1014_00001ORDINANCENO.1014 ANORDINANCERELATINGTOCHAPTER8.08 OF THEMOSESLAKEMUNICIPALCODEENTITLED"GARBAGECOLLECTION"BYAMENDINGCERTAINSECTIONSANDADDINGNEWPROVISIONSTOCERTAINSECTIONSOFCHAPTER8.08 THE CITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTON00 ORDAINAS FOLLOWS: Section 1.Chapter 8.08 of the Moses Lake Municipal Code entitled "Garbage Collec-tion"is hereby amended to read as follows:I 8.08.030 Definitions:The following words and phrases shall apply in thischapter: 1."Agricultural Waste"means all solid waste generated by the growing,washing,or preparation for marketing of agricultural products,without cooking,blanching,or other processing. 2."Ashes"means solid waste products of coal,wood,or other fuelsusedforheatingandcooking,from all public and private estab-lishments and from all residences. 3."Combustible Rubbish"or "Burnable Material"means,in general,theorganiccomponentofrefuse,paper,rages,cartons,boxes,wood,excelsior,furniture,bedding,rubber,plastics,leather,treebranches,lawn trimmings,and the like. 4."Commercial Refuse"means all solid wastes which originate in busi- nesses,office buildings,stores,markets,theaters,and otherbuildings.The point at which any of the refuse becomes solidwasteandistheresponsibilityofthecitygarbagecontractorshallbedeterminedbythesanitationtechnicianofthecity. 5."Compactor Collection Truck"means an enclosed vehicle providedwithspecialmechanicaldevicesforloadingtherefuseintotheimaincompartmentofthebody,for compressing the loaded materials,and for distributing the refuse within the body. 6."Construction and Demolition Wastes"means building materials andrubbleresultingfromconstruction,remodeling,repair and demoli-tion operations on houses,commercial buildings,pavements,andotherstructures. 7."Containers"means small receptacles (one-to ten-cubic-yard capac-ity)that can be emptied by compactor collection trucks on site. 8."Disposal Site"means the location where any treatment,utilizationprocessingordepositionofsolidwasteoccurs. 9."Drop Box Site"means a loading site where small loads of solidwastearedumpedintoalargecontainerfortransporttoaprocess-ing and/or disposal site. 10."Functional Standards"means the criteria for solid waste handlingexpressedintermsofexpectedperformance. 11."Garbage"means all putrescible material including all putrescibleanimalandvegetablewastesresultingfromthehandling,prepara-tion,cooking and consumption of food;swill and carcasses of deadIanimals,except sewage,sewage sludge and human body wastes. 12."Groundwater"means water in the ground that is in the zone ofsaturation. 13."Hazardous Wastes"means dangerous wastes requiring special handlingincluding,but is not limited to,explosives,pathological wastes,radioactive materials and chemicals. Ord.1014/Page 2 14,"Industrial Solid Waste"means all solid wastes which result fromindustrialprocessesandmanufacturingoperationssuchasfactories,processing plants,repair and cleaning establishments,refineries and rendering plants. 15."Institutional Solid Waste"means solid waste generated by hospi-tals,nursing homes,schools,prisons,reformatories,or otherbuildingshousinganorganizationhavingsocial,educational,orreligiouspurpose. 16."Jurisdictional Health Department"means city,county,city-county, or district health department. 17."Landfill"means the solid waste disposal process using land forthefinaldisposalsite. 18."Noncombustible Rubbish"means material that is unburnable atordinaryincineratortemperatures(one thousand three hundred totwothousanddegreesFahrenheit).For the most part,it is theinorganiccomponentofrefuse,such as tin cans,heavy metal,mineral matter,glass,crockery,dust,metal furniture,ashes andthelike. 19."Offal"means intestine and discarded parts from the slaughter of animals. 20."On-site Disposal"includes all means of disposal or,more usually,volume reduction,of refuse on premises before collection.Examples are garbage grinding,burning or incineration,burial,compaction or slurrying at homes and commercial establishments. 21."Open Burning"means the burning of solid wastes in an open area orburningofsolidwastesinatypeofchamberorvesselwhichisnotapprovedinregulations. 22."Open Dumping"means the depositing of solid wastes into a body orstreamofwater,or onto the surface of the ground without compact-ing the wastes and covering with suitable material to a suitabledepththatwouldpreventvectornuisanceandpollutionproblems. 23."Pathogen"means any infective agent capable of producing disease; it may be a virus,rickettsia,bacteria,protozoan,etc. 24."Person"means an individual,firm,association,copartnership,political subdivision,government agency,municipality,industry, public or private corporation,or any other entit.y whatsoever. 