952_00001ORDINANCENO.95j2 ANORDINANCER1ENDINGCHAPTER18.69 OF THEMOSESLAKEMUNICIPALCODEENTITLED"NON-CONFORMINGUSES"BY AMENDING18.69.050 'REMODELINGA NON-CONFORMINGUSE'ANDBYADDINGANEWSECTION18.69.060 'REBUILDINGDUPLEXESIN R-1 ZONES'. THE CITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: I Section 1.Chapter 18.69,Section 18.69.050 of the Moses Lake Municipal Codeentitled"Non-conforming Uses"is hereby amendedto read as follows: 18.69.050 Remodeling a Non-Conforming Use:Recognizing that there are non-conforming buildings or structures which are now existing which shouldbeupgradedorimprovedbyreplacement,rebuilding,or addition there-to,the City Council may,after a public hearing before the PlanningCommission,issue a permit for the replacement,rebuilding,or additiontoanexistingnon-conforming building or structure.As a condition totheissuanceofthepermit,the City Council shall require plans andspecificationsoftheproposedreplacement,rebuilding,or addition befiledandthatabondinanamounttobesetbytheCouncilbepostedtoassurecompliancewiththeplansandspecificationssofiled.NopermitshallbeissuedunlesstheCityCouncilfindsthattheproposedreplacement,rebuilding,or addition will be compatible with the lot ortractoflandinvolvedand,further,that it will not be detrimental tothehealth,safety,or welfare of the surrounding area.I The aforesaid section shall not apply to duplexes in areas currentlyzonedR-1 or areas subsequently zoned R-1 either through a rezoning oruponterritorybeingannexedintothecorporatelimitsoftheCityofMosesLakewhichareintendedtobereplaced,rebuilt,or added tototallyorpartiallybecauseofdestruction.In the case of suchreplacement,rebuilding,or addition,Section 18.69.060 shall apply. I Section 2.There is added to Chapter 18.69 of the Moses Lake Municipal Code asectionentitled"Non-Conforming Uses"as follows: 18.69.060 Rebuildinq Duplexes in R-1 Zones:In areas currently zoned R-1 orareassubsequentlyzoned4-1 either through a rezoning or upon terri-tory being annexed into the corporate limits of the City of Moses Lakeifaduplexexistsasanon-conforming use and is destroyed,it may bereplaced,rebuilt,or added to by the owner/purchaser/vendee of theduplexwithoutreferencetotheprovisionsofSection18.69.050.Inthecaseofsuchaforesaidreplacement,rebuilding,or addition,theduplexmaybereplaced,rebuilt,or added to upon obtaining a buildingpermitasisrequiredforallconstructionintheCityofMosesLakeunderMosesLakeMunicipalCode16.12.040,provided,that the replace-ment,rebuilding,or addition otherwise complies with all other currentorsubsequentlyenactedordinancesoftheCityofMosesLakeincludingbutnotlimitedtoordinancesreferencingtheUniformBuildingCode,Moses Lake Municipal Code 16.04.010 and 16.04.030 and ordinances refer-encing the R-1 Single Family Residential Zone Moses Lake Municipal code18.15.010 through 18.15.140 inclusive. If an exclusion from any of the above referenced ordinances is desired,application must be made to the City Council who may allow the soughtafterexclusioniftheCit.y Council finds that strict adherence to theordinanceswouldworkaninsiusticeagainsttheowner/purchaser/vendeeoftheduplexandfurtherwouldnotbedetrimentaltothehealth,safety,or welfare of the surrounding area. Section 3.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
