899_00001ORDINANCE NO.99 AN ORDINANCE REPEALING CHAPTER 10,28 OF THE MOSES LAKE CITY CODE ENTITLED "BICYCLES"AND CREATING A NEW CKAPTER 10.28 ENTITLED "BICYCLES" THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN AS FDLLOWS: Section 1.Chapter 10.28 of the Moses Lake Municipal Code is hereby repealed iniitsentirety. Section 2.A new chapter 10.28 entitled "Bicycles",shall read as follows: 10.28.010 Bicycle License Required:No person who resides within the jurisdictionofthecityofMosesLakeshallrideorpropelabicycleonanyhighway or upon any public path set aside for the exclusive use of bicycles unless such bicycle has been licensed and a license plate or decal isattachedtheretoasprovidedinthischapter, 10.28.020 Bicycle License Application:Application for a bicycle license andlicenseplatordecalshallbemadeuponaformprovidedbyandto thePoliceChief.There shall be no fee to register or license a bicycle within the City of Moses Lake. 10.28.030 Issuance of Bicycle License: A.The Police Chief,upon receiving proper application therefor,is authorized to issue a bicycle license which shall be effective forthelifeofthebicycle. B.The Police Chief shall not issue a license for any bicycle whenheknows,or has reasonable grounds to believe,that the applicant is not the owner of,or entitled to the possession of,such bicycle. I C.The Police Chief shall keep a record of the number of each license,the date issued,and the name and address of the person to whomissued. 10.28.040 Attachment of Bicycle License Plate or Decal: A.The Police Chief,upon issuing a bicycle license,shall also issue a license plate or decal bearing the license number assigned to thebicycle,and the name of the local authority. B.Such license plate or decal shall be firmly attached to the frameofthebicycleforwhichitwasissuedinsuchapositionastobeplainlyvisible. C.No person shall remove a license plate or decal from a bicycle duringtheperiodforwhichitwasissuedexceptuponatransferofownershiporintheeventthebicycleisdismantledandnolongeroperateduponanyhighwaywithinthejurisdictionofthelocalauthority. 10.28,050 Inspection of Bicycles:The Police Chief,or an officer assigned suchresponsibility,may inspect each bicycle before licensing the same and may refuse a license for any bicycle which he determines is in unsafemechanicalcondition. I 10.28.060 Transfer of Ownership:Upon the sale or other transfer of a licensedbicycle,the licensee shall remove the license plate or decal and shalleithersurrenderthesametothePoliceChieformay,upon proper applica-tion,have such plate or decal assigned to another bicycle owned by theapplicant. 10.28.070 Rental Agencies:A rental agency shall not rent or offer any bicycleforrentunlessthebicycleislicensedandalicenseplateordecalisattachedtheretoasprovidedhereinandsuchbicycleisequipped withtheequipmentrequiredbyRCW46.61.780. 10.28.080 Bicycles -Obedience to Traffic Control Devices: A.Any person operating a bicycle shall obey the instructions of official traffic control devices applicable to vehicles,unless otherwise directed by a police officer. B.Whenever authorized signs are erected indicating that no right or left or U turn is permitted,no person operating a bicycle shall disobey the direction of any such sign,except where such persondismountsfromthebicycleattherighthandcurborascloseas is practicable to the right edge of the right hand shoulder to make any such turn,in which event such person shall then obey the regula- tions applicable to pedestrians. 10.28.090 Bicycles -Parking:No person shall park a bicycle upon a highway other than as follows: A.Off the roadway except in designated area B.Upon the sidewalk in a rack to support the bicycle,if provided C.Against a building D.In such manner as to afford the least obstruction to pedestrian traffic. 10.28.100 Bicycles -Riding on Sidewalks: A.No person shall ride a bicycle upon a sidewalk in a business district. B.A person may ride a bicycle on any other sidewalk or any roadway unless restricted or prohibited by traffic control devices. C.Whenever any person is riding a bicycle upon a sidewalk,such person shall yield the right-of-way to any pedestrian, 10.28.110 Additional Bicycle Regulations:The city shall enforce all bicycle regulations contained in the Model Traffic Ordinance which has been adopted by reference. 10.28.120 Bicycles -Penalties:Every person convicted of a violation of any provision of this chapter shall be guilty of a misdemeanor. 10.28.130 Unclaimed Bicycles:All unclaimed bicyles in the custody of the Police Department shall be disposed of as provided in RCW 63,32. Section 3.This ordinance shall take effect and be in force five (5)days after its passage and publication as provided by law.
