AN ORDINANCE APPROVING ANDCONFIRMING THE ASSESSMENTS AND ASSESSMENT
ROLL OF LOCAL IMPROVEMENT DISTRICT NO.40 WHICHHAS BEEN CREATEDANDIESTABLISHEDFORTHEPURPOSEOF-GRADING,GRAVELING CONSTRUCTIONOFCURSS,ASPHALTIC CONCRETEPAVEMENTAND STORM DIMINAGE ON TAMARACKLANEANDGAYLORDPLACEINTKECITYOFMOSESIAKEASPROVIDEDBYORDINANCENO.840 AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGATNST THE SEVERALIDTS,TRACTS,PARCELS OF LAND AND OTHER PROFERTY SHOWN ON SAID ROLL.
WHEREAS,the assessment roll levying the special assessments against properties located in Local ImprovementDistrictNo.40 in the City of Moses Lake,Washington,created under Ordinance No,840 has been filed withtheCityClerkoftheCityofMosesLakeasprovidedbylaw;and
NHEREAS,notice of the time and place of hearing thereof and of making ob3ections and protests to said rollwasdulypublishedatandforthetimeandinthemannerprovidedbylaw,fixing the time and place ofhearingthereonforthe16thdayofMay,1978 at the hour of 8:00 o'clock in the Council Chambers in the CityHall,Moses Lake,Washington,and further notice thereof was duly mailed by the City Clerk to each propertyownershownonsaidroll;and
WHEREAs,at the time and place fixed and designated in said noticei the hearing was duly held and all protestsmadeinwritingwerereadandsubmitted-to the City Council and were by it overruled,
NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSESLMÅ’,WASHINGTON,DO OROAIN AS FOLLOW5:
Section 1.That the assessments and assessment roll of Local Improvement District No.40 which has beencreatedandestablishedforthepurposeofgrading,graveling,construction of curbs,asphaltic concretepavementandstormdrainageonTamarackLaneandGaylordPlaceintheCityofMosesLakeasprovidedin .Ordinance No.840 as the same now stands,be and the same as hereby in all things and respects approvedandconfirmed,
Section 2.That each of the lots,tracts,parcels of land and other property shown upon the said roll isherebydeterminedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinproportiontotheseveralassessmentsappearinguponsaidroll.There is hereby levied and assessed against each lot,tract,parceloflandandotherpropertyappearinguponsaidrolltheamountfinallychargedagainstthesamethereon.
Section 3.That the assemisment roll as approved and confirmed shall be filed with the Treasurer of theCityofMosesLakeforcollectionandthatsaidCityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollis.in her hands for ecllection and that payment of anyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days fromthedateofthefirstpublicationofsaidnoticewithoutpenaltyginterestrorcost,and that thereafterthesumremainingunpaidmaybepaidintenequalannualinstallmentswithinterestthereonofsevenand one-halfparcent(79%)per annum.The first installment of assessments on said assessment roll shall become dueandpayableduringthe30-day period succeeding the date one year after the date of first publication bytheCityTreasurerofnoticethattheassessmentrollisinherhandsforcollectionandannuallythere-after each succeeding installment shall become due and payable in like manner.
If the whole or any portion of the assessment remains unpaid after the first 30-day period,interest uponthewholeunpaidsumshallhechargedatarateofsevenandone-half (7½%)per annum and each year there-after one of said installments,together with interest due on the whole of the unpaid balance,shall becollected.Any installment not paid prior to the expiration of the said 30-day period during which suchinstallmentîsdueandpayableshallthereuponbecomedelinquent.All delinquent installments shall hesubjecttoachargeforinterestofsevenandone-ha1Z (74%)per annum and for an additional charge of ninepercent(9%)penalty levied upon both principal and interest due upon such installment or installments.The collection of such delinquent installments shall he enforced in the manner provided by law.
Section 4.This ordinance shall take effect and be in force five (5)days after its passage and publica-tion as provided by law,
