AN ORDINANCEAPPROVINGANDCONFIRMINGTHE ASSESSMENTSANDASSESSMENTROLLOFLOCALIMPROVEMENTDISTRICTNO.48 WHICHHASBEENCREATEDANDESTABLISHEDFORTHEPURPOSEOFGRADING,GRAVELTING,CONSTRUCTING,ANDINSTALLINGSTORMDRAINAGE,CURBS,ANDASPHALTCONCRETEPAVBAENTIN THE LAKEVIEWAREAON IRONWOODDRIVEFROMPLUMSTREETTO350'SOUTHONTHEWESTERLYPORTIONOFIRONWOODDRIVEASPROVIDEDINORDINANCENO.937 ANDLEVYINGANDASSESSINGTHEAMOUNTTHEREOFAGAINSTTHEPARCELOFLAND
I SHOWNON SAID ROLL
WHEREAS,the assessment roll levying the special assessments against propertieslocatedinLocalImprovementDistrictNo.48 in the City of Moses Lake,Washington,created under Ordinance No.937 has been filed with the Cit.y Clerk of the City ofMosesLakeasprovidedbylaw;and
WHEREAS,notice of the time and place of hearing thereof and of making objectionsandproteststosaidrollwasdulypublishedatandforthetimeandinthemannerprovidedbylaw,fixing the time and place of hearing thereon for December 9,1980atthehourof8:00 o'clock p.m.in the Council Chambers in the Police Building,Moses Lake,Washington,and further notice thereof was duly mailed by the CityClerktoeachpropertyownershownonsaidroll;and
WHEREAS,at the time and place fixed and designated in said notice the hearing wasdulyheldandallprotestsmadeinwritingwerereadandsubmittedtotheCityCouncilandwerebyitoverruled,
NOW,THEREFORE,THE CITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTON,DO ORDAINASF0LLOWS:
Section 1.That the assessments and assessment roll of Local .Improvement DistrictNo.48 which has been created and established for the purpose of grading,graveling,constructing and installing storm drainage,curbs,and asphalt concrete pavement intheLakeviewareaonIronwoodDrivefromPlumStreetto350'south on the westerlyiportionofIronwoodDriveinthecityofMosesLakeasprovidedinOrdinanceNo.937 as the same now stands,be and the same as hereby in all things and respectsapprovedandconfirmed.
Section 2.That the parcel of land shown upon the said roll is hereby determinedanddeclaredtobespeciallybenefitedbysaidimprovementsinatleasttheamountchargedagainstthesameandtheassessmentappearingagainstthesameisinpro-portion to the several assessments appearing upon said roll.There is herebyleviedandassessedagainsttheparceloflandappearinguponsaidrolltheamountfinallychargedagainstthesamethereon.
Section 3.That the assessment roll as approved and confirmed shall be filed withtheTreasureroftheCityofMosesLakeforcollectionandthatsaidcityTreasurerisherebyauthorizedanddirectedtopublishnoticeasrequiredbylawstatingthatsaidrollisinherhandsforcollectionandthatpaymentofanyassessmentthereonoranyportionofsaidassessmentcanbemadeatanytimewithinthirty(30)daysfromthedateofthefirstpublicationofsaidnoticewithoutpenalty,interest,orcost,and that thereafter the sum remaining unpaid may be paid in ten equal annualinstallmentswithinterestthereofherebyfixedattherateof13%per annum,provided however,that if the net effective interest rate fixed on the local im-provement bonds hereafter issued for Local Improvement District No.48 is otherthan124%per annum,the interest rate on the unpaid assessments shall be revisedtoarateof½of 1%in excess of the net effective interest rate on such bonds.The first installment of assessments on said assessment roll shall become due andpayableduringthe30-day period succeeding the date one year after the date ofIfirstpublicationbytheCityTreasurerofnoticethattheassessmentrollisinherhandsforcollectionandannuallythereaftereachsucceedinginstallmentshallbecomedueandpayableinlikemanner.
If the whole or any portion of the assessment remains unpaid after the first 30-day
period,interest upon the whole unpaid sum shall be charged at the rate of 13%perannum,provided however,that if the net effective interest rate fixed on the local
improvement bonds hereafter issued for Local Improvement District No.48 is other
than 124%per annum,the interest rate on the unpaid assessments shall be revised
to a rate of ½of 1%in excess of the net effective interest rate on such bonds;
and each year thereafter one of said installments,together with interest due onthewholeoftheunpaidbalance,shall be collected.Any installment not paidpriortotheexpirationofthesaid30-day period during which such installment is
due and payable shall thereupon become delinquent.All delinguent installments
shall be subject to a charge for interest at the rate above referenced,and for anadditionalchargeofninepercent(9%)penalty levied upon both principal andinterestdueuponsuchinstallmentorinstallments.The collection of such delin-
quent installments shall be enforced in the manner provided b.y law.
Section 4.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
