ANORDINANCEPROVIDINGSTANDARDSANDREGULATIONSFORBURGLARANDROBBERYALARMSYSTEMS THE CITY COUNCILOF THE CITYOF MOSESLAKE,WASHINGTON00 ORDAINAS FOLLOWS: Section 1.Short Title:This ordinance shall be known and may be cited as aniAlarmOrdinance. Section 2.Purpose And Definitions A.The purpose of this ordinance is to provide minimumstandards andregulationsapplicabletoburglarandrobberyalarmsystems,alarmbusinesses,alarm agents and alarm users as defined in this ordi-nance. B.For the purpose of this ordinance,the following terms,phrases,words,and their derivations shall have the meaninggiven herein.When not inconsistent with the context,words used in the presenttenseincludethefuture,words used in the plural number includethesingularnumber,and words in the singular number include thepluralnumber.The word "shall"is always mandatory and notmerelydirectory. 1."Alarm Agent"means any person employed by an alarm businesswhosedutiesincludethemonitoring,altering,installing,maintaining,moving,repairing,replacing,delling,servicing,responding to,or causing others to despánd to an alarmdevice.Personnel involved in new construction not in theemployofanalarmbusinessmaybeinvolvedundercontracts orsubcontractsintheuseorinstallationofalannsystems.I Such persons are not required to obtain identification cardsasalarmagentsorobtainlicensesasalarmbusinesses. 2."Alarm Business"means any business operated by a person for a profit which engages in the activity of monitoring,alter-ing,installing,leasing,maintaining,repairing,replacing,selling,or responding to a burglar or robbery alarm system,or which causes any of these activities to take place. 3."Alarm System"means an assembly of equipment and devices (orasingledevicesuchasasolidstateunitwhichplugsdirect-ly into a 110 volt AC line)arranged to signal the presence ofahazardrequiringurgentattentionandtowhichpoliceareexpectedtorespond.In this ordinance,the term "alarmsystem"shall include the terms "Automatic Robbery AlarmSystems",NBurglar AÎðPM SyStemS","Robbery Alarm Systems"and"Manual Robbery Alarm Systems"as those terms are hereinafterdefined.Fire alarm systems and alarm systems which monitortemperature,humidity or any other condition not directlyrelatedtothedetectionofanunauthorizedintrusioninto apremisesoranattemptedrobberyatapremisesarespecifi-cally excluded from the provisions of this ordinance. 4."Alarm User"means any person on whose premises an alarm sys-I tem is maintained within the City of Moses Lake except foralarmsystemsonmotorvehiclesorproprietarysystems.If,ever,an alarm system on a motor vehicle is connected with analarmsystematapremises(other than a proprietary system)Person using such a system is an alarm user.Also excludedfromthisdefinitionandfromthecoverageofthisordinancearepersonswhousealarmsystemstoalertorsignalpersonswithinthepremisesinwhichthealarmsystemislocated,ofanattemptedunauthorizedintrusionorrobberyattempt.Ifsuchasystem,however,employs an audible signal unittingsoundsoraflashinglightorbeacondesignedtosignalpersonsoutsidethepremises,such system shall be within thedefinitionofalarmsystemandshallbesubjecttothisordinance. a 2 5."Annunciator"means the instrumentation on an alarm console atthereceivingterminalofasignallinewhichthroughbothvisualandaudiblesignalsshowswhenanalarmdeviceataparticularlocationhasbeenactivatedoritmayalsoindicatelinetrouble. 6."Answering Service"refers to an answering service providing among its services the service of receiving on a continuousbasis,through trained employees,emergency signals from alarmsystems,and thereafter immediately relaying the message bylivevoicetothecommunicationcenteroftheMosesLake Police Department. 7."Automatic Dialing Device"refers to an alarm system whichautomaticallysendsoverregulartelephonelines,by directconnectionorotherwise,a prerecorded voice message or codedsignalindicatingtheexistenceoftheemergencysituationthatthealarmsystemisdesignedtodetect. 8."Automatic Robber.y Alarm System"means an alarm s.ystem inwhichthesignaltransmissionisinitiatedbytheaction oftherobber. 9."Burglar Alarm System"refers to an alarm system signaling anentryorattemptedentryintotheareaprotectedbythesystem. 10."Central Station"means an office to which remote alarm andsupervisorysignalingdevicesareconnected,where operatorssupervisethecircuits,and where guards are maintainedcontinuouslytoinvestigatesignals. 11."Central Station Equipment"refers to the signal receiving,recording,or retransmitting equipment installed in the cen-tral station. 12."Central Station System"means a system in which the opera-tion of electrical protection circuits and devices are sig-naled automatically to,recorded in,maintained,and super-vised from a central station having trained operators and guards in attendance at all times. 13.The word "City"means the City of Moses Lake,Washington. 14."Direct Connect"means an alarm system which has the capa-bility of transmitting system signals to and receiving them at an agency or business. 15."Direct Line"means a non-dialing telephone line or intercom line leading directly from a central station to the communi-cation center of the police department that is for use only toreportemergencysignalsonaperson-to-person basis. 16."False Alarm"means the activation of a burglary and/or rob- bery system by other than a forced entry,attempted force entry,robbery,or attenpted robbery caused by mechanical failure,malfunction,improper installation or negligence oftheownerorlesseeofanalarmsystemorhisemployeesoragents.Such terminology does not include,for example, alarms caused by hurricanes,tornadoes,earthquakes,or otherviolentconditions. 