915_00001ORDINPECE ND.g AN ORDINANCEAMENDINGCHAPTER 16.04 OF THE lOSES IAKE CITY 00DE ENTITLED UNIFORMBUILDING CODE THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAINAS EOLLOWS: I section 1.Chapter 16.04 of the Moses Lake City Code,entitled Uniform BuildingCode,shall be changed to read as follows: CHAPTER 16.04 Sections: 16.04.010 Adopted by reference16.04.020 Filed for public use16.04.030 Amendments made in the Uniform Building Code16.04.040 Violation Penalty 16.04.010 Adopted by reference:The City Council adopts the 1976 Edition of theUniformBuildingCode.The code is adopted in the whole,includingappendices,save and except such portions that are deleted,modified,or amended by section 16.04.030 of this ordinance.Three copies of the1976EditionoftheUniformBuildingCodearenowonfileintheofficeoftheclerkofthecityandthesameareadoptedandincorporatedasfullyasifsetoutatlengthinthischapter. 16.04.020 Copies on file for public use:Three copies of the Uniform BuildingCodehavebeenfiledforuseandexaminationbythepublicintheofficeoftheclerkofthecitypriortotheadoptionoftheordinancecodifiedinthischapter,and the copies of codes shall remain in the officeforuseandexaminationbythepublicatalltimessubsequenttotheiadoptionoftheordinancecodifiedinthischapter. 16.04.030 Amendments made in the Uniform Building Code:The Uniform BuildingCodeisamendedandchangedasfollows: A.Section 1807(A)is amended to read as follows: Scope These requirements apply to buildings housing Group B,Division 2OccupanciesusedprimarilyasofficesandtoGroupR,Division 1Occupancies. Such buildings having floors used for human occupancy located morethan50feetabovethelowestlevelofFireDepartmentvehicleaccessshallconformtotherequirementsofthissectioninadditiontootherapplicablerequirementsofthiscode. B.Section 3309(B)is amended to read as follows: Where Required Where a floor of any story is located nore than 50 feet abovethehighestgrade,one of the required exits shall be a smokeproofienclosure.When a smokeproof enclosure is required it shall beusedtomeettherequirementsofSection3305(0). 16.04.040 Violation -Penalty:Any person,firm,or corporation who violates,disobeys,amits,neglects or refuses to ocmply with or who resists theenforcenentofanyoftheprovisionsofthischapterisguiltyofamisdemeanorandshallbefinedinanysumnotnorethanfivehundreddollars($500)or imprisoned in the county jail for a term not exceed-ing ninety (90)days,or both for each such offense.Each separate Ordinance 915,Page 2 day or any portion thereof during which any violation of this chapter occurs or continues is deemed to constitute a separate offense,and upon conviction thereof shall be punishable as provided in this section.The issuance or granting of a permit or approval of plans and specifica- tions shall not be deemed or constreed to be a permit for,or an approvalof,any violation of any of the provisions of the code.No permitpresumingtogiveauthoritytoviolateorcanceltheprovisionsofthiscodeshallbevalid,except insofar as the work or use which itauthorizedislawful. Section 2.This ordinance shall take effect and be in force five (5)days after its passage and publication as provided by law.
