1040_00001ORDINAÑCENO.1040 ANORDINANCEAMENDINGSECTION18.27.120 OF CHAPTER18.27OFTHEMOSESLAKEMUNICIPALCODEENTITLEDC-1,GENERALCOMMERCIALZONE;CHAPTER18.30 OF THEMOSESLAKEMUNICIPALCODEENTITLEDC-2,LIMITEDCOMMERCIALZONE;ANDSECTION18.33.180 OF CHAPTER18.33 OF THEMOSESLAKEMUNICIPALCODEENTITLEDC-3,NEIGHBORHOODCOMMERCIALZONE THECITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTON00 ORDAINAS FOLLOWS:I Section 1.Section 18.27.120 of Chapter 18.27 of the Moses Lake Municipal Code isherebyamendedtoreadasfollows: 18.27.120 Storage and Display:Merchandise,equipment,supplies,and othermaterialsbeingstoredshallbekeptwhollywithinabuildingor sightobscuringfenceorscreening.Screening or fencing shall be constructedandmaintainedtoaheightofatleastsixfeet(6').Materials re-quired to be stored within a sight obscuring fence shall not be stackedorpiledhigherthantheenclosingscreen.Storage of nursery stock,operative automobiles,boats,and other similar items for rent orresalemaybeallowedinanopensaleslotornexttotheplaceofbusiness. A.Open outdoor displays of merchandise are permitted on privatepropertywhentheyarelocatedsuchthattheydonotinterfere withparking,traffic,or pedestrian movement and are changed at leasteverysixty(60)days.Displays such as Christmas trees,beddingplants,peat moss,or presto logs arranged in an orderly manner arepermitted. B.There shall he no combustible storage above ground exceeding onethousandcubicfeet(1,000')by volume outside of an enclosedbuildingorcoveredstructure.Combustible materials shall be keptatleastfivefeet(5')from adjacent property lines.Where asolidmasonaryorconcretefenceorwallisprovidedatapropertylinetoaheightthreefeet(3')higher than the combustible stor-age,the storage shall be permitted not to exceed twenty-fivehundredcubicfeet(2,500')by volume adjacent to the fence orwall. C.This section shall apply only to those items stored or displayed inone(1)location for a continuous time period exceeding twenty-four(24)hours in duration. Section 2.Chapter 18.30 of Title 18 of the Moses Lake Municipal Code is herebyamendedtoreadasfollows: CHAPTER18.30 C-2,LIMITEDCOMMERCIALZONE 18.30.010 Intent:The Limited Commercial District is designed to serve thosecommercialandbusinessuseswhich,because of large space require-ments,truck traffic generated,or similar characteristics,should notbelocatedinthecentralbusinessdistrictofthecity.All attemptsmustbemadetoavoidtheundesirableaspectsof"stripdevelopment"and "strip zoning"along arterials through special developmental stan-dards,and careful placement of the district. 18.30.020 Permitted Uses:The following are permitted in a C-2 Zone: A.All uses permitted in the C-1 Zone B.Auto repair C.Auto sales ORD.1040:Pg.2 D.Farm machinery and equipment sales E.Lumber yards and other building materials F.Mobile Home Parks G.Open sales lots for boats and trailers H.Residential uses (other than apartments)when residence is a joint occupancy with a permitted use and used only by the owner or em-playee of the business. I.Service stations -gas pumps shall be set back twenty-five feet(25')from the property line. J.Sit-down restaurants K.Trucking terminals L.Warehouses M.Other uses ruled by the Planning Commission to be similar to thespecifiedpermittedusesandnototherwiseprohibited. 18.30.030 Conditional Uses:The following are conditional uses in a C-2 Zone: A.Any development over two (2)acres permitted in Section 18.30.020 B.Storage of fuel oil,propane,and/or white gas in above ground containers 18.30.040 Prohibited Uses:The following are prohibited in a C-2 Zone: A.Industrial Uses B.Junkyards C.Public nuisances 18.30.050 Setbacks: A.The front yard setback shall be fifteen feet (15')minimum B.For the side yard there is none (15feet on corner lot where lot is bordered on two (2)sides by street rights-of-way) C.For the rear yard there is no setback. 18.30.060 Building Heights: 18.30.070 Landscaping:At least one (1)square foot per total lot front footage shall be landscaped and maintained.For a corner lot,the front foot- age shall be based on the street address frontage only.This landscap- ing shall be located in the lot area between the street address front- age and the public right-of-way. 18.30.080 Area:Lots in the C-2 Zone shall have a minimum square footage of TweÏvethousand square feet (12,000).All Tots platted prior to the effective date of the ordinance codified in this title shall not have to comply with this minimum square footage. 18.30.090 Access:Efforts shall be made to minimize the number of curb cuts along arterials through proper spacing and joint use of driveways.The - city traffic engineer may impose special standards on curb cuts in areas where curb cuts could cause traffic or safety problems. 18.30.100 Drainage:The requirements are the same as in the C-1 Zone. 18.30.110 Fencing:The requirements are the same as in the C-1 Zone. 3RD.1040:Pg.3 18.30.120 Parking and Loading:Parking and loading areas shall be provided asshowninChapter18.54 of this title. 18.30.130 Signs and Billboards:Signs and billboards shall conform with Chapter18.57 of this title. 18.30.140 Shoreline Areas:All property developed within two hundred feet (200')of the high water line of Moses Lake shall conform with the city'sshorelinemanagementplan. 18.30.150 Storage and Display:Merchandise,equipment,supplies,and otherimaterialsbeingstoredshallbekeptwhollywithinabuildingor sightobscuringfenceorscreening.Screening or fencing shall be constructedandmaintainedtoaheightofatleastsixfeet(6').Materials storedwithinasightobscuringfenceshallnotbestackedorpiledhigherthantheenclosingscreen.
