910_00001ORDINANCENO.910 AN ORDINANCEAMENDINGCHAPTER18.36 ENTITLEDC-4,TOURISTCOMMERCIALZONE,OF TITLE 18 OF THEMOSESLAKECITY CODE THECITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTON,DOORDAINAS FOLLOWS: Section 1.Chapter 18.36 entitled C-4 Tourist Commercial Zone,of Title 18 of theMosesLakeCityCodeshallbechangedtoreadasfollows: CHAPTER18.36C-4,HIGHWAYCOMMERCIALZONE 18.36.010 INTENT:The highway commercial district is intended to permit smallhighwaycommercialcentersaroundtheinterchangesonInterstate90andalongitsassociatedbusinessloopandalsothelimitedaccesssectionsofHighway17.This district is not to be an extension of other commer-cial districts and,in fact,shall be more restrictive in its permitted uses.It shall include development standards which will make for anattractiveentranceintothecity. 18.36.020 PERMITTEDUSES:The following are permitted in the C-4 zone: A.Accessory uses of the uses permitted in this section B.Auditoriums,exhibition halls and other public assembly rooms C.Barber shops and beauty shops D.Engineering offices E.Hotels and motels H.Marinas located on the lake I.Medical offices J.Other uses ruled by the Planning Commission to be similar to thespecifiedpermittedusesandnototherwiseprohibited. K.Professional offices,studios,and clinics L.Residential uses other than apartments when resident is a jointoccupancywithapermitteduseandusedonlybytheowneroremployeeofthebusiness. M.Real estate offices N.Restaurants -sit-down and drive-in 0.Service station -gas pumps shall be set back twenty-five feet (25')from the property line. P.TheaterI Ordinance No,910/Page 2 18.36.030 CONDITIONALUSES:The following are conditional uses in the C-4 zone: A.Any development over two acres permitted in Section 18.36.020 B.Automobile Sales C.Seasonal produce stands D.Vacation trailer and recreational vehicle campgrounds when in compli- ance with Chapter 18.66 E.Veterinary offices and clinics that are completely enclosed and contain no outside runs or outside boarding facilities. 18.36.040 PROHIBITEDUSES:The following are prohibited in the C-4 zone: A.Farm and heavy equipment sales and service B.Industrial uses C.Junkyards D.Open sales lots except for automobile sales E.Public nuisances F.Residential uses not permitted in Sections 18.26.020 and 18,36.030 G.Storage of fuel H.Warehouses I.Wrecking yards 18.36.050 SETBACKS: A.The front yard setback shall be fifteen feet (15')minimum B.The side yard setback shall be ten feet (10')minimum C.The rear yard setback shall be ten feet (10')minimum 18.36.060 LOTSIZE:The minimumlot size permitted is twelve thousand square feet (12,000').A conditional use permit will be required to build on a lot which is less then twelve thousand square feet (12,000'). 18.36.070 LANDSCAPING:Five percent (5%)of the developed area shall be landscaped, including the first ten feet (10')of area back of the sidewalk within the required front yard setback not used for driveways.This area shall be maintained and not used for storage,display,or parking. 18.36.080 ACCESS:Efforts shall be made to minimize the number of curb cuts along arterials through proper spacing and joint use of driveways.The city traffic engineer may impose special standards on curb cuts in areas where curb cuts could cause traffic or safety problems. 18.36.090 DRAINAGE:The requirements are the same as in the C-1 zone. 18.36.100 FENCING:The requirements are the same as in the C-1 zone. 18.36.110 PARKINGANDLOADING:Parking and loading areas shall be provided as shown in chapter 18.54 of this title. Ordinance No.910/Page 3 18.36.120 SIGNS ANDBILLBOARDS:Signs and billboards shall conform with Chapter 18.57ofthistitle. 18.36.130 SHORELINEAREAS:All property developed within two hundred feet of thehighwaterlineofMosesLakeshallconformwiththecity's shorelinemanagementplan. 18.36.140 STORAGEANDDISPLAY:No outside storage or display of merchandise shallbepermittedinthiszone, i Section 2.This ordinance shall take effect and be in force five (5)days after itspassageandpublicationasprovidedbylaw.
