THE CITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTONDO ORDAINAS FOLLOWS: Section 1.Repeal and Re-establishing:Chapter 5.24 of the Moses Lake City CodeisherebyrepealedinitsentiretyandanewChapter5.24,entitled "Private Detec-I tives"is hereby established as follows: 5.24.010 Preamble:The City Council of the City of Moses Lake,Washington,inaccordancewithit's duty to safeguard the safety of the citizens of theCityofMosesLake,finds and declares that it is in the best interest ofthecitizensoftheCityofMosesLakethatthefollowingordinancerequiringthelicensingandregulationofprivatedetectives,and repeal-ing Chapter 5.24 dealing with private detectives,be enacted. 5.24.020 Definitions: A."Private Detective"means any person or corporation engaged in thedetectivebusiness,as that term is hereinafter defined,who does notemployoruseanysuployees,assistants,clerks or operatives,andshallincludethosepersonsemployedasdetectivesbyprivatedetec-tive agencies. B."Private Detective Agency"means any firm or corporation engaged inprivatedetectivebusiness,as that term is hereinafter defined;provided,that this term shall also apply to a sole self-employedproprietorengagedintheprivatedetectivebusinessonanindepen-dent basis. C."Private detective business"means the business of or representation i of being the business of making an investigation or investigations,for hire or reward,with reference to any of the following matters:detecting,discovering or revealing crime or criminals,or securingsecretinformationorevidencerelatingthereto;the habits,conduct,movements,whereabouts,associates,reputation,character or actionsofanyperson,firms,or corporations;the credibility of witnesses or other persons;the location or recovery of lost or stolen property;the causes,origin or responsibility for fires or accidents or in,iu-ries to real or personal property;the securing of evidence to beusedbeforeauthorizedinvestigatingcommittees,boards of award orarbitrationorinthetrialofcivilorcriminalcases. 5.24.030 License -Required:It is unlawful for any person,firm,or corporationtoactasaprivatedetectiveortoengageinanybusinessasaprivatedetectiveagencywithintheCityofMosesLakewithoutbeingtheholderofavalidexistinglicenseissuedundertheprovisionsofthischapter;provided,however,that a private detective agency may employ a privatedetectiveforagraceperiodofuptothreeweekspendingtheissuance ordenialofhislicenseandidentificationcardonthefollowingconditions: A.That proper application for an identification card has been made tothePoliceChief. B.That the applicant has paid the required fee for a records check. I C.That a records check,performed at the time of application,indicatedthattherewasnothingonfilewithrecordssourcesthatwoulddisqualifytheapplicant. 5.24.040 License -Application -Generally:Application for any license oridentificationcardrequiredbythischaptershallbemadetotheCityClerkuponsuchformastheCityClerkshallrequire.Such applicationshallshowthereontheapplicant's name,age,date of birth,and previousresidenceandoccupationforaperiodofnotlessthanfiveyearsimmedi- ately prior to such application,the address of his place of business,and the name of his employer,if any;and shall state whether or not theapplicanthaseverbeenconvictedofafelonyorforfeitedbond.Theapplicationshallbesignedandverifiedbytheapplicant.If the appli-cant is a firm or corporation,the application shall be signed by a dulyauthorizedofficerofthefirmorcorporationandshallgivethelocaladdressandplaceofbusinessofsuchfirmorcorporation. All applications for licenses shall be forwarded to the Police Chief forinvestigationandreport.The Police Chief shall require that eachapplicantbefingerprintedandhisphotographtaken;and an investigationshallbemadeintothebackgroundoftheapplicant. 5.24.050 License Application Qualifications:No identification card or privatedetectivelicenseshallbeissuedtoanypersonunlessthePoliceChiefshallhavedeterminedthattheapplicanthasnotbeenconvictedof,orforfeitedbail,for any felony or any other crime involving moral turpi-tude that directly relates to the occupation of being a private detect-ive,and that the applicant is at least 21 years of age.If the issuance of any license hereunder is denied,the applicant shall have the right ofhearingbeforetheCityCouncil,by filing an appeal within ten daysafterthepermitisdenied.The findings of the City Council on suchappealshallbefinalandconclusive. 