25."Pollution"means the presence in the environment or portion of theenvironmentofcontaminatingsubstances,materials,forms of animals or plant life in sufficient quantities and of such characteristics and duration,as is or is likely to be,injurious to humans,tootherplantoranimallife,or property,or which unreasonably interferes with enjoyment of life and property. 26."Processing of Waste"means the operation of solid waste which con-verts a waste into something useful,leaving the term "handling"todescribewhatisdonetoprepareitfordisposal. 27."Pull-on Container"means a detachable container system in which alargecontainer(aroundtwenty to fifty cubic yards)is pulled onto service vehicle mechanically and carried to disposal site for anptying. 28."Putrescible"means capable of being decomposed by micro-organisms with sufficient rapidity as to cause nuisances from odors,gases,etc.Kitchen wastes,offal,and dead animals are examples of putrescible components of solid waste. Ord.1014/Page 3 29.For a definition of refuse,see "solidwaste"as defined in subsec-tion 37 of this section. 30.For a definition of refuse fill,see "landfill"as defined insubsection17ofsection. 31."Rendering"means a process of salvaging fats and oils,animal feedandotherproductsfromanimalwastebycooking.Dead animals,fish and wastes from slaughter houses and butcher shops are commonlyused.I 32."Rubbish"means all discarded nonputrescible solid waste exceptashes,including paper,cardboard,tin cans,wood,glass,bedding,yard clippings,etc. 33."Salvage"means reclaimable solid waste such as paper,metal,bottles,or other objects saved for the purpose of sale or other use not prohibited by law,rule,or regulation. 34."Sanitary Landfill"means a method of disposing of refuse on landwithoutcreatingnuisancesorhazardstopublichealthorsafety,by utilizing the principles of engineering to confine the refuse tothesmallestpracticalarea,to reduce it to the smallest practicalvolume,and to cover it with a layer of earth at the conclusion ofeachday's operation or at such more frequent intervals as may be necessary. 35."Sanitation Technician"means the city official or employee of thecit,y delegated and authorized to administer this chapter. 36."Scavenging"means the uncontrolled picking of materials. 37."Solid Waste"means all putrescible and nonputrescible solid andsemisolidwastes,including garbage,rubbish,ashes,industrialwastes,demolition and construction wastes,abandoned vehicles orpartsthereof,discarded home and industrial appliances,manure,vegetable or animal solid and semisolid wastes and other discardedmaterial.The point at which any of the above becomes solid wasteandistheresponsibilityofthecitygarbagecontractorshallbedeterminedbythesanitationtechnicianofthecity. 38."Solid Waste Disposal"means final disposition of solid waste byacceptablemeans. 39."Solid Waste Handling"means the storage,collection,transporta-tion,treatment,utilization,processing,and final disposal ofsolidwastes. 40."Special Wastes"means wastes difficult or unusual in the character-istics of quantities or composition to handle. 41."Street Refuse"means material picked up by manual and mechanicalsweepingofstreetsandsidewalks,litter from public litterreceptacles,and dirt removed from catch basins. 42."Surface Water"means a body of water whose top surface is exposedtotheatmosphereincludingaflowingbodyaswellasapondorlake. I 43."Swill"means the semiliquid animal or vegetable waste of kitchens,market or stores. ¯44."Transfer Station"means a loading site where solid waste is trans-ferred from one vehicle to another for transfer to a final disposalsite. 45.For a definition of "trash",see "rubbish",as defined in subsec-tion 32 of this section. Ord.1014/Page 4 46."Unsanitary Condition"means any situation which negatively effectsthehealthandgeneralwelfareofhumansorisofsuchacharacter so as to be likely to be injurious to humans,plant or animal life, or property,or which unreasonably interferes with the enjo.yment oflifeorproperty. 47."Vector"(of disease)means a living insect or other arthropod,oranimal(not human),which transmits infectious diseases from onepersonoranimaltoanother. 48."Waste"means useless,unused,unwanted,or discarded materials.Waste includes solids,liquids,and gases.The gases are princi-pally industrial fumes and smoke;the liquids consist mainly of sewage and the fluid part of industrial wastes,the solids areclassedasrefuseorsolidwastes. 8.08.040 City Sanitary Division:For the purpose of carrying into effect theprovisionsandaimsofthischapter,there is created and established adivisiontobeknownasthecitysanitarydivision. The City Manager is empowered and authorized and may appoint a suitableandqualifiedpersonassanitationtechnicianandthispersonshallhavefullchargeandcontrolofalltheworkprovidedforandcontem-plated under this chapter and as may be provided for by rules andregulationssubsequentlyadopted.He shall also have charge of allcollectionsandtheenforcementofallchargesforservicesrendered.In the absence of the appointment of a sanitation technician,the CityManagermaydesignateanindividualemployedbythecityoracity department to perform the functions of a sanitary technician. 