989_00001ORDINANCENO.989 ANORDINANCERELATINGTO COLLECTIONOF SANITARYSERVICEREVENUESAMENDINGMOSESLAKEMUNICIPALCODESECTION8.08.130 ANDADDINGANEWSECTION8.08.135 TOTHEMOSESLAKEMUNICIPALCODE THE CITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTON,DO ORDAINAS FOLLOWS: Section 1.Section 8.08.130 is amended to read as follows: 8.08.130 Duties -Service Charges: i A.It shall be the duty of every person or company to cause theirgarbageandrefusetoberemovedanddisposedofonlybythecol-lector of refuse. B.Charges for refuse collection and disposal may be billed separatelyorinconjunctionandsimultaneouslywithstatementsissuedbythecityforwaterandsewer.However,the form of billing shall be atthecity's discretion.The billing for garbage service shall bemadeinthenameoftheowneroftherealestateserved.Thechargesoraccountsshallbepaidwithin10daysofthebillingdate;and,if not paid,shall become delinquent after the first dayofthefollowingmonth.Service may be suspended for nonpayment of isuchaccounts.Such suspension shall not relieve the person owingsuchaccountfromthedutyofcomplyingwiththeprovisionsofthischapter.Such suspension shall render the premises where suchserviceissuspended,subject to condemnation for sanitar.y reasons. C.Suspension of service and charges may be authorized by the sanita-tion technician upon written request of the owner if the premises are to be vacant for one month or more. D.Upon failure to pay the charges for garbage collection and disposal,the amount thereof shall become a lien against the real estate asprovidedinRCW35.21.180.I Section 2.There is added to the Moses Lake Municipal Code Chapter 8.08 thefollowingnewsection: 8.08.135 Utility Tax Pass Through: A.Section 3.28.050 provides in part for the collection of a utilitytaxuponeveryperson,including the city,who engages in or carriesonthebusinessofsellingorfurnishingsanitationorgarbagefacilitiesand/or service for domestic or industrial use.As aresultoftheoperationofthecitysanitarydivision,the city issubjecttotheutilitytaximposedbySections3.28.050. B.The city is authorized to collect the percentage of gross incomeportionoftheutilitytaximposedb.y Section 3.28.050 from theusersofthecity's sanitary services by including on each user'sbillingthesumthecitywouldbeliabletopayasautilitytax onthatbasis. Section 3.This ordinance shall take effect five (5)days after its passage andpublicationasprovidedbylaw.
