ANORDINANCEPROVIDINGFORTHE CONDEMNATION,APPROPRIATION,TAKINGANDDAMAGINGOF LANDANDOTHERPROPERTYNECESSARYINTHEBUILDINGOFYONEZAWABOULEVARDANDASECONDLARECROSSINGOVERPARKERHORN
THE CITY COUNCILOF THE CITY OF MOSESL4KE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Public convenience requires that it is necessary in order to buildiYonezawaBoulevardandasecondlakecrossingoverParkerHorntoacquireright-of-way for the express purpose of building Yonezawa Boulevard and a second lakecrossingoverParkerHorn.
Section 2.In order to acquire right-of-way for the building of Yonezawa BoulevardandasecondlakecrossingoverParkerHorn,it is necessary to condemna tract oflandsituatedinGrantCounty,Washington,more particularly described as follows:
Aportion of Lot 2,Monty Holmes Plat in Section 22,Township 19 North,Range 28 EWM,more particularly described as follows:
Beginning at the south corner of Lot 2,Monty Holmes Plat,which is theTruePointofBeginning;thence north 38°30'00"west 113.00 feet moreorlesstothesoutheasterlyright-of-way line of the Chicago,Milwou-kee,St.Paul and Pacific Railway;thence on a curve to the northeastandconcavetotheeastandachorddistanceof116.54 feet,a chordbearingnorth19°30'40"east a chord distance of 116.54 feet to thenorthcornerofLot2,Monty Holmes Plat;thence south 64°51 '00"east113.00 feet more or less;thence south 25°09'00"west 165.54 feet totheTruePointofBeginningcontainingapproximately.34 acres.
Said land is ownedby Donald F.Liggett and Elizabeth J.Liggett,husband and wife,according to the tax roles of the Treasurer and Assessor of Grant County,Washing-ton,and that the property cannot be acquired for a reasonable sumwithout condem-I nation proceedings.The City Council of the City of Moses Lake desires to condemnthesaidtractoflandfortheexpresspurposeofbuildingYonezawaBoulevardandasecondlakecrossingoverParkerHorn.
Section 3.Canpensation for the above described property to be paid to the ownersthereofshallbepaidoutoftheGeneralFundoftheCityofMosesLakeandthatnospecialassessmentsshallbemadeuponthepropertybenefitedbytheacquisitionofsaidright-of-way.
Section 4.The City Attorngt for the City of Moses Lake,Washington be and isherebyauthorizedtoproceedwithacondemnationproceedingintheSuperiorCourtofGrantCount.y,Washington and do all things necessary to condemnsaid property inthemannerprovidedbythestatutesoftheStateofWashington.
