AN ORDINANCE APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT
ROLL OF LOCAL IMPROVEMENT DISTRICT NO.31 WHICH HAS BEEN CREATEDAND
I ESTABLISHED FOR THE PURPOSE OF GRADING,GRAVELING,CONSTRUCTINGAND
INSTALLING CURBS,SIDEWALKS,SEWER SIDE IATERALS AND ASPHALT CONCRETE
PAVEMENT ON BEAUMONTDRIVE IN THE CITY OF MOSES LAKE AS PROVIDED BY
ORDINANCE NO.ÎS$AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST
THE SEVERAL LOTS,TPACTS,PARCELS OF LAND ANDOTHER PROPERTY SHOWN ON
SAID ROLL.
WHEREAS,the assessment roll levying the special assessments against properties located in Local ImprovementDistrictNo.31 in the City of Moses I,ake,Washington,created under Ordinance No.783 has been filed withtheCityClerkoftheCityofMosesLakeasprovidedbylawsand
WHEREASr notice of the time and place of hearing thereof and of making objections and protests to said rollwasdulypublishedatandforthetimeandinthemannerprovidedbylaw,fixing the time and place ofhearingthereonforthe12thdayofOgtober,1977,at the hour of 8:00 O'clock in the Council Chambers in the CityHall,Moses Lake,Washington,and further notice thereof Was duly mailed by the City Clerk to each propertyownershownonsaidroll;and
WHEREAs,at the time and place fixed and designated in said notice the hearing was duly held and all protestsmadeinwritingwerereadandsubmittedtotheCityCouncilandwerebyitoverruled,
NOW,THEREFORE,THE CITY COUNCIL OF IWS CITY OF MOSES IAlÅ’,WASHINGTON,DO ORDAIN AS FOLLOWS:
Sectiors 1.That the assessments and assessment roll of Local Improvement District No.31 which has beencreatedandestablishedforthepurposeofgrading,graveling,constructing and installing curbs,sidewalks,sewer side laterals and asphalt concrete pavement on Beaumont Drive in the City of Moses Lake as provided inOrdinanceNo.783 as the same now standBa be and the same as hereby in all things and respects approved and
,confirmed.
Section 2.That each of the lots,tracts,parcels of land and other property shown upon the said roll isFyherebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveralassessmentsappearinguponsaidro11,Staere is hereby levied and assessed against each lot,tract,parcelioflandandotherpropertyappearinguponsaidrolltheamountfinallychargedagainstthesamethereon.
Section 3.That the assessment roll as approved and-confirmed shall be filed with the Treasurer of theCityofMosesLakeforcollectionandthatsaidcityTreasurerisherebyauthorisedanddirectedtopublishnoticeasrequiredbylawstatîngthatsaidrollisinherhandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days fromthedateofthefirstpublicationofsaidmoticawithoutpenalty,interest,or cost,and .that thereafterthesumremainingunpaidmaybepaidintenequalannualinstallmentswithinterestthereonofsevenpercent(7%)per annum The first installment of assessments on said assessment roll sha11.become dueandpayableduringthe30-day period succeeding the date one year after the date öf first publication by
.the City Treasurer of notice that the assessment roll is in her hands for collection and annually there-after each succeeding installment shall become due and payable in like manner.
If the-whole or any portion of the assessment remains unpaid after the first 30-day period,interest uponthewhoLeunpaidsumshallbechargedatarateofsevenpercent(7%)per annum and each year there-after one of said installments,together with interest due on the whole of the unpaid balance,shall becollected.Any installment not paid prior to the expiration of the said 30-day period during which stich.installment is due and payable shall thereupon become delinquent.All delinquent installments shall besubjecttoachargeforinterestofsevenpercent(7%)per annum and for an additional charge of ninepercent(9%)penalty levied upon both principal and interest due upon such installment or installments.The collection of such delinquent installments shall he enforced in the manner provided by law.
Section 4.This ordinance shall take effect and be in force five (5)days after its passage and publica-tion as provided by law.
