AN ORDINANCEPROVIDINGFORTHECONDEMNATION,APPROPRIATION,TAKINGANDDAMAGINGOF LANDANDOTHERPROPERTYNECESSARYINTHEBUILDINGOFYONEZAWABOULEVARDANDASECONDLAKECROSS-ING OVERPARKERHORNANDREPEALINGORDINANCE1036
THE CITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Public convenience requires that it is necessary,in order to buildYonezawaBoulevardandasecondlakecrossingoverParkerHorn,to acquire right-i of-way for the express purpose of building Yonezawa Boulevard and a second lakecrossingoverParkerHorn.
Section 2.In order to acquire right-of-way for the building of Yonezawa BoulevardandasecondlakecrossingoverParkerHorn,it is necessary to condemn a tract oflandsituatedinGrantCounty,Washington,more particularly described as follows:
A portion of Lot 2,Monty Holmes Plat in Section 22,Township 19 North,Range 28 EWM,more particularly described as follows;
Beginning at the south corner of Lot 2,Monty Holmes Plat,which is theTruePointofBeginning;thence north 38°50'00"west 113.00 feet moreorlesstothesoutheasterlyright-of-way line of the Chicago,Milwau-kee,St.Paul and Pacific Railway;thence on a curve to the northeastandconcavetotheeastwhoseradiusis1,585.28 feet,a chord bearingnorth19°30'40"east and a chord distance of 116.54 feet to the northcornerofLot2,Monty Holmes Plat;thence south 64°51 '00"east 113.00feetmoreorless;thence south 25°0'00"west 165.54 feet to the TruePointofBeginningcontainingapproximately.34 acres.
Said land is owned by Donald F.Liggett and Elizabeth J.Liggett,husband and wife,according to the tax roles of the Treasurer and Assessor of Grant County,Washing-ton,and that the property cannot be acquired for a reasonable sum without condem-nation proceedings.The City Council of the City of Moses Lake desires to condemnithesaidtractoflandfortheexpresspurposeofbuildingYonezawaBoulevardandasecondlakecrossingoverParkerHorn.
¯Section 3.Compensation for the above described propert,y to be paid to the ownersthereofshallbepaidoutoftheGeneralFundoftheCityofMosesLakeandthatnospecialassessmentsshallbemadeuponthepropertybenefitedbytheacquisitionofsaidright-of-way.
Section 4.The City Attorney for the City of Moses Lake,Washington be and isherebyauthorizedtoproceedwithacondemnationproceedingintheSuperiorCourtofGrantCounty,Washington and do all things necessar.y to condemnsaid property inthemannerprovidedbythestatutesoftheStateofWashington.
Section 5.Ordinance 1036 is hereby repealed with the effective date of thisordinance.
Section 6.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