17."Holdup Alarm System"is the same as defined in this ordinance as Robbery Alarm System. 18."Interconnect"means to connect an alarm system to a voice- grade telephone line,either directly or through a mechanical device that utilizes a standard telephone,for the purpose of using the telephone line to transmit an emergency message upontheactivationofthealarmsystem. Page 3 19."Local Alarm System"refers to a signaling system which whenactivatedcausesanaudibleand/or visual signaling device tobeactivatedinorontthepremiseswithinwhichthesystemisinstalled. 20."Manual Robbery Alarm System"refers to an alarm system inwhichthesignaltransmissionisinitiatedbythedirectactionofthepersonattackedorb.yan observer of the attack. I 21."Modified Central Station"means an office to which remotealarmandsupervisorysignalingdevicesareconnected,whereoperatorssupervisethecircuits.Such modified centralstationisnotlistedbyUnderwriters'Laboratories. 22."Person"means any person,firm,partnership,association,corporation,company,or organization of any kind. 23."Police chiefN means the Chief of the Police Department of theCityofMosesLake,or his designated representative. 24."Police"or "Police Department"means the publicly supportedPoliceDepartmentoftheCityofMosesLakeoranyauthorizedagentthereof. 25."Proprietary System"means an alarm system sounding and/orrecordingalarmandsupervisorysignalsatacontrolcenterlocatedwithintheprotectedpremises,the control centerbeingunderthesupervisionoftheproprietoroftheprotectedpremises.If a proprietary system includes a signal lineconnecteddirectlyorbymeansofanautomaticdialingdevicetoacentralstation,modified central station,or answeringservice,it.thereby becomes an "alarmsystem"as defined inthisordinanceandmustmeettherequirementsofthisordin-ance.I 26."Remote Signaling Systen"means en alarm signaling systemwhichwhenactivatedbyanalarmdevicetransmitsasignalfromanalarmsignalingdevicetoacentrallocation,otherthanthePoliceDepartment,where appropriate action is takentoinvestigateandrespondtothesignal. 27."Robbery Alarm System"refers to an alarm system signaling arobberyorattemptedrobbery. 28."Signal Line"refers to the transmission line through whichthesignalpassesfromoneoftheelementsofthesignaltransmissiontoanother. 29."Subscriber"means a person who buys and/or leases,or other-wise obtains an alarm signaling system and thereafter con-tracts with or hires an alarm business to monitor and/orservicethealarmdevice. 30."Telephone Company"means the utility that furnishes telephoneservicestotheCityofMosesLake. 31."ANSI"stands for the American NationaleStandards Institute. I 32."UL"stands for Underwriters'Laboratories. 'Section 3.Application For License By Alarm Business A.Any person engaging in an alarm business in the city shall,withinthirty(30)days after the effective date of this ordinance,applytotheCityClerkforalicensetooperateonaformtobefur-nished by the City Clerk.Businesses which sell only those alarmsystemsexcludedfromthedefinition-of alarm systems in Section 2B3ofthisordinancearenotrequiredtoobtainalicenseunderthisSection.Such application shall be signed by the individualproprietorofsuchbusiness,or by a partner,or by the propercorporateofficial,as is appropriate for the form of the businessseekingthelicense,and shall include: 4 1.The name,address,and telephone number of the alarm business, and the type of business organization it is (individual,partnership,or corporation).If the business is an indivi-dual proprietorship,the name,address,and telephone numberoftheowner;if a partnership,the name,address,and tele-phone number of each partner (general,limited,silent,etc.); if a corporation,the names and addresses of the directors,principal officers and stockholders (any stockholder holding more than 20 percent of the corporation's authorized andissuedstock)and the state where incorporated. 2.Certification that within 90 days after the effective date ofthisordinanceoruponreceiptofnoticeofapprovalofalicense,whichever occurs later,the alarm business shallmaintainadescriptionofthealarmsystemsanddevicesofferedforsaleorleasetothepublicandadescription ofanyservicesrelatedtoalarmdevicesofferedtothepublic. 3.Certification that within 90 days after the effective date ofthisordinanceoruponreceiptofnoticeofanapprovalofalicense,whichever occurs later,a complete list of the namesandaddressofallpersonsforwhomalarmsystemshavebeensoldand/or are currently under contract to the alarm business for service on or after the effective date of this ordinance,shall be maintained for inspection by the Police Chief during the course of his official business. 4.A complete list of criminal convictions,if any,except for minor traffic offenses of the applicant,or a list of criminalconvictions,if any,except for minor traffic offenses of eachpartner,officer,or local office manager if the applicant isotherthananindividual. 