920_00001ORDINANCE NO.920 AN ORDINANCE APPROVING AND CONFIRMING THE ASSESSMENTS AND ASSESSMENT ROLL OF LOCAL IMPROVEMENT DISTRICT NO.41 WHICH RAS BEEN CREATED AND ESTABLISHED FOR THE PURPOSE OF GRADING,GRAVELING,CONSTRUCTING AND INSTALLING CURBS, SIDEWALKS,SEWER SIDE LATERALS,ASPHALT CONCRETE PAVEMENT AND STORM DRAINAGEONMADISONAVENUEBETWEENNELSONROADANDBROWNSTREETINTHECITYOFMOSES LAKE AS PROVIDED BY ORDINANCE NO.870 AND LEVYING AND ASSESSING THE AMOUNT THEREOF AGAINST THE SEVERAL LOTS,TRACTS,PARCELS OF LAND AND OTHER PROPERTY SHOWN ON SAID ROLL. WHEREAs,the assessment roll levying the special assessments against properties located i in Local Improvement District No.41 in the City of Moses Lake,Washington,created under Ordinance No.870 has been filed with the City Clerk of the City of Moses Lake as provided by law;and WHEREAS,notice of the time and place of hearing thereof and of making objections andproteststosaidrollwasdulypublishedatandforthetimeandinthemannerprovidedbylaw,fixing the time and place of hearing thereon for the February .13,-1979 at thehourof8:00 o'clock p.m.in the Council Chambers in the City Hall,Moses Lake,Wash-ington,and further notice thereof was duly mailed by the City Clerk to each property owner shown on said roll;and WHEREAS,at the time and place fixed and designated in said notice the hearing was dulyheldandallprotestsmadeinwritingwerereadandsubmittedtotheCityCounciland were by it overruled. NOW,THEREFORE,THE CITY COUNCIL OF THE CITY OF MOSES LAKE,WASHINGTON,DO ORDAIN: Section 1.That the assessments and assessment roll of Local Improvement District No.41whichhasbeencreatedandestablishedforthepurposeofgrading,graveling ,constructing and installing curbs,sidewalks,sewer side laterals,asphalt concrete pavement and stormdrainageonMadisonAvenuebetweenNelsonRoadandBrownstreetintheCityofMosesLakeasprovidedinOrdinanceNo.870 as the same now stands,be and the same as hereby in allthingsandrespectsapprovedandconfirmed. section 2.That each of the lots,tracts,parcels of land and other property shown uponithesaidrollisherebydeterminedanddeclaredtobe.specially benefited by said improve-ments in at least the amount charged against the same and the assessment appearing againstthesameisinproportiontotheseveralassessmentsappearinguponsaidroll.There isherebyleviedandassessedagainsteachlot,tract,parcel of land and other propertyappearinguponsaidrolltheamountfinallychargedagainstthesamethereon. Section 3.That the assessment roll as approved and confirmed shall be filed with theTreasureroftheCityofMosesLakeforcollectionandthatsaidcityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisin -her hands for collection and that payment of any assessment thereon or any portion of saidassessmentcanbemadeatanytimewithinthirty(30)days from the date of the firstpu-lication of said notice without penalty,interest,or cost,and that thereafter thesumremainingunpaidmaybepaidintenequalannualinstallmentswithinterestthereonofseven§,onehalfft7ht)opercent.The first installment of assessments on said assessmentrollshallbecomedueandpayableduringthe30-day period succeeding the date one yearafterthedateoffirstpublicationbytheCityTreasurerofnoticethattheassessmentrollisinherhandsforcollectionandannuallythereaftereachsùcceedinginstallmentshallbecomedueandpayableinlikemanner. If the whole or any portion of the assessment remains unpaid after the first 30-day period,interest upon the whole unpaid sum shall be charged at a rate of seven&cmewhalf (7 ½%)perannumandeachyearthereafteroneofsaidinstalLments,together with interest due onthewholeoftheunpaidbalance,shall be collected.Any installment not paid prior totheexpirationofthesaid30-day period during which such installment is due and payableishallthereuponbecomedelinquent.All delinquent installments shall be subject to achargeforinterestofseveneigneeglfÛB%)perannum and for an additional charge of ninepercent(9%)penalty levied upon both principal and interest due upon such installmentorinstallments.The collection of such delinquent installments shall be enforced inthemannerprovidedbylaw.
