878_00001DRDINANCENO.878 AN ORDINANCEAPPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLLOFLOCALIMPROVEMENTDISTRICTNO.34 WHICH HAS BEEN CREATED AND ESTABLISHEDFORTHEPORPOSEOFGRADING,GRAVELING,CONSTRUCTIONAND INSTALLING SIDELATERALSEWERCONNECTIONS,CURBS,SIDEWALKS,ASPHALTIC CONCFETE PAVEMENTANDISTORMDRAINAGEONJEFFERSONAVENUEINTHECITYOFMOSESLAKEASPROVIDEDBYORDINANCENO.793 AND LEVYING ANDAssESSING THE AMOUNTTHEREOF AGAINST THESEVERALLOTS,TRACTS,PARCELS OF LAND AND OTHER PROPERTY SHOWNON SAID ROLL. WHEREAS,the assessment roll levying the special assessments against properties located in Local ImprovementDistrictNo.34 in the City of Moses Lake,Washington,created under ordinance No.793 has been filed withtheCityClerkoftheCityofMosesLakeasprovidedbylaw;and WHEREAS,notice of the time and place of hearing thereof and of making objections and protests to said rollwasdulypublishedatandforthetimeandinthemannerprovidedbylaw,fixing the time and place Ofhearingthereonforthe9thdayofNovember,1977 at the hour of 8:00 o'clock in the Council Chambers in the CitYHall,Moses Lake,Washington,and further motice thereof was duly mailed by the Çity Clerk to each propertyownershownonsaidroll;and WHEREAS,at the time and place fixed and designated in said notîce the hearing was duly held and all protestsmadeinwritingwerereadandsubmittedtothecityCouncilandwerebyitoverruled, NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OP MOSES LAKE,WASHING5cNy DO ORDAIN As FOLLOWS: Section 1.That the assessments and assessment roll of Local Improvement District No.34 which has beencreatedandestablishedforthepurposeofgrading,graveling,construction and installing side lateral sewerconnections,ourbs,sidewalks,asphaltic canerate pavement and storm drainage on Jefferson Avenue in the CityofMosesLakeasprovidedinordinanceNo.793 as the same now stands,be and the same as hereby in all thingsand.respects approved and confirmed. Section 2.That each of the lots,tracts,parcels of land and other property shown upon the said roll isherebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleastthe.amountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportioritotheseveralassessmentsappearinguponsaidroll.There is hereby levied and assessed against each lot,tract,parcel,of land and other property appearing upon said roll the amount finally charged against the same thereon. Section 3.That the assessment roll as approved and confirmed shall be filed with the Treasurer of theiCityofMosesLakeforcollectionandthatsaidcityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinherhandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days fromthedateofthefirstpublicationofsaidnoticewithoutpenalty,interest,or cost;and that thereafterthesumremainingunpaidmaybepaidintenequalannualinstallmentswithinterestthereonof.sevenpercent(7%)per annum The first installamat of assessments on said assessment roll shall become dueandpayableduringthe30-day period succeeding the date one year after the date of first publication bytheCityTreasurerofnoticathattheassessinentrollisinherhandsforcollectionandannuallythere-after each succeeding installment shall become due and payable in like manner, the whole or any portion of the assessment remains unpaid after the first 30-day period,interest upontuewholeunpaidsomshallbechargedatarateofsevenpercent(7%)per annum and each year there-after one of said installments,together with interest due on the whole of the unpaid balance,shall becollected.Any installment not paid prior to the expiration of the said 30-day period during which suchinstallmentisdueandpayableshallthereuponbecomedelinquent.All delinquent installments shall hesubjecttoachargeforinterestofsevenpercent(74)per annum and for an additional charge of ninepercent(94)penalty levied upon both principal and interest due upon such installment or installments. -The collection of such delinquent installiments shall he enforced in the manner provided by law. Section 4.This ordinance shall take effect and be in force five (5)days a£ter its passage and publica-tion as provided by law.