5.A statement that the applicant will inform the Police Depart- ment within ten (10)days after any substantial change in theinformationrequiredbySection3ofthisordinanceinwrit-ing. 6.A copy of a valid Washington State Electrical License issuedbytheDepartmentofLaborandIndustriesasrequiredbyRCW 19.28.120,if the applicant is going to be involved in thebusinessofinstallingwiresorequipmenttoconveyelectriccurrentorinstaTTingapparatustobeoperatedbysuchcurrent as it pertains to the electrical industry. B.License application shall be accompanied by a nonrefundable fee oftendollars($10)to cover the costs to the city of processing theapplicationandinvestigatingtheapplicant. C.Applicants already doing business in Moses Lake on the effective date of this ordinance may continue to do business while theirlicenseapplicationsarebeingprocessed.An applicant not pre-viously doing business in Moses Lake on the effective date of thisordinanceshallnotcommencedoingbusinessuntilhisapplication is approved. D.If an alarm business is operating or intends to operate a central station,a modified central station,or a telephone answering service,the license application shall so specify.An alarm busi- ness which commencesoperation of a central station,a modified central station,or a telephone answering service must comply with the applicable standards set forth in Sections 14,15,and 16 and must be inspected for such compliance by an appropriate city offi-cial before a .license may be issued. E.Alarm businesses which are operating a central station,modified central station,or telephone answering service on the effective date of this ordinance shall have two years after such date toconformtothestandardsrequiredbySections14,15,and 16 of this ordinance. Page 5 Section 4.Action On Business License Applications And Standards For IssuanceOfLicense A.The City Clerk shall request a background report on the applicanttobepreparedbythePolicechieforhisdesignatedrepresentativebasedontheinformationcontainedintheapplicationtogetherwithsuchotherrelevantinformationasmaybeobtainedpertainingtotheapplicantandhisbusinesswitharecommendationtoapproveordenythelicense, i The background check will require a full set of rolled fingerprintimpressions.of the applicant which will be sent to the state andnationalidentificationsectionsoftheState'of Washington and theFederalBureauofInvestigation.In addition to the fingerprints,the Moses Lake Police Department will photograph the applicant withthephotographtoberetainedintheCityClerk's business filesandidentificationfilesofthePoliceDepartment. B.On the basts of this report,the Police Chief shall within sixty(60)days after the receipt of the City Clerk s request for areportofanapplicationforanalarmbusinesslicenseshallmake arecomrendationtoeitherapproveordenytheissuanceofalicense.Upon making a decision,the City Clerk sha11: 1.In the case of approval,notify the applicant,in writing oftheapproval,and inform him that upon the presentation of thewritingtotheCityClerk,or his designated representative,and the .payment of the required fee,the applicant will beissuedalicensetooperate. 2.In the case of denial,notify the applicant,in writing,ofthedenialandofthebasisforthedenial,which may be non-conformance with any part of this ordinance.If the basis forthedentalcanbecorrected,the writing shall so state andishallexplainhowthesecorrectionsmaybemadeandsetareasonabletimelimitformakingsuchcorrections.Thenoticeofdenialshallinformtheapplicantthathemay appealthedentalandsetforththeprocedureforappeal.The proce-dure for appeal shall he as follows: a.Within ten (10)days after receipt of the notice ofdenial,the applicant shall file a notice of appeal withtheCityManageraèdressedtotheCityCouncilandStatingthebasi's of the appeal. b.Within ten (10)daystafter receipt of the notice ofappeal,the City Manager or his designated representative,shall arrange for a conference with the applicant and thePoliceChieftoattempttoreachanagreementconcerningtheappeal. c if the conference fails to settle the matter in a wayacceptabletotheapplicant,arrangements shall be madetohavetheappealheardbeforetheCityCouncil.Suchhearingshallbelheldwithintwenty(20)days after theconference.The City Manager shall cause the applicanttobegivennoticeofthehearingbycertifiedmailatleastseven(7)da.ys in advance of the date of the hear-I ing.Notice of such hearing shall also be posted as partoftheCityCouncil's agenda for that meeting.TheapplicantmayappearbeforetheCityCouncilandtheapplicantorhisdesignatedrepresentativemaymakeanoralpresentationofhisappeal,or he may make the appealthroughawrittenstatement,or he may do both.The CityCouncilshallruleontheappealwithinthirty(30)daysafteritisheard,and such ruling shall be final. Page 6 Section 5.Fees For License And License Renewal A.An alarm business wishing to do business in the city shall paystandardlicensingfeesrequiredofothermerchantsinthecom-munity. B.No refunds of license fees shall be made. Section 6.Revocation Of Alarm Licenses A.In addition to any penalties which may be imposed for the violationofcertainprovisionsofthisordinance,the city may,pursuant totheprovisionsofthisSection,revoke the license of an alarmbusinessonanyofthefollowinggrounds: 1.Fraud or willful and knowing misrepresentation or false state-ment made in an application for a license. 2.Fraud or willful and knowing misrepresentation or false state-ment madein the conduct of an alarm business. 3.Failure to comply within a reasonable time with any order ornoticeistuedb.y the City Manager after the licensee's.rightstohearingandappealhavebeenexhaustedorfailureafterreasonablenoticetopermitthePoliceChieftoinspectanylistswhichheisauthorizedtoinspectunderthisordinance,or failure to comply with the standards imposed by this ordin-ance within a reasonable time,not less than thirty (30)days,after notice or order from the Police Chief. B.No alarm business license shall be revoked until a hearing is heldbytheCityClerk.Written notice of the time and place of thehearingshallbeservedontheholderofthelicenseatleastten(10)days before the date set for the hearing.The notice shallsetforthasummaryofthegroundsadvancedasthebasisfortherevocationofthelicense. C.At the hearing before the City Clerk,the holder of the license orhisauthorizedrepresentative,shall be given an opportunity toconfrontandexamineanyadversewitness,and