8.08.060 Container Regulations: A.It shall be the duty of every person in possession,charge or incontrolofanydwelling,flat,roominghouse,apartment house,oreatingplace,or in possession,charge,or control of any dwelling,flat,roominghouse,apartment house,or eating place,or in posses-sion,charge or control of any shop,place of business,or manufac-turing establishment at all times,to keep or cause to be kept,portable containers of approved size,t.ype,and construction,and to deposit or cause to be deposited the refuse therein. B.Such containers shall be constructed in such a manner as to be strong,watertight,not easily corrodible,rodent-proof,insect- proof,and of not less than fifteen-gallon and not more than thirty-gallon capacit.y,shall have two handles at the sides thereof andtiGht-fitting lids.Such lids shall not be removed except when necessary to place garbage and refuse in such containers or takethesametherefrom.When garbage and refuse is placed therein ortakenthereform,such lids shall be replaced by the person placing the same therein or taking the same therefrom.Refuse or garbagecontainersshallnotbefilledwithdishwaterorotherliquidorsemiliquidkitchenwastes,which are properly disposable down sanitary drains.Such containers shall be kept in a sanitaryconditionwiththeoutsidethereofcleanandfreefromaccumulative grease and decomposing material. C.Every container,on the day designated for collection,shall be kept in a place accessible to the collector of garbage and refuse. Where alley access is available,all containers shall be placed at the alle.y line.Where no alle.y access is available,all containers shall be placed at the curb line on the day designated for collec- tion and on all other days shall be removed from street view. D.Each garbage container shall be kept clean inside and out so that no odor nuisance shall exist.The area around the containers shall be kept in a neat and sanitary condition.The sanitation technician shall place tags on garbage containers found to be in violation of this subsection and notify the property owner when the areas around the container are not being kept in a neat and sanitary condition. Ord.1014/Page 5 All tags and notifications shall be dated and signed by the sanita-tion technician.Two or more violations of this provision of thissectionshallsubjectthepersonresponsibletothepenaltiesdescribedinChapter1.08 of this code. E.Those containers found to be defective or illegal (defectivebottomscrushedsothatlidswillnotfit,fift.y-five gallonbarrels,waste baskets,paper drums)or any other containers thatarefoundtobeillegalshallbesubjecttoimpoundinganddisposal.If a container received two violations within a thirty-day period,the sanitation technician of the city will impound it.I The container shall be stored by the city not to exceed ten days.If after ten days the owner has not claimed and agreed to repairillegalcontainer,it will be disposed of by the city.The impound-ment of an illegal container shall not relieve the owner fromcompliancewithregulationsinthischapter. F.No garbage or refuse container shall contain earth,rocks,or heavyrefuse.Any container requiring a man to lift it shall not exceedseventy-five pounds in total weight of container and refuse.Customers must restrain vicious dogs beyond reach of the garbagecontainersandpreventanyinterferencewiththepickupmanonthisaccount. G.Large,suitable containers for collection of refuse may,with theapprovalofthesanitationtechnician,be used in the business andcommercialzones. H.Compactors for industrial and commercial users shall have a doublestagepumpcapableofdevelopingapressureofatleast1600psi.The pressure on the ram face shall be a minimum of 40 psi.Com-pression ratio shall be a minimum of 3:1.The sanitary technicianshallapproveallcompactorsusedforcommercialorindustrial uses.These compactors shall be designed to be compatible with i local sanitation transportation equipment. I.All containers,compactors,and dumpsters shall comply to theConsumerProductsSafetyCommissionlawsandregulations. J.It shall be the duty of every person in possession,charge orcontrolofanydeadanimaloruponwhosepremisesthesamemay belocated,to forthwith cause the same to be removed and disposed ofbythecollectorofrefuse. 