AN ORDINANCEREPEALINGCHAPTER2.66 OF THEMOSESLAKEMUNICIPALCODEENTITLEDMERCHANTPOLICEANDENACTINGCHAPTER5.44 OF THEMOSESLAKEMUNICIPALCODEENTITLEDPRIVATESECURITYBUSINESS
THECITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTON,DOORDAINAS FOLLOWS:
Section 1.Specific Repeal:Chapter 2.56 of the Moses Lake Municipal Code isIherebyrepealedinitsentirety.
Section 2.New Chapter Enacted:Chapter 5.44 of the Moses Lake Municipal Codeshallreadasfollows:
5.44.010 Preamble:The City Council of the City of Moses Lake and in accordancewithitsdutytosafeguardthesafetyofthecitizensoftheCityofMosesLake,finds and declares that it is in the best interest of thecitizensoftheCit.y of Moses Lake that the following ordinance requiringthelicensingandregulationofprivatesecuritybusinessbeenacted.
5.44.020 Definitions:When used in this chapter,the following words shall havethefollowingmeanings:
A."Private Security Officer"means any person engaged in the privatesecuritybusiness,as that term is hereinafter defined,who does notemployoruseanyemployees,assistants,clerks,or operatives,andshallincludethosepersonsemployedasprivatesecurityofficersbyprivatesecurityagencies.
B."Private Security Agency"means any firm or corporation engaged intheprivatesecuritybusiness,as that term is hereinafter defined,provided,that this term shall also apply to a sole self-employedproprietorengagedintheprivatesecuritybusinessonanindependent

ate Security Business"means the business of or the representa-tion of being engaged in the business for hire or reward and as anindependentcontractorofguardingorprotectingpersonsorproperty,or patrolling buildings,streets,districts,or territories.
D."Employee"of a private security agency means any person hired bysuchanagencyandwhoseemploymentgiveshimaccesstoprivateinformationconcerningclientsofsuchagency.
5.44.030 License -Required:It is unlawful 'for any person,firm,or corporationtoactasaprivatesecurityofficerortoengageinanybusinessasaprivatesecurityagencywithintheCityofMosesLakewithoutbeingtheholderofavalidexistinglicenseissuedundertheprovisionsofthischapter;provided,however,that a private security agency may employ aprivatesecurityofficerforagraceperiodofuptothreeweekspendingtheissuanceordenialofhislicenseandidentificationcardonthefollowingconditions:
1.That proper application for an identification card has been made tothePoliceChief.
2.That the appitcant has paid the required fee for a records check.
I 3.That a records check,performed at the time of application,indicatedthattherewasnothingonfilewithrecordssourcesthatwoulddisqualifytheapplicant.
5.44.040 License -Application -Generally:Application for any license oridentificationcardrequiredbythischaptershallbemadetothe CityClerkuponsuchformastheCityClerkshallrequire.Such applicationshallshowthereontheapplicant's name,age,date of birth,and previousresidenceandoccupationforaperiodofnotlessthanfiveyearsimmedi-ately .prior to such application,the address of his place of business,and the nameof his suployer,if any;and shall state whether or not theapplicanthaseverbeenconvictedofafelonyorforfeitedbond.Theapplicationshallbefiledandverifiedbytheapplicant.If the appli-cant is a firm or corporation,the application shall be signed by a dulyauthorizedofficerofthefirmorcorporationandshallgivethelocaladdressandplaceofbusinessofsuchfirmorcorporation.
All applications for licenses shall be forwarded to the Police Chief forinvestigationandreport.The Police Chief shall require that eachapplicantbefingerprintedandhisphotographtaken;and an investigationshallbemadeintothebackgroundoftheapplicant.
5.44.050 License Application Qualifications:No identification card or privatesecuritylicenseshallbeissuedtoanypersonunlessthePoliceChiefshallhavedeterminedthattheapplicanthasnotbeenconvictedof,orforfeitedbail,for any felony or any other crime involving moral turpi-tude that directly relates to the occupation of being a private securityofficer,and that the applicant is at least 21 years of age and holds avalidWashingtondriver's license.
If the issuance of any license hereunder is denied,the applicant shallhavetherightofhearingbeforetheCityCouncil,by filing an appealwithintendayswiththeCityAttorney,after the permit is denied.ThefindingsoftheCityCouncilonsuchappealshallbefinalandconclusive.
5.44.060 License Fee:The license fee for private security officers and privatesecurityagenciesshallbeandarefixedintheamountshowninthefollowingscheduleandshallbepaidannuallyinadvance:
Private Security Agency $35.00
All licenses shall expire on the 31st day of December of each year and noreductioninfeeforsuchlicensesshallbemadeforanypartialyear.No license shall be transferable.All licenses will be renewed throughtheCit.y Clerk with the payment of the year's fee.