to present evidence on his own behalf.After the hearing the City Clerk shall eitherdismissthecomplaintorshallforwardthecomplainttotheCityManagerwithhisrecommendationthatthelicenseberevoked.Within ten (10)days after receiving such recommendation,the CityManagershallapproveordisapprovetherecommendation.In eitherevent,the City Manager shall cause the holder of the license to begivennoticeinwritingofhisdecisionwithinten(10)days aftermakingit. D.Any person whose license is revoked pursuant to Section 6 C of thisordinanceshallhavetheright,within ten (10)days after receiv-ing notice in writing of the revocation from the City Manager,offilingawrittenappealwiththeCityCouncil.Such appeal shallsetforthindetailthespecificgroundorgroundsonwhichitisbased.The City Council shall hold a hearing on the appeal withinthirty(30)days after its receipt by the city and shall cause theappellanttobegivenatleastten(10)days written notice of suchhearing.At the hearing the appellant or his authorized represen-tative shall have the right to present a written or oral argument,or both,in support of his appeal.The determination of the CityCouncilontheappealshallbefinal. Page 7 E.Within ten (10)days after an alarm business receives notice ofrevocatton'of'its license,or aft r it hos exhausted all appealswithrespecttosuchrevocatioW,it shall notify all persons forwhomitisrequiredtomaintainalistpursuanttoSection3A3 ofthisordinanceofsuchrevodation,and the notice shall advise suchpersonsthatthealarmbusinessmustceaseprovidingservicefororsellingburglarandrobberyalarmsystemstosuchpersonswithinthirt;y (30)days after they receive notice of revocation.For thepurposesofthisSection,any alarm business other than a central i station,modified central station,or telephone answering servicemaysatisfythenoticerequirementsbyplacinganadvertisementinanewspaperornewspaperspùblishedinthegeographicareasinwhichitscustomersarelocated,which advertisement shall be in aformprescribedbytheCityClerk.Such advertisement shouldappearatileastonedayaweekforthreesuccessiveweeks.WhenthenoticarequiredbythisparagraphhasbeencompletedthealarmbusinessshallsubmitasworncertificatetotheCityClerkthatithasmettherequirementsofthisparagraph. F.After notice of revocation has been given,an alarm businesslicenseemaycontinuetooperatehisbusinessuntilallof hisrightsofappeal"ander this ordinance have been exhausted. Section 7.Alarm Agents -Identification Cards A.Every alarm agent employed by an alarm business within Moses LakeshallherequiiredtoobtainanidentificationcardfromtheCityclerk.Until .the City Clerk acts upon the=application of an alarmagentfbWahidentificationtard,an alatm'behiness-may issue atemporaryidentificationcard,as provided in patagraph B of thissection.The owners,managers,corporate officers,and partners ofallalarmbusinessesarealso'required to obtain identificationcardsfromtheCityClerkiftheydirectlyengageinselling,installing,servicing,maintaining,or responding to alarm systemswithinMosestake.'An.y persont who is not an alarmagent who,as anemployeeaflalicensedalarmbusiness,has access tb confidentialinformationofanalarmuser,or to monitoring radio equipment,must also obtain an identification card.Within thirty (30)daysoftheeffectivedateofthisordinance,alarm agents and,ifrequiredbythisparagraph,owners,managers,corporate officers,and partners sha1T submitsapplications to the City Clerk foridentificationcards.The application for the identification cardshallbeinaformprescribedbytheCityCTerkandshallincludethefollowing: 1.The applicant's full nameand any aliases or other namespreviouslyused,residence and business addresses and tele-phone numbers.I 2.The applicant's date and place of birth 3.A list of all felony and misdemeanor convictions of theapplicant. 4.Two classifiable sets of fingerprints 5.Two recent photographs of the applicant of a type prescribedbytheCityClerk.I 6.The name and address of the alarm business where the applicantisorwillbeemployed. 7.The applicant's unployment record for the p†ior three years. 8.A statement that the applicant will inform the City Clerk ofanychangeintheaboveinformationortheterminationoftheapplicant's employment by the alarm business within ten (10)days of such change. 9.Any other information which the City Clerk may deem necessarytodeterminewhethertheapplicantforanidentificationcardmeetstherequirementsofthisordinance. Page 8 B.A temporary identification card may be issued by an alarm businessforitsalarmagentsoranyotherpersonrequiredtoobtainanidentificationcardinparagraphAofthissectionpriortotheobtainingofanauthorizedidentíficationcardfromtheCityClerk.The form for temporary identification cards shall beprescribedbytheCityClerkandshallprovideforthefollowing: 1.The name of the alarm agent or card holder. 2.The homeaddress of the alarm agent or card holder. 3.The name and address of,the alarm business for which the alarmagentorcardholderisemployed. 4.The date upon which the alarm agent or card holder commencedemploymentwiththealarmbusinessandtheexpirationdateofthetemporaryidentificationcard. 