8.08.130 Duties -Service Charges: A.It shall be the duty of every person or companyto cause theirgarbageandrefusetoberemovedanddisposedofonlybythecol-Tector of refuse. B.Charges for refuse collection and disposal may be billed separatelyorinconjunctionandsimultaneouslywithstatementsissuedbythecityforwaterandsewer.However,the form of billing shall be atthecity's discretion.If charges for refuse collection and dispo-sal are billed in conjunction and simultaneously with statementsissuedbythecityforwaterandsewercharges,all paymentsreceivedfromacustomershallbecreditedfirsttopastduegarbagecharges,then the remainder,if there be any,first to pastiduesewerchargesthentopastduewatercharges.Payments oncurrentaccountsshallbecreditedfirsttogarbagechargesthentheremainder,if there be any,to sewer charges then to watercharges. C.The billing for garbage service shall be made in the name of theowneroftherealestateservedbutcanbesenttoanaddressotherthanthatoftheowneroftherealestate.If the owner of therealestatewishesthebillsenttoanotheraddress,the owner of Ord.1014/Page 6therealestate first must execute a form provided for by the Cit.yofMosesLakeindicatinghisdesires.The form shall contain,at aminimum,the owner of the real estate's name and address,theaddresstowhichhewishesthebillsent,and a statement that ifthepersonattheaddresstowhichthebillissentmovesandleavesanunpaidbalance,the owner of the real estate recognizeshisresponsibilityforthebill. D.The charges or accounts shall be paid at the city hall 30 daysafterthedateofbilling,and if not paid,shall become delinquent on the 31st day after the date of billing.Service may be suspendedfornonpaymentofsuchaccounts.Such suspension shall not relievethepersonowingsuchaccountfromthedutyofcomplyingwiththeprovisionsofthischapter.Such suspension shall render thepremiseswheresuchserviceissuspended,subject to condemnationforsanitaryreasons. E.Suspension of service and charges may be authorized by the sani-tation technician upon written request of the owner if the premises are to be vacant for one month or more. F.Upon failure to pay the charges for garbage collection and dispo-sal,the amount thereof shall become a lien against the real estateasprovidedforbylaw. 8.08.150 Administration: A.If a home occupation is carried on in a residential zone as allowedbythePlanningCommissionundertheMosesLakeMunicipalCode,theresidentshallpayonlyforresidentialserviceunlessanunsanitaryconditiondevelopsorunlessmoregarbageand/or refuse is set forcollectionthanisallowedforinaresidentialservice.In theeventadisputearisesoverwhetherahomeoccupationshouldberequiredtopayresidentialorcommericalrates,the sanitationtechnicianshallmakethedeterminationastowhatserviceis beingusedorshouldbeusedandthereforewhatserviceistobecharged. B.If a commercial building with a single entrance,exclusive of fireexists,has multiple tenants,the owner of the real estate shallhavetheoptionofpayingforserviceforallthetenantsorthe 3wner of the real estate upon notifing the city of Moses Lake on aformprovidedbythecitycanrequirethetenantstopayforindividualservices.The form shall provide that in the event thetenantfailstopayfortheservicerendered,the owner of the real estate shall assume responsibility for the debt and agree to paythesame.The form shall also provide that if the service isconvertedfromasingleservicetomultipleservicesorvice versatheaccountoraccountsmustbepaidinfullbeforethechangeismade. C.If two or more types of service are available to a garbage account,both which adequately and satisfactorily serve the account,the owner of the real estate or the party receiving the service,de- pending upon the circumstances,shall have the option of selecting the service he wishes to receive so long as no unsanitary condition is created as a result of the service selection of the owner of therealestateorthepartyreceivingtheservice.If a dispute arises between the owner of the real estate or the party receiving the service and the collector of refuse concerning the type ofcollectionserviceanaccountshouldbereceiving,the sanitation technician shall make the determination as to what type of service is to be charged. D.A service fee for commercial accounts shall be agreed upon by the owner of the real estate served or the party receiving the service, depending upon the circumstances.If a dispute arises between the owner of the real estate or the part.y receiving the service and the Ord.1014/Page 7collector of refuse concerning the type of collection service anaccountshouldbereceiving,the sanitation technician shall makethedeterminationastowhattypeofserviceistobecharged. E.The cit.y shall have the power,from time to time,by resolution orafterCouncilconsiderationbymotiondulymadeandpassed,to setforthanddetermineadditionalrulesandregulationsandothermattersasmaybenecessaryinthediscretionoftheCityCouncilfortheproperexecutionofthischapter. Section 2.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
