AN ORDINANCEAMENDINGCHAPTER3.28 OF THE MOSESLAKEMUNICIPALCODEENTITLED"UTILITY OCCUPATIONALTAX"BY INCREASINGTHETAXLEVIEDANDADDINGANEWSECTIONEARMARKING3%OF THE UTILITYOCCUPATIONALTAXFORSTREETOVERLAY,REPAIR,ANDRECONSTRUCTION
THE CITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 3.28,Section 3.28.050 of the Moses Lake Municipal Code entitled"Utility Occupational Tax"is hereby amended to read as follows:
3.28.050 Occupations Subject to Tax -Amount:There are levied upon and shall becollectedfromthepersonsorfirmsonaccountofthebusinessactivitiesannuallicensefeesoroccupationtaxesintheamountstobedeterminedbytheapplicationoftheratesagainstgrossincomeasfollows:
A.Upon every person or firm engaged in or carrying on a telephonebusiness,a fee or tax equal to eight percent of the total grossincomefromsuchbusinessinthecityduringitsfiscalyearnextprecedingthetaxyearforwhichthelicenseisrequired;provided,however,that the minimumfee or tax shall not be less than onehundredtwentydollarspertaxyear.
B.Upon every person or firm engaged in or carrying on the business ofsellingorfurnishingelectriclightandpowerorelectricalenergy,a fee or tax equal to eight percent of the total gross income frowsuchbusinessinthecityduringitsfiscalyearnextprecedingthetaxyearforwhichthelicenseisrequired;provided,however,thattheminimumfeeortaxshallnotbelessthanonehundredtwentydollarspertaxyear.
C.Upon every person or firm engaged in or carrying on the business ofsellingorfurnishingwaterfordomesticorindustrialconsumption,I a fee or tax equal to eight percent of the total gross income fromsuchbusinessinthecityduringitsfiscalyearnextprecedingthetaxyearforwhichthelicenseisrequired;provided,however,thattheminimumfeeortaxshallnotbelessthanonehunredtwentydollarspertaxyear.
D.Upon every person or firm engaged in or carrying on the business ofsellingorfurnishingsewerfacilitiesand/or service for domestic
or industrial use,a fee or tax equal to eight percent of the totalgrossincomefromsuchbusinessinthecityduringitsfiscalyearnextprecedingthetaxyearforwhichthelicenseisrequired;provided,however,that the minimum fee or tax shall not be lessthanonehundredtwentydollarspertaxyear.
E.Upon every person or firm engaged in or carrying on the business ofsellingorfurnishingnaturalgasfordomesticorindustrialconsump-tion,a fee or tax equal to eight percent of the total gross incomefromsuchbusinessinthecityduringitsfiscalyearnextprecedingthetaxyearforwhichthelicenseisrequired;provided,however,that the minimum fee or tax shall not be less than one hundredtwentydollarspertaxyear.
F,Upon every person or firm engaged in or carrying on the business ofsellingorfurnishingsanitationorgarbagefacilitiesand/or servicefordomesticorindustrialuse,a fee or tax equal to eight percentiofthetotalgrossincomefromsuchbusinessinthecityduringitsfiscalyearforwhichthelicenseisrequired;provided,however,that the minimum fee or tax shall not be less than one hundredtwentydollarspertaxyear.
G.Upon every person or firm engaged in or carrying on the business offurnishingacablesubscriptionsystemfortelevisionsignaldistri-bution,a fee or tax equal to eight percent of all basic monthlyservicechargesderivedfromsuchbusinessinthecityduringitsfiscalyearprecedingthetaxyearforwhichthelicenseisrequired;provided,however,that the minimum fee or tax shall not be lessthanonehundredtwentydollarspertaxyear.It is not the intentofthissectiontoclassifythebusinessasapublicutility.
Section 2.There is added to Chapter 3.28 of the Moses Lake Municipal Code entitled"Utility Occupational Tax"the following:
3.28.055 Street Overlay,Repair,and Reconstruction Fund:Of the eight percentutilityoccupationaltaxleviedin3.28.050 of the Moses Lake MunicipalCode,three percent shall be set aside in a special fund entitled "StreetOverlay,Repair,and Reconstruction Fund"to be used solely for theoverlay,repair,and reconstruction of the streets in the City of MosesLake.
Section 3.This ordinance shall take effect and be in force on October 1,1980 orthenextbillingdatethereafterfollowingitspassageandpublicationasprovided.by law.