5.A recent photograph of the alarm agent or card holder. Prior to employing an alarm agent,an alarm business shall requirethenamesofatleasttworeferencesandthenamesandaddresses ofemployersforthepastthreeyearsofsuchpersonandshallmakereasonableandprudentinquiriespriortoissuingatemporaryidentificationcardtodeterminewhetherthepersonapplyingforemploymentmeetstherequirementsofthissection.If the alarmbusinesshasneasontobelievethatthejobapplicantdoesnotmeettherequirementsofthissection,no temporary identification cardshallbeissuedbythealarmbusiness.Within fourteen (14)daysofthecommencementofemploymentwithanalarmbusiness,any newalarmagentmustsubmitanapplicationtotheCityCTerkforapermanentidentificationcardunderthissection. C.The temporar.y or permanent identification card required by thissectionshall:be carried by a person required to obtain an iden-tification card whenever such person is engaged in the business ofthelicenseeandshallbeexhibitedatthedemandofanylawfulauthority. D.Application for an identification card must be accompaniedby a $10feetocovercostsofprocessingtheapplicationandinvestigatingtheapplicant. Section 8.Action On Alarm Agent Applications A.The Police Chief shall cause a report on the applicant for the CityClerktobepreparedbasedontheinformationcontainedintheapplicationtogetherwithsuchothertelevantinformationasmaybeobtainedpertainingtotheapplicant.No identification card shall be issued if: 1.The applicant has been convicted of a felony or a misdemeanor involving moral turpitude. 2.The application contains any false statements made willfullyandknowingly. 3.The applicant is not employed as an alarm agent or is not tobeemployedasanalarmagentbyanalarmbusinessifheis issued an identification card. B.If the application is approved,the City Clerk shall cause anidentificationcardtobeissuedtotheapplicant. Page 9 C.If the application-is denied,the City Clerk shall notify theapplicant;in writing,of the denial and of the basis for thedenial.The notice of denial shall inform the applicant that hemayappealthedenialandsetforththeprocedureforappeal.Theprocedureforappealshallbeasfollows: 1.The applicant shall have ten (10)days after receipt of thenoticeofdenialtofileanoticeofappealwiththeCityManagerorhisdesignatedrepresentative,stating the basisfortheappeal,i 2.Withinsten (10)days after receipt of the notice of appeal,the City Manager or his designated representative,shalleitherreversetheCityClerkandorderanidentification cardtobeissued,or uphold the decision of the City Clerk and cause the applicant-to be so notified.The ruling of the cityManagerorhisdesignatedrepresentative,ishall be final. Section 9.Suspension Or Revocation Of Identification Cards , A.In addition to any penalties which may be imposed for the violationofprovisionsofthisordinance,the city may,pursuant to theprovisionsofthissection,revoke the identification card of analarmagentonanyofthefollowinggrounds: 1.Fraud or willful and knowing misrepresentation or false statement made in an application for an identification card. 2.Fraud or udllful and knowing misrepresentation or falsestatementmadewhileemployedasanalarmagent. 3.Conviction of a felony or of a misdemeanor which reflectsunfavorablyuponthecardholder's fitness to be an alarmagent.I B.No identification card shall be'revoked until a hearing is held bytheCityClerk.Written notice of the time and place of thehearingshallbeservedontheholderofanidentificationcard atleastten(10)days before the date set for the hearing.Thenoticeshallsetforthasummaryofthegroundsadvancedasthebasisfortherevocationoftheidentificationcard. C.At the hearing before the City Clerk :the holder of the identifi-cation card,shall be given an opportunity toiconfront and examineanyadversewitness,and to present evidence in his own behalf.After-the hearing the City Clerk shall either dismiss the com-plaint,or shall forwards the complaint to the City Manager with hisrecommendationthatanidentificationcardberevoked.Within ten(10)days after receiving such recommendation,the City Managershallapproveordisapprovetherecommendation.In either event,the City Manager shall cause the holder of an identification cardtobegivennoticeinwritingofhisdecisionwithinten(10)daysafterwakingit. D.Any person whose identification card is revoked pursuant to Section9ofthisordinanceshallhavetheright,within'ten (10)daysafterreceivinginoticeinwritingoftherevocationfromtheCityManagereoffilinga.written appeal with the City Council.SuchIappealshallsetforthindetailthespecificgroundonwhichit isbased.Thes€ity Council shall hold a hearing on the appeal withinthirty(30)days after its receipt by the city,and shall cause theappellanttobegivenatleastten(10)days written notice of suchhearingtAtthehearingtheappellantorhisauthorizedrepresen-tative-shall have the rightito present a written or oral argument,or both,in support of his apPeal.The determination of the CityCouncilon'the appeal shall be final. E.After notice of revocation is given,an alarm agent identificationcardshallremaininfullforceandeffectandtheholderofanalarmagent.identification card shall be permitted to perform theauthorizedfunctionsofalicensedalarmagentuntilanyappealhasbeenconcluded. Section 10.Identification-Cards -Form;Return Of Cards A.An identification card missued by the City clerk shall contain arecentphotographoftheapplicant,ithe date of issue,the appli-cant's signature,a statement that the card is valid for two (2)years from the date of issue and such other information as the CityClerkmay-in his discretion require.All identification cardsshallbeconsecutively;numbered. B.It shall he a misdemeanor for the applicant willfully to fail toreturnanidentificationcardtotheissuingagencyorbusiness upon termination of his employmentwith an alarm business.Itshallbeamisdemeanorforthealarmbusinesstofailtoreturn totheCityClerkanidentificationcardissuedbytheCityClerkuponterminationoftheemploymentofthealarmagent. Section 11.Administrative Rules The Cit.y Clerk shall promulgate such rules as may be necessary for theimplementation-of this ordinance and for determination of grounds forclericalsuspension,or revocation of any license or permit required bythisordinance.The rules shall be approved by the City Manager andshallbeopentoinspectionbythepublic. Section 12.Automatic Dialing Device A.Persons owning or'leasing an automatic dialing device may have thedeviceinterconedontoatelephonelinetransmittingdirectlyto: 2.A modified central station. 