ANORDINANCECREATINGCHAPTER16.52 OF THEMOSESLAKECITY CODEENTITLED"INSTALLATIONANDMAINTENANCEOF AUTOMATICFIRE EXTINGU-ISHING SYSTEMS
THE CITY COUNCILOF THECITYOF MOSESLAKE,WASHINGTON,DOORDAINAS FOLLOWS:
Section 1.Chapter 16.52 of the Moses Lake City Code,entitled "Installation andMaintenanceofFireExtinguisherSystems"is established as follows:

16.52.010 Statement of Policy:This chapter is enacted to establish the require-ments for the installation and maintenance of automatic fire extinguish-ing systems.
16.52.020 Definitions:
A.National Fire Protection Association Pamphlets:Codes,standards,and recommended practices for fire and life safety as published by

automatic sprinkler system(s)that conforms with the recommendations of an approved RatingBureauandwithN.F.P.A.Pamphlet No.13.
C.Supervisory System:A system arranged to supervise the performanceandoperativeconditionofanautomaticextinguishingsystem.
D.Area separation Wall:A four (4)hour wall constructed in accord-ance with Uniform Building Code 1976 Edition.
E.Eave Height:Eave height shall mean the highest point of a roof.
16.52.030 General Information:
A.The regulations contained herein require the installation,andmaintenanceoffireextinguishingsystems.
B.Complete information regarding the systems shall be submitted toandapprovedbytheWashingtonStateSurveyingandRatingBureauandthecit.y Fire Marshal.As-built plans shall be submitted tothebuildíngownerandtheFireMarshal.
C.All systems shall be installed by a contractor licensed by the StateofWashington.
D.Maintenance and testing of systems required under this ordinance shallbeinaccordancewithN.F.P.A.Pamphlet #13.Records of maintenanceandtestingshallbemadeavailabletotheFireDepartmentuponrequest.
E.The Fire Chief may at any time order the removal of any alarm termina-tion from the fire department or Fire Control facilities due to re-peated failure of equipment or circuitry,muTtiple false alarms,orfailuretocomplywithalloftheprovisionsofthiscode.Suchnoticeofdiscontinuationshallbemadeinwritingtoboththecom-
pany that installed and/or supplied the alarm equipment and to theperson,firm or corporation that is responsible for the buildinginwhichthealarmsystemisinstalled,at least 48 hours prior tothedisconnectionofthealarmcircuit.
In the event of temporar.yfailure of alarm equipmentor circuitry,the Fire Chief may order all emergencyresponse actions discontinueduntilrepairscanbemade.
ln each instance involving two (2)false alarms from a system mal-function that occur from any one location within a continuous ninety ,(90)day period,a penalty of twenty-five dollars ($25)may bechargedagainsttheperson,firm,or corporation that is responsibleforsuchalarmsystem.When the number of false alarms exceeds two(2)in any ninety (90)day period,the Chief may notify in writingsuchperson,firm,or corporation that they will be held responsibleforcostsofrespondingtosuchfalsealarmsiftheycontinuetooccur.
F.Fire extinguishing systems may be supervised,at but not limitedto,the 0.S.&Y.valve,post indicator valve,and water flow switch.
G.All systems required under this code may terminate at the Fire Depart-ment or at a central receiving station conforming to N.F.P.A.Pamphlet#71.
H.A four (4)hour area separation wall shall be required to divide abuildingintotwo(2)or more separate buildings for the purpose ofavoidingthesprinklerrequirementsofthisordinance.
16.52.040 Fire Extinguishing Systems:
A.here Required:Approved fire extinguishing systems shall be requiredinallnewlyconstructedbuildingswhichcontaintwelvethousandsquarefeet(12,000')or more of gross floor space,and in all newly construct-ed buildings with an eave height of thirty feet (30')or more.
B.Exceptions:The only exception to these requirements will be buildingswhichareexemptfromArticle.35 of the Uniform Fire Code.(Reference
RCW19.27.060)
16.52.050 Exis.ting Buildings:When additions or alterations are made to existingbuildings,such buildings shall meet the requirements of this ordinance,when the gross floor area exceeds eleven thousand nine hundred and ninety-nine square feet (11,999').
16.52.060 Violation -Penalty:Any person,firm,or corporation who violates,disobeys,omits,neglects,or refuses to comply with or who resists the enforcementofanyoftheprovisionsofthisordinanceisguiltyofamisdemeanorandshallbefinedinanysumnotmorethanthreehundreddollars($300)orimprisonedinthecityjailforatermnotexceedingninety(90)days,
or both for each such offense.
Section 3.Any and all ordinances,or parts of ordinances in conflict herewith
are hereby repealed.
Section 4.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedby1.
