ANORDINANCEAMENDINGTITLE 18 OF THE MOSESLAKECITYCODEENTITLEDZONINGBYDELETINGCHAPTER18.66 ANDESTABLISHINGANEWCHAPTER18.66
THECITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTON,DOORDAINAS FOLLOWS:
Section 1 That chapter18.66 of the Moses Lake Zoning Code shall be deleted and anewChapter18.66 established to read as follows:
CHAPTER18.66
PLANNEDUNIT DEVELOPMENTS
18.66.010 Intent:The intent of the Planned Unit Development regulations is topermitgreaterflexibilityandconsequently,more creative and imagina-tive design for the development of residential and commercial areasthangenerallyispossibleunderconventionalzoningandsubdivisionregulations.It is further intended to promote more economical andefficientuseofthelandwhileprovidingaharmoniousvarietyofhousingchoices,commercial building layouts,a higher level of urbanamenities,and preservation of natural scenic qualities of open spacesandlandscaping.
A PUDmust comply with Zoning and Subdivision regulations.However,inordertopermitgreaterflexibilityinitsdesign,the City Council maygrantvariancesfromtheZoningandSubdivisionregulationsprovidingthePUDmeetswiththeintentoftheregulationsandcomplieswithallotherapplicablecity,state,and federal regulatory laws.
18.66.020 Permitted Uses:The following are permitted in a PUD:i A.Commercial uses designed to meet neighborhood consumer needs.These uses shall not be an extension of an existing commercial areabutshallbedesignedtomeettheprimaryshoppingneedsoftheneighborhood.Sixty percent (60%)of the proposed residentialdevelopmentshallbecompletedbeforeanycommercialdevelopmentwillbepermitted.
B.Offices and clinics
C.Residential units of any type;for example,single family,duplex,townhouse,etc.
18.66.030 General Standards:
A.All ground surfaces shall be landscaped according to approved plansandmaintainedinamannerthatwillnotcreatedustyormuddyconditions.
B.Compliance with Title 14 of the Moses Lake City Code entitledEnvironmentalRegulations.
C.Perimeters of the PUDshall maintain all required building setbacks
i as specified in the applicable zoning designation.
D.The PUDshall comply with all regulations of the zone or zones inwhichdevelopmenttakesplaceunlessvariancesaregrantedbytheCityCouncil.
18.66.040 Adjacent Land Uses and Densities:
A.Residential and commercial densities shall be dependent on thepropertydevelopmentstandards(lot sizes,setback requirements,etc.)stated in each zone in which the PUDis proposed to be devel-oped.These densities shall be applied to the gross area of thePUD.
8.The PUDshall be compatible with adjacent land uses and shall notadverselyaffectthecharacteroftheareainwhichitislocated.
18.66.050 Traffic Circulation and Parking:
A.All dedicated right-of-ways within a PUDshall be paved with curbs
and sidewalks in accordance with city Street and Utility Standards.
The location for sidewalks may be varied as deemed appropriate whenitisfoundthattheplanforthePUDprovidesfortheseparationofvehicularandpedestriancirculationpatterns.
B.Private roadways which serve a maximumof four (4)single family,
two (2)duplex,or one (1)multi-family apartment containing notmorethaneight(8)units will be permitted.Private roadways willalsobepermittedtoserveaclinicorofficecomplex.All private
roadways shall have direct access onto a dedicated street.Con-
struction standards shall be the same as for dedicated right-of-
ways unless variances are granted.
C.All private roadways and dedicated streets shall be designed andmaintainedtocarryemergencyvehicles.
D.Off-street parking spaces and loading areas shall be provided asspecifiedinChapter18.54 of this title.Parking areas shall be
designed and constructed according to APWAstandards.Parking lots
for more than twenty-five (25)vehicles shall be periodically
broken up by landscaped areas.
E.The PUDshall be located with respect to existing right-of-wayswhichareadequatelydesignedtohandlethegeneratedtrafficwithoutcreatingadditionaltrafficalongminorstreetsinresi-
dential neighborhoods outside the PUD.
18.66.060 Utilities:
A.All utilities,including electricity and telephone,shall be in-stalled underground except for access terminals.
B.PUD's shall be so located in relation to streets,sanitary sewers,water mains,storm and surface drainage systems,and other utility
systems and installations that will be of adequate size to properly
serve the PUDand conform to the comprehensive plans of the city.
C.PUD's shall be so located with respect to schools,parks,play-
grounds,and other required public facilities so as to have accessinthesamedegreeaswoulddevelopmentinaformgenerallypermit-
ted in the area.
18.66.070 Pre-Application Conference:
A.Before any proposal for a PUDis presented to the Planning Commis-
sion,the Planning Director shall schedule a meeting between allinteresteddepartmentheadsandtheapplicant.
B.The applicant shall have prepared for the meeting the general
outlines of the proposal,evidenced schematically by sketch plans.
C.The Planning Director shall furnish the applicant with a written
review of the conference regarding the relation of the PUDtogeneraldevelopmentalobjectivesandapplicablecityordinances and
policies.
18.66,080 Preliminary Development Plan:
A.An Environmental checklistmust be submitted with the application.