3.A licensed answeringsservicer B.Automatic dialing devices may also be interconnected to one or moretelephonenumbersavailabletotheownerorlesseeofthedevices, or their designated representatives,at another location. C.No automatic dialing device may be interconnected to other com-munication centers in the Police Department,other municipal .offices,or to the telephone company operator,excluding the city Fire Department offtees. Section 13.Automatic Dialing Device -Operating Instructions;Service A.Every alarm business selling or leasing to any person an automaticdialingdevicewhichisinstalledonsuchperson's premises in thecityaftertheeffectivedateofthisordinanceshallfurnishthat person with instructions that provide adequate information toenablepersonsusingsuchdevicetooperateitproperlyand,if thedeviceistobeservicedormaintainedbyanotheralarmbusiness, shall furnish «such othermalarm business with a manual or otherinformationsmecessarytoenabletittoserviceorproperlymaintain su¢h device. B.If the city Clerk reasonably finds such infonaation to be incom-plete or unclear,or inadequate to explain how the device operatesandisconstructed,he may require the alarm business to revise theinformationtomeethis.approval,and then to distribute the revised information to persons who have had such devices installed as well as to persons subsequently having such devices installed. Page 11 C.Every alarm business selling or leasing to any person an automaticdialingdevicewhichisinstalledonsuchperson's premises in thecityaftertheeffectivedateofthisordinanceshallprovideormakeavailableatalltimesservicetorepairsuchdeviceshoulditmalfunction,and shall furnish to the person buying or leasing suchdevicewritteninformationconcerninghowservicemaybeobtainedatanytime,including the telephone number to call for service. Section 14.Central Stations -Standards i In addition to any other requirements imposed by this ordinance,analarmbusinessshallnotbegrantedalicensetooperateacentralstationunlessthePoliceChieffindsthatthecentralstation,ifoperated,will meet the following minimumrequirements: A.Compliance with "Standard for Central Station Burglar Alarm UnitsandSystems"(UL 611 1972)issued by Underwriters'Laboratories orAmericanNationalStandardsInstitute(ANSI SE2.2 1972). B.Such standards are hereby adopted and made a part of this ordi-nance,and a copy of such standards shall be kept on file at thePoliceDepartmentandbeavailableforpublicinspection.Theserviceprovidedmaycorrespondtoanyoftheseveralgradesofservicelistedinthestandards,but the owner,aTarm agent orotherpersoninresponsiblecontrolofthepremiseswhereinsuchalarmsystemislocatedmustbepresentatsuchpremisesassoon asisreasonablypossibleafterbeingrequestedtodosobyarepre-sentative of the Police Department.A central station mayalso belicensedasamodifiedcentralstationorlicensedtelephonean-swering service. C.If a central station is currently registered with Underwriters'Laboratories as a "UL listed central station"or if it is listed assuchinUnderwriters'Laboratories'publication.The Quarterl.yiSupplement,such registration or listing shall be sufficient evi-dence of compliance with this Section. Section 15.Modified Central Stations -Standards In addition to any other requirements imposed by this ordinance,analarmbusinessshallnotbegrantedalicensetooperateamodifiedcentralstationunlessthePoliedChieffindsthatthemodifiedcentralstation,if operated,will meet the fallowing minimumstandards: A.The premises from which the services are performed must meet anyapplicablefineregulations. B.The premises from which the servtces are performed must be securedinamannerapprovedbythePoliceChieftoprevententrybyunauthorizedpersons. C.A large enough number of oþerators must be on duty,awake and fullyalert,at alT times to assure that all emergency messages receivedwillberelayedimmediatelytothePoliceDepartmentoveradirectline. D.As soon as possible after notifying the Police Department,theoperatorconcernedshallnotifythesubscriberinvolvedofsuchIactionandthenatureoftheemergencymessagereceived. E.The modified centra3 station shall certify that all equipmentsupervisedbythemodifiedcentralstationshall'be tested at leastonceayear.Where a test result is unsatisfactory,the causethereofshallbecorrectedwithintwenty-four (24)hours unlesscircumstancesextstthatmakesuchcorrectionsimpossiblewithinsuchtime,in which event the cause shall be corrected within areasonabletime. Page 12 Section 16.Answering Serv:ices -Standards In addition to any other requirements imposed by this ordinance,analarmbusinessshallnotbegrantedalicensetooperateanansweringserviceunlessthePoliceChieffindsthattheansweringservice,ifoperated,will meet the following minimumstandards: A.The premises from which the services are performed must meet anyapplicablefireregulations. B.The premises from which the services are performed must be securedina-manneriapproved by the-Police Chief to prevent entry byunauthorizedpersons.r C.A large enough number of operators must be on duty,awake and fullyalert,at all times to ensure that all emergency messages receivedwillberelayedimmediatelytothePoliceDepartmentoveradirectline. D.Emergency messages frme automatic alarm devices shall be given priorit.y over all other mesages received by the answering servicesexceptthatfirealarmsignalsmayhaveequalpriorit.y. E.All operators shall be trained