FOR TWEPURPOSE OF STR2ET IMPROVEMENTSIN THE KNOTA.SVÌSTA AREA AD.TACENTTOIIDT1OFKNOLLSVISTA#7 ADDITION,LOT 12 OF ENOLLS VISTA #13 ADDITION AND
IOTS 1 THROUGH 29 OF KNOLLS VISTA #12 ADDITION BY CONSTRUCTING CONCRETE
SIDEWALKS IN THS CITY OF MosEs IAKE AS PROVIDED BY ORDINANCE NO.838 ANDTÆVilNGANDASSESSINGTHEAMOUNTTHEREOFAGAÎNST2*BË SEVESAL LOTS,TRACTS,
PARCELS OF LAND ANDOTHER PROPERTY SHOWN ON SAID ROLL.
WHEREAS,the assessment roll levying the special assessments against properties located in Local ImprovementDistrictNo.38 in the city of Moses Lake,Washington,created under Ordinance No.38 has been £11ed withtheCityClerkoftheCityofMosesLakeasprovidedbylaw;and
WHEREAS,notice of the time and place of hearing thereof and of making objections and protests to said rollwasdulypublishedatand£or the time and in the manner provided by law,fixing the time and place ofhearingthereonforthe21stdayofFebruary,1978 at the hour of 8:00 o'clock p.m.in the Council ChambersintheCityHall,Moses Lake,Washington,and further notice thereof was duly mailed by the City Clerk.toeachpropertyownershownonsaidroll;and
WHEREAS,at the time and place fixed and designated in said notice the hearing vaseduly held and all protestsmadeinwritingwerereadandsubmittedtotheCityCouncilandwerebyitoverruled,
NOW,THEREFORE,29ΠCITT COUNCTI.OF THE CITY OF MOSES LAEE,WASHINGTON,DO ORDAIN AS FOLLOWS:
.Section 1.That the assessments and assessment roll of Local Improvement District No.38 which has been
created and established for the purpose of street improvements in the Knolls Vista area adjacent to Lot 1ofKnolleVista#7 Addition,Lot 12 of Enolls Vista #13 Addîtion and Lots 1 through 29 of Enolls Vista #12AdditionintheCityofMosesLakeasprovidedinOrdinanceNo.838 as the same now stands,he and the sameasherebyinallthingsandrespectsapprovedandconfirmed.
Section 2.That each of the lots,tracts,parcels of land and other property shown upon the said roll isherebydeterminedanddeclaredtobespeciallybenefiteähysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveraliassessmentsappeezinguponsaidroll.There is hereby levied and assessed against each lot,tract,parcel
of land and other property appearing upon said roll the amount finally charged against the same thereon.
Section 3.That the assessment roll as approved and gonfirmed shall be filed with the Treasurer of theCityofMosesLakeforcollectionandthatsaidCityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinherhandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days fromthedateofthefirstpublicationofsaidnoticewithoutpenalty,interest,or cost,and that thereafterthesumremainingunþaidmaybepaidintenequalannualinstallmentswithinterestthereonofsevenpercent(7%)per annum The first installment of assessments on said assessment roll shall become dueandpayableduringthe30-day period succeeding the date one year after the date of first publication bytheCityTreasurerofnoticethattheassessmentrollisinherhandsforcollectionandannuallythere-after each succeeding installment shall become due and payable in like manner.
If the whole or any portion of the assessment remains unpaid after the first 30-day period,interest uponthewholeunpaidsumshallhechargedatarateofsevenpercent(7%)per annum and each year there-after one of said installments,together with interest due on the whole of the unpaid balance,shall becollected.Any installment not paid prior to the expiration of the said 30-day period during which suchinstallmentisdueandpayableshallthereuponbecomedelinguent.All delinquent installments shall besubjecttoachargeforinterestofsevenpercent(7%)per annum and for an additional charge of ninepercent(9%),penalty levied upon both principal and înterest due upon such installment or installments.The collection of such delinquent installments shall be enforced in the manner provided by law.
Section 4.Shis ordinance shall take effect and be in force five (5)days after its passage and publica-tion as provided by law.