B.Application
1.A legal description of the total site proposed for development,including a statement of present and proposed ownershipandpresentandproposedzoning.
2.A statement of planning objectives to be achieved by the PUDthroughtheparticularapproachproposedbytheapplicant.
3.A development schedule indicating the approximate date whenconstructionofthePUDorstagesofthePUDcanbeexpected toibeginandbecompleted.
4.A statement of the applicants intention with regard to thefuturesellingorleasingofallorportionsofthePUDsuch aslandareas,dwelling units,etc.
5.Quantitative data for the following:total number and type ofdwellingunits,parcel size,proposed lot coverage of buildingsandstructures,approximate gross and net residential densi-ties,and total amount of open space.
C.A site plan and any supporting maps necessary to show the majordetailsoftheproposedPUDmustcontainthefollowingminimuminformation:
1.A general landscape plan
2.Existing land uses adjacent to proposed PUD
3.Existing site conditions including contours at two foot (2')intervals and unique natural features.
4.List of all adjacent property owners
5.Proposed lot lines and plot designs
6.The existing and proposed circulation system of arterial,collector,.and local streets including offstreet parking areas,service areas,loading areas,and major points of ingress andegresstothedevelopment.
7.The existing and proposed utility systems including sanitarysewers,storm sewers,and water,electric,gas,and telephonelines.
8.The location and floor area size of all existing and proposedbuildings,structures,and other improvements including maximumheights,t.ypes of dwelling units,density per type,and non-residential structures,including commercial facilities.
9.The location and size in acres or square feet of all areas tobeconveyed,dedicated,or reserved as commonopen spaces,public parks,recreational areas,school sites,and similarpublicandsemipublicuses.
10.The proposed pedestrian circulation system.
11.The proposed treatment of the perimeter of the PUD,includingimaterialsandtechniquesusedsuchasscreens,fences,andwalls.

18.66.090 Planning Commission Review and Approval:
A.When the information required in Sections 18.66.070 and 18.66.080isreceivedalongwithanapplicationfeeoffiftydollars($50),the Planning Director shall schedule a public hearing for consid-eration of the Environmental Checklist and PUDapplication.Alladjacentpropertyownersshallbenotifiedofthepublichearing.
B.The first item which must be considered at the public hearing is
the Environmental Checklist.Only if the PUDis found to have anon-significant impact on the environment can the preliminary
development plans be considered for approval.
C.After the public hearing the PUDpreliminary development plan shall
be forwarded to the City Council with the Planning Commission's
recommendations.
D.Within a maximumof twelve (12)months following the approval of
the preliminary development plan,the applicant shall file with thePlanningCommissionafinaldevelopmentplancontaininginafinal
detailed form the information required in Section 18.66.100 of thischapter.
18.66.100 Final Development Plan:
A.The final development plan shall contain all information requiredinthepreliminaryplans,and it shall be prepared in substantialcompliancewiththepreliminarydevelopmentplan.The final siteplanshallshowallbuildings,lot lines,detailed landscapingplan,circulation,and off-street parking and lighting plan.
B.Complete utility construction plans,prepared by a licensed engi-
neer in compliance with the city Street and Utility Standards shallbesubmittedalongwiththefinaldevelopmentsiteplan.These
construction drawings must be approved by the city engineer prior
to the final development plans being submitted to the City Council.
C.The subdivider shall post a performance bond or other secured
method in a form satisfactory to the city attorney and upon therecommendationoftheCommissionandapprovaloftheCityCouncil.
This bond shall be of such an amount to cover one hundred and fifty
percent (150%)of the cost of completing all landscaping improve-
ments as required by the City Council in approving the final PUD
plan.All such landscaping improvements listed in the bond must be
completed in conformance with the approved PUDplans within a settimeperiodofnotmorethantwo(2)years.
D.When all construction drawings,required performance bond,and
final plat drawing in compliance with Title 17 of the Moses Lake
City Code,subject to approved PUDvariances,have been approved by
the city engineer,a public hearing shall be scheduled before theCityCouncilforconsiderationofthefinaldevelopmentplans.
Only after final approval by the City Council can construction onthePUDbecommenced.
E.If,during the construction phase of the PUDdevelopment,minor
changes in the location,sitting,or character of buildings and
structures becomes necessary,they may be authorized by the Plan-
ning Commission.•All other changes in the PUD,including changes
in the site plan and in the development schedule,must be approved
by the City Council.
F.Construction on the PUDshall be commencedwithin one (1)yearfollowingfinalapproval.If substantial progress in good faith
has not been made within this time period,final approval shall be
voided and a new application required.A one (1)year extension
may be granted by the City Council.
18.66.110 Existing Residential Unit Development:
All existing developments approved under Section 18.66 of the Moses g
Lake City Code entitled Residential Unit Developments,which is hereby
repealed in its entirety by this ordinance,shall nowbe considered
Planned Unit Developments and shall be found to be in full compliance
with the Planned Unit Development requirements.
Section 2 This ordinance shall take effect and be in force five (5)days after itspassageandpublicationasprovidedbylaw.