to handle emergency messages. F.As soon as possible after notifying the Police Department,theoperatorconcernedshallnotifythesubscriberinvolvedofsuchactionandthenatureoftheemergencymessagereceived. G.All subscribers of an answering serv.ice shall be required b.y theservicetocooperateinatestofitsalarmdevicesatleastonce a year to determine if the device is working properly.The an-swering service shall certify that the test requirements have been fulfilled.Unsatisfactory test results shall be reported promptly,in writing,tar the subscriber and the Police Department.Until thedeviceinques.tion is again working properly,the Police Department may require that its use be discontinued. Section 17.Alarm Systems -Standards And Inspection A.All alarm systems insta11ed in commercial or public buildings afterthepassageofthisordinanceshallutilizeequipmentandmethodsofinstallationsubstantiallyequivvalenttoorexceedingthefollowingminimumapplicableULorANSIstandards:UL 609 (ANSI5E2.1-1972)"Local Burglar Alarm Units and Systems";UL 636 (ANSI 5E2.7-1973)"Hold-up Alarm:Units and Systems";UL 681 (ANSI SE2.3-1972)"Installation and Classification of Mercantile and Bank Burglar Alarm-Systems." B.All alarm systems installed in residences after the passage of thisordinanceshallutilizeequipmentwhichshallbesubstantiallyequivalentto.or exceed the minimum applicable ULStandards 1023(ANSI SE2s4-1972)"Household,Burglar Alarm Systems Units,"and suchequipmentshallbeinstalledinasafe,reliable,and workmanlike manner. C.The equipment or hardware-used and/or the manner of installation ofthealarmsystemmaycorrespondtoanyoftheseverallevelsof protection or gradestof service listed in the applicable standards, provided,however,that alarm system users shall not be required toprovideprotectionforalloftheareasoropeningswhichmaybe required to be protected by the applicable standards. D.The standards referred to in this.section are hereby adopted aspartofthisordinancesubjecttothemodificationsandqualifi- cations set forth.herein and ar copy of such standards shall be kept on file at the City Hall and be available for public inspection. Page 13 E.In those instances where UL and/or ANSI have not establishedstandardsfor.categories of equipment or where new equipment isundergolingfieldtesting,the City'Clerk may require that the alarmsystembeinspectedattheexpenseofthealarmuserbyaprofes-sional electrical engineer whoshall certify whether the alarmsystemappearstobesafeandreliable. Section 18.Inspection=0f Alarm Devices And Businesses i A.For the purpose of enforcing the provisions of this ordinance,thePoliceChiefshallhavetheauthority,at reasonable times and uponreasonableoralnotice,to enter any premises in the city in oruponwhichalarmbusinessessubjecttothisordinancearelocated,to inspect the installation and/or operation of such alarm systemsoralarmbusinessesonofficialpolicebusiness. B.If such inspection reveals any violations of the provisions of thisordinance,a written report detailing such violations shall bepromptlysenttotheCityClerkandtotheowner,lessee,or otherpersonresponsibleforthealarmsystemorbusinessinviolationofthisordinante.Such report shall require the correction withinthirty(30)days after receipt of the notice of the violationdiscovered,and shall state that a failure to comply may result intherevocationofthealarmbusiness'license to operate,inaccordancewithprovisionsofthisordinancerelatingtorevocationoflicensesandpermits.The alarm user or alarm business shall begrantedareasonableextensionoftimetocorre¢t such violationupongoodcauseshown. Section 19.Statistical Data In addition to any other information that may be required to be sup-plied by the provisions of this ordinance,the Police Chief may requireanalarmbusinesstofurnishhim'with certain statistical data whichimaybereasonablysavailablerelativetospecifiedperiodsofoperationaftertheeffectivedateofthisordinance.Any operational data sofurnishedshallbeforuseonlybytheCityManager,Police Chief,andthePoliceDepartment. Section 20.Testing Of Equipment Permission is not required to test or demonstrate alarm devices nottransmittingemergencymessagesdirectlytothePoliceDepartmentunlessthemessagesaretoberelatedtothePoliceDepartment. Section 21.Notice Of Disruption In Service When an alarm business'service to its subscribers is disrupted for anyreasonbythealarmbusiness,or the alarm business becomes aware ofsuchdisruption,it shall promptly notify its subscriber by telephonethatprotectionisnolongerbeingprovided.If,however,the alarmbusinesshaswritteninstructionsfromitssubscribernottomakesuchnotificationbytelephoneduringcertainhours,thé alarm business maycomplywithsuchinstructions. Section 22.Alarm User Permits A.Permit -Within ninety (90)days after the effective date of thisordinance,every alarm user shall obtain an alarm user permit foreachalarmsystemheoperateswithinMosesLakefromtheCityClerk.This paragraph'does-not require that licensed alarm busi-nesses obtain a permit under this section when it leases or pro-vides services to alarm system users.If a licensed alarm businessdoes,however,use an alarm system to protect its own premises,itshallobtainapermitforsuchsystemasrequiredinthissection. Page 14 B.Alarm User,Permit Application 1.The alarm user applying for the permit required in paragraph A of this section,shall state on a permit application form tobepreparedbytheCityClerkhisnameitheaddressoftheresidenceofbusinessorbusinessesinoruponwhichthealarmsystemhasbeenorwillbeinstalled,his telephone number,the type of alarm system (local,direct connect,centralstation,etc.),the alarm büsiness or businesses selling,installing,monitoring,inspecting,responding to and/ormaintaingthealarmsystemi,and the name and telephone numberofatleastoneotherperson(in the case of a corporate alarn user applicant,at least two persons)who can be reached at any times day or night,and who is authorized to respond to analarmsignalandwhocanopenthepremisesinwhichthesystemisinstalled. 