ANORDINANCEADOPTINGCHAPTER8.22 OF THEMOSESLAKEMUNICIPALCODEENTITLED"NOXIOUSWEEDCONTROL"
THE CITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 8.22 entitled "Noxious Weed Control"shall read as follows:
8.22.010 Noxious Weeds:The weeds listed by Grant County Weed District No.2pursuanttoRCW17.04 are declared to be noxious weeds and as noxiousIweedsarefoundtobeinjurioustocrops,livestock,and other property.A listing of weeds declared to be noxious weeds is available from theCityClerk's office at all times.
8.22.020 Duty to Control:It shall be the duty of each owner of property in theCityofMosesLaketocontrolandpreventthespreadofnoxiousweedslistedbyGrantCountyWeedDistrictNo.2 from his property."Ownerofproperty"shall be defined as the person in actual control of prop-erty,or his agent,whether such control is based on legal or equitabletitleoranyotherinterestentitlingtheholdertopossession.Theword"control"and the term "preventthe spread of noxious weeds"shallmeanconformingtothestandardsofnoxiousweedcontrolorpreventionbyadoptionofruleorregulationbyGrantCountyWeedDistrictNo.2.
8.22.030 Violation Declared a Nuisance:Additionally,a public nuisance isdeclaredtoexistwherethereareanynoxiousweedsgrowinguponanylot,place,or area within the Cit.y of Moses Lake.Allowing a publicnuisanceisaviolationoftheMosesLakeMunicipalCodeandpunishableasprovidedforin1.08.010.
8.22.040 Enforcement Officer:The Fire Chief or his designee of the city ofMosesLakeisherebydesignatedastheenforcementofficerofthisordinance.
I 8.22.050 Entry Onto Property:The enforcement officer or his designee may enteruponanypropertyforthepurposeofinspectingthepropertyandtakingspecimensofweedsorothermaterial.A reasonable attempt shall firstbemadetonotifytheownersofthepropertyastothepurposeandneedforentry,but where such notification is impossible,such entry shallbemadewithouttheconsentoftheowner.
8.22.060 Notice to Destroy:Whenever the Fire Chief or his designee finds thatnoxiousweedsarepresentonanyparceloflandandthattheownerhasnottakensufficientactiontocontrolthesame,he shall notify theownerthataviolationofthisordinanceexists.Such notice shall beinwriting,identify the noxious weed or weeds found to be present,order prompt control and specify the time,at least 10 days from theissuanceofthenotice,within which the prescribed action must betaken.Such notice shall be b.y certified mail,addressed to said ownerortheagentofsaidowner,at his last known address.
8.22.070 Action UponNon-Compliance -Costs:Upon the failure,neglect,refusalofanyownersonotifiedtoabateanuisancebycontrollingnoxiousweedsgrowinguponanylot,place,or area within the City of MosesLake,within 15 days after receipt of the written notice provided forinSection8.22.060 above,or within 15 days after the date of suchnotice,in the event the same is returned to the City of Moses Lake bythePostOfficebecauseoftheinabilitytomakedeliverythereof,provided the same was properly addressed to the -Tast known address ofIsuchowneroragent,the Fire Chief or his designee is hereby authorizedandempoweredtoabatethenuisanceandactonbehalfoftheCityofMosesLakeinauthorizingpaymentforthecontrollingofsuchnoxiousweedsortoordertheremovalbytheCityofMosesLake's own personnel.
8.22.080 Recovery in Civil Action:When the City of Moses Lake has affected thecontrolofsuchnoxiousweedsorhaspaidfortheircontrol,the actualcostofcontrol,plus damages and other charges incurred by the city ofMosesLakeshallbechargedtotheownerofsuchproperty.The costs,damages,and other charges incurred by the city shall be recovered by
civil action brought by the city against the property owner(s)respon-sible.
8.22.090 Provision Supplemental:This ordinance is intended to supplement theweedcontrolprovisionscontainedintheUniformFireCodeandMosesLakeMunicipalCodeChapter8.22.This ordinance is not intended andshallnotimpairtheadministrationoftheUniformFireCodeasitrelatestoweedcontrol.
Section 2.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