5.24.060 License Fees:The license fees for private detectives and detective agencies shall be and are fixed in the amounts shown in the followingscheduleandshallbepaidannuallyinadvance: Private Detective Agency $36.00EachAdditionalPrivateDetective$25.00 All licenses shall expire on the 31st day of December of each year and noreductioninfeeforsuchlicensesshallbemadeforanypartialyear.No license shall be transferable.All licenses will be renewed throughtheCityClerkwiththepaymentoftheyear's fee. 5.24.070 License -Bond: A.No license shall be issued nor application acted upon by the Police Chief under this chapter unless the applicant files with the city asuretybondexecutedbysuchapplicantbyasuretycompanyauthorizedtodobusinessinthisstateinthesumof$5,000,or such otherfinancialsecurityasmaybeapprovedbytheCityAttorney,condi-tioned upon the careful,faithful,and honest conduct of the services to be performed by the applicant,or his or it's employees.Such bond shall be approved b.y the City Attorney as to form,execution andsufficiencyofsureties. B.The bond or approved security required in this section shall be takeninthenameofthepeopleofthecityandeverypersoninjuredbythenegligent,willful,malicious,or wrongful act of the principal,his agent,servant,or employee,in the conduct of business of privatedetective,may bring an action on the bond in his own name to recoverdamagesforsuchnegligent,willful,malicious,or wrongful act. C.Notice of cancellation.The bond or other approved financial securityrequiredbythissectionshallcontainaclausewhichwillclearlystatethattendaysnoticeofcancellationornon-renewal will be given to the City of Moses Lake. D.The Police Chief shall suspend any license when the bond or otherapprovedfinancialsecurityrequiredinthissectionshallhave lapsed or is reduced by reason of a judgment thereon,or for anyotherreasonisonlongerinfullforceandeffect. 5.24.080 License Revocation:Any private detective or private detective agencylicenseissuedhereunderwayberevokedbyresolutionoftheCityCouncil,at any time for cause deemed to be sufficient;provided that before anysuchrevocationiseffective,a public hearing shall be held before theCityCouncil,of which hearing the licensee shall be given notice,and atwhichheshallbeentitledtobeheard,provided,that the Police Chief may suspend the license of any holder thereof who has been arrested fororconvictedofviolatinganycit.y or county ordinance or state orfederallaw,except minor traffic laws,pending a hearing on the revoca-tion of the license before the City Council. I 5.24.090 Identification Costs of Screening:Every private detective shall at alltimeshaveinhispossessionanidentificationcardinformapprovedbythePoliceChiefandsuchcardshallhavethereon,in addition to suchotherinformationasmayberequiredbythePoliceChief,the licensee'sphotograph,thumbprint,and signature.Upon the revocation or suspensionofanysuchlicense,such identification card shall be surrendered to thePoliceChief.The Police Chief shall charge a one time fee of $15tohelpdefraythecostsofscreeninganyapplicantforanidentificationcardandlicense.If such card is issued,the Police Chief may,inaddition,charge the applicant the actual cost of the card.This cardwillexpireonDecember31stofeachyearandmustberenewedthrough thePoliceDepartmentbypayingtheappropriatecostofthecard. 5.24.100 Impersonation of an Officer: A.It is unlawful for any person licensed under this chapter to representhimselfasapubliclawenforcementofficerortowearanyuniformwhichislikelytocauseconfusionbyreasonofsimilaritywiththoseuniformswornb.y regular city,county,or state law enforcementofficers,nor shall a private detective operate or agency operate orpermittobeoperatedamotorvehiclewithasiren,blinker light,orwithanyinsigniathereon,or likeness of insignia being used by peace officers of this city. I B.It is unlawful for any person to represent himself as a privatedetectivewhoisnotlicensedasaprivatedetective. 5.24.110 Duties of Licensee:The licensee under this chapter shall cause a certi-ficate of such license to be displayed at all times in a conspicuousplaceinoronhisplaceofbusinessdescribedinsuchlicense.Thelicenseeshallcarryonhispersonatalltimeswhenperformingservicesasaprivatedetective,the identification card issued by the PoliceChiefidentif.ying him as a private detective. 5.24.120 Exemptions:The provisions of this chapter shall not apply to: A.Any officer or employee of any department or agency of the UnitedStatesorofanystate,county,city,or municipal corporation whileengagedintheperformanceofhisofficialduties. B.Firms or corporations commonly referred to as "creditbureaus"or"creditreporting agencies". C.Private detective whose principal place of business is not in thecity,provided that his business in the city is of a temporary natureonly,and that he shall have,before engaging in his activities inthiscity,registered with the Police Chief. Failure to comply with any provision of this chapter is a misdemeanor andipunishablebyafineof$500,90 days in jail,or both. 5.24.130 Severability:A determination that any portions of this ordinance isinvalidshallnotimpairthevalidityoftheremainingportions. 5.24.140 Private detectives and private detective agencies presently holdinglicensesissuedunderthepriorordinancewillbedeemedtobeincompli- ance with this chapter until such licenses expire.Upon reapplication,under the terms of this chapter,for identification cards and licenses,the Police Chief may,in his discretion,waive a records check for thoseindividualspreviouslysubjectedtothatprocedureunderthepriorordinance. Section 2.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
