ANORDINANCERELATINGTO CHAPTER13.04 OF THE MOSESLAKEMUNICIPALCODEENTITLED"SEWERREGULATIONS"BY AMENDINGCERTAINSECTIONSANDADDINGNEWPROVISIONSTOCERTAINSECTIONSOFCHAPTER13.04
THECITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 13.04 is amended to read as follows:
I 13.04.170 Application for Permit -Fee:
A.There shall be two classes for building sewer permits:one forresidentialandcommercialservice,and one for service to estab-lishments producing industrial wastes.In either case,the ownerorhisagentshallmakeapplicationonaspecialformfurnishedbythecity.The permit application shall be supplemented by anyplans,specifications,or other information considered pertinent inthejudgmentofthesewersuperintendent.A permit and inspectionfeeoffifteendollarsforaresidentialorcommercialbuildingsewerpermitandtheactualcostofdoingthepermitinvestigationandinspectionbutinnoeventlessthanforty-five dollars for anindustrialbuildingsewerpermitshallbepaidtotheCityTreasureratthetimetheapplicationisfiledortotheCit.y Clerk if theCit.y Treasurer so designates.The Public Works Director shallestimatethecostofanindustrialpermitinvestigationandinspec-tion which shall be paid upon the application for the permit butthepermitshallnotbeissueduntilthefullamountoftheinvesti-gation and inspection has been paid.
B.The applicant for the building sewer permit shall notify the SewerSuperintendentofthecitywhenthebuildingsewerisreadyforin-spection and connection to the public sewer.The connection shallbemadeunderthesupervisionoftheSewerSuperintendentorhisrepresentative.
13.04.190 Separate Sewer for Each Building:
A.A separate and independent building sewer shall be provided foreverybuilding;except where one building stands at the rear ofanotheronaninteriorlotandnoprivatesewerisavailableor canbeconstructedtotherearbuildingthroughanadjoiningalley,court,yard,or driveway,the building sewer from the front build-ing may be extended to the rear building and the whole consideredasonebuildingsewer.
B.Building sewers which are connected to the city's system shall bedesignedandconstructedinaccordancewiththeWashingtonStateAmericanPublicWorksStandardSpecificationsasadoptedbythecity,the city plumbing code,and the Washington State DepartmentofHealthandtheWashingtonStatePollutionControlCommissionStandards.
C.For no properly located "Y"branches available,a connection may bemadebycuttingthesewerandforminga"Y"branch in the upper onehalfofthesewer,with entry in the down stream direction of 45°.
I 13.04.320 Penalty for continuedViolation:Any person who continues any viola-tion beyond the time limit provided for in Section 13.04.310 shall bepunishableasdefinedinChapter1.08 of the Moses Lake Municipal Code.Each day in which any such violation shall continue is deemed a separateoffense.

13.04.330 Liability for Expense or Damage:Should damages occur to fire hydrants
through their use for fire protection or other authorized uses,all
costs for repairs shall become the obligation of the user.Damageresultingfromanaccidentorfromunauthorizedorimproperuseof
water and/or sewer facilities shall become an obligation against the
agency or person causing such damage.
Additionally,any person violating any of the provisions of this chaptershallbecomeliabletothecityforanyexpense,loss,or damage occa-sioned the city by reason of such violation.
Section 2.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
