section 3.EFFECTIVE DATE This ordinance shall take effect and be in force five(5)days after its passage and publication as provided by law.
