ANORDINANCEREPEALINGCHAPTER8.21 OF THEMOSESLAKEMUNICIPALCODEENTITLED"WEEDCONTROLREGULATIONS"ANDENACTINGANEWCHAPTER8.20 OF THEMOSESLAKEMUNICIPALCODEENTITLED"WEEDCONTROL"
THECITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 8.21 of the Moses Lake Municipal Code entitled "Weed Control
I kegulations"is hereby repealed in its entiret.y.
Section 2.Chapter 8.20 of the Moses Lake Municipal Code entitled "Weed Control"shall read as follows:
8.20.010 Duty to Maintain Property:It shall be the duty of every owner oroccupantortheagentofsuchowneroroccupantofanyproperty,lot,place,or area within the corporate limits of the City of Moses Lake toremoveordestroyalltrees,plants,shrubs,or vegetation,or partsthereof,which overhang or obstruct any part of any sidewalk or streetorwhicharegrowingthereon,in such a manner as to obstruct or impairthefreeandfulluseofthesidewalkorstreetbythepublic.Further-more,it shall be the duty of every owner or occupant or the agent ofsuchowneroroccupanttoremoveordestroyallgrass,weeds,shrubs,bushes,trees,or vegetation growing or which has grown and died and toremoveordestroyalldebris,upon such property owned or occupied bythemandwhichareafirehazardoramenacetopublichealth,safety,or welfare,either present or potential.
8.20.020 Notice to Comply:The Building Official is authorized and empowered tomakeinspectionsofallproperty,lots,places,or areas,either vacantoroccupied,within the corporate limits of the city to determinewhethertheobligationsimposedbythisChapterarebeingfulfilled.In the event a property,lot,place,or area is .discovered which is notincompliancewiththisChapter,the Building Official shall prepare aiwrittennoticetotheowneroroccupantoragentoftheowneroroccu-pant of such propert.y,lot,place,or area,which notice shall describetheproperty,lot,place,or area involved and the hazardous condition,and shall require the owner or occupant or agent of such owner oroccupanttocomplywiththisChapterwithin10daysafterreceivingsuchnotice.If the property,lot,place,or area is unoccupied,suchnoticeshallbedeliveredtotherecordownerofsuchproperty,lot,place,or area by certified mail at the last known address as shown bytherecordsintheofficeoftheTreasurerofGrantCounty.If theproperty,lot,place,or area is occupied with a dwelling,structure,or building which is not vacant,such notice shall be delivered person-ally to the owner or occupant or agent of the owner or occupant of thedwelling,structure,or building.
8.20.030 Action Upon Non-Compliance -Costs:In the event that any property,lot,place,or area is not brought into compliance with this Chapter bytheowneroroccupantortheagentoftheowneroroccupantwithin10daysafterreceivingthenoticepreparedbytheBuildingOfficial,theCityofMosesLake,under the direction of the Building Official,shalldowhatisnecessarytobringanyproperty,lot,place,or area intocompliance.The proceedings for bringing any property,lot,place,oraresintocomplianceshallbeinitiatedbyresolutionoftheCityCouncilwhichshalldescribetheproperty,lot,place,or area involvedandshallauthorizetheBuildingOfficialtodowhatisnecessarytoibringanyproperty,lot,place,or area into compliance.The workwhichmustbepreformedinordertobringanyproperty,lot,place,orareaintocompliancemaybedonebytheagentsandemployeesoftheCityofMosesLake,or by independent contractors,as the BuildingOfficialmaydeemappropriate.Careful account of the cost of suchworkshallbekeptandreportedtotheFinanceDirectorwhentheworkiscompleted.The cost to the city of such work shall be and become achargeagainsttheownerofsuchproperty,lot,place,or area and alienagainsttheproperty,lot,place,or area.
8.20.040 Lien:Notice of such lien shall as nearly as practical be in substan-tially the same form,filed with the same officer within the same timeandmanner,and in force and foreclose as is provided by law for liensforlaborandmaterials.
8.20.050 Penalty:Any person who violates any of the provisions of this Chap-ter,additionally,shall be punishable as defined in Chapter 1.08 oftheMosesLakeMunicipalCode.
8.20.060 Provision Supplemental:This Chapter is intended to supplement theweedcontrolprovisionscontainedintheUniformFireCodeasadminis-tered by the Fire Department.This Chapter is not intended and shallnotimpairtheadministrationoftheUniformFireCodeasitrelates toweedcontrol.The Fire Department shall continue to administer theUniformFireCodeasitpertainstoweedsandfirehazards.
Section 4.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