5.44.070 License -Issuance Prerequisites -Bonds and Insurance:
A.No license shall be issued nor application acted upon by the PoliceChiefunderthischapterunlesstheagencyapplyingforthelicensefileswiththecityasuretybondexecutedbyasuretycompanyauthor-ized to do business in this state in the sum of an amount not lessthan$10,000per occurrence conditioned to recover against the prin-cipal,its servants,officers,agents,and employees b.y reason of itswrongfulorillegalactsoromissionsinconductingsuchbusinesslicensedundertheprovisionsofthisordinance.Said bond is to befiledwiththeCityClerkonaformapprovedbytheCityAttorneyandwithsuretyapprovedbytheCityFinanceDirector.The bond requiredbythisordinanceshallbemadepayabletotheCityofMosesLake,and anyone so injured by the principal,officers,agents,and em-ployees,shall have the right and shall be permitted to sue directly
upon this obligation in their ownname;and this obligation shall be
subject to successive suits for recovery until complete exhaustion ofthefaceamountthere;and the agency applying for the licenseestablishesthatithasineffectapublicliabilityinsurance policy
in at least the following amounts;property damage of $50,000peroccurrence,bodily injury of $100,000per person;with a combined
liability of $300,000per occurrence.Said policy shall name the
City of Moses Lake as an additional named insured party.
B.The insurance required b.y this section shall contain a clause withintheinsurancecontractwhichwillclearlystatethatten(10)daysnoticeofcancellationornon-renewal will be given to the City ofMosesLake;and any license issued pursuant to this chapter shall beautomaticallysuspendedforanyperiodduringwhichtherequirementsofthissectionarenotcompliedwith.
5.44.080 Identification Costs of Screening:Every owner,manager,administrator,private security officer,and other employee of a private security agencyshallatalltimeshaveinhispossessionanidentificationcardinformapprovedbythePoliceChief.Such card shall have thereon,in additionitosuchotherinformationasmayberequiredbythePoliceChief,thephotograph,right index print,employer,and signature of the personbeingidentifiedanddateofexpirationofthecard.
The Police Chief shall charge a one time fee of $15 to help defray thecostsofscreeninganyapplicantforáhidentificationcardandlicenseandhemayinadditiontoanyotherfeeschargetheapplicanttheactualcostofthecard.All identification cards shall expire on the 31st dayofDecemberofeachyear.
All identification cards shall remain the property of the City of MosesLake.When a holder of an identification card shall leave the employment iofasecurityagency,said holder shall immediately surrender his identi-fication card and forward it immediately to the Police Chief.Theformeremployeemaythenreapplyforanidentificationcarduponemploy-ment with another security agency licensed by the city.
5.44.090 Impersonation of an Officer:
A.It is unlawful for any person licensed under this chapter to representhimselfasapubliclawenforcementofficerortowearanyuniformwhichislikelytocauseconflictionbyreasonofsimilaritywiththoseuniformswornbyregularcity,county,or state law enforcementofficers,nor shall a private security officer or agency operate oripermittobeoperatedamotorvehiclewitha'siren,blinker light,orwithanyinsigniathereon,or likeness of insignia being used bypeaceofficersofthiscity.
B.It is unlawful for any person to represent himself as a privatesecurityofficerwhoisnotlicensedasaprivatesecurityofficer.
5.44.100 Private Security Officers Not Employees of City:Nothing in this chaptershallbeconstruedasmeaningthatanyprivatesecurityofficersareemployeesoftheCityofMosesLakeandresponsibilityforpaymentofanyandallwithholdingtaxes,social security taxes,and all other taxesshallbeassumedbythepersons,firms,or corporations employing theprivatesecurityofficers.
Private security officers are not eligible to come under the LEOFFPoliceOfficersandFireFightersRetirementSystem.
5.44.110 Powers and Authority:Every private security officer appointed under theprovisionofthischapter,shall,when on duty,have the power and author-ity conferred by law on police officers,but shall exercise such poweronlyastomattersrelatingtohisdutyunderhisspecialappointment,orintheprotectionofthepropertybelongingtoorunderthecontrolofthepersonsorcompaniesatwhoseinstanceheisappointed,and in makingarrestsforviolationoflawuponorinconnectionwithsuchproperty,and may at the option of the Police Chief be given permission to carry apistolorrevolver.
5.44.120 License Revocation:A private security officer,or private security
agency license issued by the City of Moses Lake way be revoked by resolu-tion of the Moses Lake City Council,at any time for cause deemed to besufficient;provided that before any such revocation is effective,apublichearingshallbeheldbeforetheCityCouncil,of which hearing
the licensee shall be given notice,and at which he shall be entitled tobeheard,provided,that the Police Chief may suspend the license of anyholder,thereof,who is arrested for or convicted of violating any city
or county ordinance or state or federal law,except minor traffic laws,pending a hearing on the revocation of the license before the Moses LakeCit.y Council.
5.44.130 Duties of Licensee:The licensee shall carr.y on his person at all timeswhenperformingservicesasaprivatesecurityofficer,the identificationcardissuedbythePoliceChiefidentifyinghimasaprivatesecurityofficer.
5.44.140 Penalty:Failure to comply with any provisions of this chapter is amisdemeanorandpunishablebya$500fine or 90 days in ,iail,or both.
9.44G;0Validity:A determination that any portions of this ordinance is invalidshallnotimpairthevalidityoftheremainingportions.
Section 3.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