2.Any alann user who installs a systen ninety (90)days or moreaftertheeffectivedateofthisordinancemustsubmitwiththeapplicationacertificateofalicensedalarmbusinessstatingthatintheopinionofsuchbusinessthealarmsystemcomplieswithSectdon17ofthisordinance.Such certificateshallsatisfytherequirementsofparagraphD1ofthissectionfortheyearinwhichthealarmpermitisfirstobtained. C.Alarm User Permit Fee 1.Thertshall be a $5 permit fee for the first year. 2.There shall be an annual renewal fee of $2. D.Every alarm user licensed under this section shall be required tohaveitsalarmsysteninspected.at least once a year by a licensedalarmbusiness,and post a certificate of such inspection on thepremiseswherethealarmsystemismaintained.The certificateshallstatethatintheopinionofthealarmbusiness: 1.The alarm system complies with the applicable provisions ofSection17ofthisordinanceifthesystemwasinstalledninety(90)days or more after the effective date of thisordinance. 2.The alarm system is safe and reliable if it was installed prior to ninety (90)days after the effective date of thisordinance. E.An applicant for an alarm user permit may file a request with the City Clerk requesting that he temporarily waive the requirements ofparagraphsB2andD1ofthissectionincircumstancesinwhich the public's safety,health,or welfare is involved. F.Any alarm systemi user who operates an alarm systemwithout first obtaining a permit as requjred by,this section,or who,afterhavíngapermitrevoked,or suspended,and after exhausting his rights to hearing and appeal fails to disconnect his alarm system,shall be in violation of this ordinance. Section 23.False Alarms A.It is unlawful to have or maintain on any premises an audible typeburglaryand/or robbery alarm unless: 1.The.alarm will shut itself off after sounding for a period of seven (7)minutes maximum. Page 15 2.Unless there is posted at the main entrance to such premises aprominentnoticeofthetelephonenumbersatwhichthepersonorpersonsauthorizedtoentersuchpremisesandturnoffsuchalarecanbereachedatalltimes,and it is unlawful for anysuchpersontofailtúappearandturnoffanysuchalarmWithinonehourafterbeingnotifiedbythepolicetodoso. B.It is unlawful for anyone to activate any robbery or burglary alarsforthepurposeofsummoningpoliceexceptintheeventofanacutalorattemptedburglaryorrobbery,or for anyone notifyingithepoliceofanactivatedalarmandhavingknowledgethatsuchactivationwasapparentlycausedbyanelectricalorothermal-function of the alarm system to fail at the same time to notify thepoliceofsuchapparentmalfunction. C.For a police response to any false alarm the Police Chief shallinformtheCityClerkandtheCityClerkshallchargeandcollectfromthepersonhavingormaintainingsuchburglaryand/or robberyalarmonpremisesownedoroccupiedbyhim,fees as follows: 1.For a response to premises at which no other false alarm hasoccurredwithintheprecedingthree(3)gonths period,herein-after referred to as a "first response",no fee shall becharged,but the person having or maintaining such burglaryand/or robbery alarm shall,within three (3)working daysafternoticetodoso,make a written report to the PoliceChiefonformsprescribedbyhimsettingforththecauseofsuchfalsealarm,the corrective action taken,whether suchalarmhasbeeninspectedbyanauthori'EOd Sgrvigeman,and suchotherinformationasthePolicechiefmayreasonablyrequiretodeterminethecauseofsuchfalsealarmandcorrectiveactionnecessary. 2.For a second response to a premises within three (3)monthsiafterafirstresponse,no fee shall be charged,but a writtenreportshallberequiredasforafirstresponseandthePoliceChiefshallbeauthorizedtoinspectorcausetobeinspectedthealarmsystematsuchpremises,prescribe neces-sar.y corrective action,and shall give notice to the personhavingormaintainingsuchalarmsystemoftheconditionsandrequirementsofthissection. 3.For a third response to premises within three (3)months aftersuchasecondresponse,and for all succeeding responseswithinthree(3)months of the last response,a fee of twenty-five dollars ($25)shall be charged,and if such third falsealarmoranysuchsucceedingfalsealarmisasaresultoffailuretotakenecessarycorrectiveactionprescribedbythePoliceChief,said Police Chief may order the disconnection ofsuchalarmsystemanditshallbeunlawfultoreconnectsuchalarmsystemuntilsuchcorrectiveactionistaken;provided,that no disconnection shall be ordered as to any premisesrequired.by law to have an alarm system in operation. Section 24.Service By Mail When a city official or City Council has the right or is required toactortakesomeproceedingwithinaprescribedperiodpursuanttothisIordinance,and service is made by mail,two days shall be added to theprescribedperiod.Whenever a person,the Police Chief or any cityofficialoremployeeisrequiredtomakedeliverybyfirstclassmail,delivery,in lieu thereof,may be made by hand by any person eighteenyearsofageorolder. Page 16 Section 25.Violation -Penalty Any person,fing,or corporation who violates,disobeys,omits,ne-g1ects,or refuses to comply with or who resists the enforcement of anyoftheprovisionsofthisordinanceisguiltyofamisdemenaorandshallbefinedinanysumnotmorethanthreehundreddollars($300)for each such offense. Section 26.This ordinance shall take effect and be in force five (5)days after its passage and publication as provided by law.
