AN ORDINANCEAPPROVING ANDCONFIRMING THE ASSESSMENTSAND ASSESSMENTROLLOFLOCALIMPROVEMENTDISTRICTNO.39 WICH HASBEEN CREATEDANDESTAELISHEDFORTHEPURPOSEOFGRADING,GRAVELING,CONSTRUCTING ANDINSTALLINGCURBS,SIDEWALKS,SEWERSIDE LATERALS,ASPHALT CONCRETEPAVEMENTANDSTORMDRAINAGEINTHEMONTLAKEAREAONCRESTMONTDRIVEIADJACENTTOLOTS22THROUGH31OFMONTLAKEADDITION#2 AND LOTS 21THROUGH23OFTHEPROPOSEDMONTTAKEADDITION#3 IN THE CITY OF MOSESLAKEASPROVIDEDEYORDINANCENO.839 ANDLEVYING ANDASSESSING THEAMOUNTTHEREOFAGAINSTTHESEVERALLO'IS,TRACTS,PARCELS OF LANDANDOTHERPROPERTYSHOWNONSAIDROLL.
WHEREAS,the assessment roll levying the special assessments against properties located in Local ImprovementDistrictNo.39 in the City of Moses Lake,Washington,created under ordinance No.839 has been filed withtheCityClerkoftheCityofMosesLakeasprovidedbylaw;and
WHEREAS,notice of the time and place of hearing thereof and of making objections and protests to said roll
was duly published at and for the time and in the manner Provided by laws fixing the time ,and place ofhearingthereonforthe16thdayofMay,1978.at the hour of 8:00 o'clock in the Council Chambers in the CityHall,Moses Lake,Washington,and .further notice thereof was duly mailed by the City Clerk to each propertyownershownonsaidroll;and
WHERBAS,at the time and place fixed and designated in said notice the hearing was duly held and all protestsmadeinwritingwerereadandsubmittedtotheCityCouncilandwerebyitoverruled,
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FOLLOWS:
Section 1.That the assessments and assessment roll of Local Improvement District No.39 which has beencreatedandestablishedforthepurposeofgrading,graveling,constructing and installing curbs,sidewalks,sewer side laterals,asphalt concrete pavement and storm drainage in the Montlake area on .Crestmont DriveadjacenttoLots22through31ofMontlakeAddition#2 and Lots 21 through 23 of the proposed MontlakeAddition#3 in the City of Moses Lake as provided in ordinance No.839 as the same now stands,be and the
same as hereby in all things and respects approved and confirmed.
Section 2.That each of the lots,tracts,parcels of land and other property shown upon the said roll ísherebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveralassessmentsappearinguponsaidroll.There is hereby levied and assessed against each lot tract,parceloflandandotherpropertyappearinguponsaidrolltheamountfinallychargedagainstthesamethereon.
Section 3.That the assessment roll as approved and confirmed shall be filed with the Treasurer of thecityofMosesLakeforcollectionandthatsaidcityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinherhandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days fromthedateofthefirstpublicationofsaidnoticewithoutpenalty,interest,or cost,and that thereafterthesomremainingunpaidmaybepaidintenequalannualinstallmentswithinterestthereonofsevenand one-half
percent (7½%)per annum.The first installment of assessments on said assessment roll shall become dueandpayableduringthe30-day period succeeding the date one year after the date of first publication bytheCityTreasurerofnoticethattheassessmentrollisinherhandsforcollectionandannuallythere-after each succeeding installment shall become due and payable in like manner.
If the whole or any portion of the assessment remains unpaid after the first 30-day period,interest uponthewholeunpaidsumshallbechargedatarateofsevenandone-half (7½%)per annum and each year there-after one of said installments,together with interest due on the whole of the unpaid balance,shall hecollected.Any installment not paid prior to the .expiration of the said 30-day period during which suchinstallmentisdueandpayableshallthereuponbecomedelinquent.All delinquent installments shall besubjecttoachargeforinterestofsevenandone-half (7½%)per annum and for an additional charge of nine.percent (9%)penalty levied upon both principal and interest due upon such installment or installments.The collection of such delinquent installments aball he enforced in the manner provided by law.
Section 4.This ordinance shall take effect and be in force five (5)days after its passage and publicá-tion as provided by law.
