ANORDINANCEAMENDINGCHAPTER12.16 OF THEMOSESLAKEMUNICIPALCODEENTITLED"EXCAVATIONSANDOBSTRUCTIONS"BY CLARIFYINGTHEBONDINGREQUIREMENTSUNDERCHAPTER12.16
THE CITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTON,DOORDAINAS FOLLOWS:
Section 1.Chapter 12.16,Section 12.16.070 of the Moses Lake Municipal Codeientitled"Excavations and Obstructions"is hereby amended to read as follows:
12.16.070 Bond.If the work permitted necessitates the obstruction of any publicright-of-way or the cutting into any sidewalk,street,pavement,thoroughfare,alley,or any public place in the city,the engineer may require a bond in twicetheestimatedcostoftheworkcontainingaclauseindemnifyingandholdingthecityharmlessfromliabilityarisingoutofthepermiteesactivities,a clauseguaranteeingpaymentofallpersonsprovidinglaborandmaterialsontheactivityallowedbythepermitandaclauseguaranteeingthereplacementofthesidewalk,street,pavement,thoroughfare,alley or other public place affected thereby andprovidingthatthepermiteeshallputthesameintheconditionitwasinpriorthereto,and within the time specified by the engineer,and maintains it in con-dition for a period of one year after the completed job is accepted by the city.
Section 2.Chapter 12.16,Section 12.16.090 of the Moses Lake Municipal Codeentitled"Excavations and Obstructions"is hereby amended to read as follows:
Any person,firm,or corporation engaged in the business of laying sewers or anykindofworkwhichtendstoobstructthesidewalks,streets,highways,thorough-fares,alleys,or public places may,in lieu of the bond referred to in Section12.16.070,execute and file an annual/bi-annual bond in such amount as may be fixedbytheengineerandapprovedbytheCityAttorney,conditioned as provided inSection12.16.070,provided,that whenever in the judgment of the engineer theamountofsuchannual/bi-annual bond becomes insufficient,a new or additional bondmayberequired.The aforesaid bond initially shall be filed for a two year period,which after the first year of the two year period,shall be extended for an addi-tional,subsequent,tacked one year period.At all times,the bond provided for inthissectiongiveninlieuofthebondprovidedforinSection12.16.070,shall beineffectfornolessthanoneyearafteractivitiesperformedunderastreetobstructionpermitforwhichthebondisgiven.
Section 3.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
