HASBEENCREATEDANDESTABLISHEDFORTHE PURPOSEOF GRADING,GRAVELING,CONSTRUCTING,ANDINSTALLINGSTORMDRAINAGE,SIDE
LATERALSEWERCONNECTIONS,CURBS,SIDEWALKS,ANDASPHALTCON-
CRETEPAVEMENTIN THE BROADRIPPLEAREAON NELSONROADBETWEEN
LAKEWAYANDEASTLAKEDRIVEANDAPPROXIMATELY1,200 FEET OF

OTHERPROPERTYSHOWNON SAID ROLL
WHEREAS,the assessment roll levying the special assessments against properties
located in Local Improvement District No.42 in the City of Moses Lake,Washing-
ton,created under Ordinance No.911 has been filed with the City Clerk of theCityofMosesLakeasprovidedbylaw;and
WHEREAS,notice of the time and place of hearing thereof and of making objections
and protests to said roll was duly published at and for the time and in the
manner provided by law,fixing the time and place of hearing thereon for February26,1980 at the hour of 8:00 o'clock p.m.in the Council Chambers in the City
Hall,Moses Lake,Washington,and further notice thereof was duly mailed by theCityClerktoeachpropertyownershownonsaidroll;and
WHEREAS,at the time and place fixed and designated in said notice the hearing
was duly held and all protests made in writing were read and submitted to theCityCouncilandwerebyitoverruled,
NOW,THEREFORE,THE CITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTON,DOORDAIN
AS FOLLOWS:
Section 1.That the assessments and assessment roll of Local Improvement Dis-
I trict No.42 which has been created and established for the purpose of grading,graveling,constructing and installing storm drainage,side lateral sewer connec-tions,curbs,sidewalks,and asphalt concrete pavement in the Broadripple area onNelsonRoadbetweenLakewayandEastlakeDriveandapproximately1,200 feet ofLakewayDriveofBroadrippleAdditionNo.3 in the City of Moses Lake as provided
in Ordinance No.911 as the same now stands,be and the same as hereby in allthingsandrespectsapprovedandconfirmed.
Section 2.That each of the lots,tracts,parcels of land and other propertyshownuponthesaidrollisherebydeterminedanddeclaredtobespeciallybene-
fited by said improvements in at least the amount charged against the same andtheassessmentappearingagainstthesameisinproportiontotheseveralassess-ments appearing upon said roll.There is hereby levied and assessed against eachlot,tract,parcel of land and other property appearing upon said roll the amountfinallychargedagainstthesamethereon.
Section 3.That the assessment roll as approved and confirmed shall be filed
with the Treasurer of the City of Moses Lake for collection and that said CityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylaw
stating that said roll is in her hands for collection and that payment of anyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)days from the date of the first publication of said noticewithoutpenalt.y,interest,or cost,and that thereafter the sum remaining unpaid
may be paid in ten equal annual installments with interest thereon of eleven
percent (11%)per annum.Except,however,that if the net effective interestiratefixedonthelocalimprovementbondshereafterissuedforLID#42 is lessthan10½%per annum,the interest rate on the unpaid assessments shall be revisedtoarateof1/2 of 1%in excess of the net effective interest rate on suchbonds.The first installment of assessments on said assessment roll shall becomedueandpayableduringthe30-day period succeeding the date one year after thedateoffirstpuplicationbytheCityTreasurerofnoticethattheassessmentrollisinherhandsforcollectionandannuallythereaftereachsucceedinginstallmentshallbecomedueandpayableinlikemanner.
If the whole or any portion of the assessment remains unpaid after the first 30-day period,interest upon the whole unpaid sum shall be charged at a rate ofelevenpercent(11%)per annum except,however,that if the net effective interestratefixedonthelocalimprovementbondshereafterissuedforLID#42 is lessthan10½%per annum,the interest rate on the unpaid assessments shall be revisedtoarateof1/2 of 1%in excess of the net effective interest rate on suchbonds,and each year thereafter one of said installments,together with interestdueonthewholeoftheunpaidbalance,shall be collected.Any installment notpaidpriortotheexpirationofthesaid30-day period during which such install-ment is due and payable shall thereupon become delinquent.All delinquent in-stallments shall be subject to a charge for interest at the rate above referenced,and for an additional charge of nine percent (9%)penalty levied upon both princi-pal and interest due upon such installment or installments.The collection ofsuchdelinquentinstallmentsshallbeenforcedinthemannerprovidedbylaw.
Section 4.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
