1063_00001ORDINANCENO.1063 AN ORDINANCEREPEALINGCHAPTER17.08 OF TITLE 17 OF THEMOSESLAKEMUNICIPALCODEANDESTABLISHINGANEWCHAPTER17.09 OF TITLE 17 OF THEMOSESLAKEMUNICIPALCODE THE CITY COUNCILOF THE CITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS: Section 1.Chapter 17.08 of Title 17 of the Moses Lake Municipal Code is hereby I repealed in its entirety. Section 2.Chapter 17.09 of Title 17 of the Moses Lake Municipal Code is herebyestablishedasfollows: 17.09.010 As used in this title,the following words or phrases shall have thefollowingmeaning. 17.09.020 Binding Site Improvement Plan:Binding Site Improvement Plan means adrawingtothescalespecifiedhereinwhichidentifiesandshowsthe areas and locations of all streets,roads,improvements,utilities, open spaces,and any other matters specified herein;contains inscrip-tions or attachments setting forth such appropriate limitations andconditionsfortheuseofthelandasareestablishedpursuanttothischapter;and contains provisions making any development be in con-formity with the site plan. 17.09.030 Block:Block means a group of lots,tracts or parcels within welldefinedandfixedboundaries. 17.09.040 Certificate of Segregation:Certificate of Segregation means a writtencertificate,on a form provided by the Planning Division of the Commun-it.y Development Department,that a legally described portion of land islocatedwithinandproperlyrelatedtoanapprovedBindingSiteIm-provement Plan and which must accompany any building permit application i for construction on said legally described portion of land. 17.09.050 Comprehensive Plan:Comprehensive Plan means the plans,maps,texts,and reports which comprise the official development plan as adopted bytheCouncilinaccordancewithRCW35.63. 17.09.060 Construction Plans:Construction plans means the maps or drawings andspecificationsaccompanyingaplatshowingthespecificlocationanddesignofimprovementstobeinstalledorconstructedinthesubdivi-sion. 17.09.070 County Auditor:County Auditor is the Grant County Auditor. 17.09.080 County Treasurer:County Treasurer is the Grant County Treasurer. 17.09.090 Dedication:Dedication means the deliberate appropriation of land byanownerforanygeneralandpublicuses,reserving to himself no otherrightsthansuchasarecompatiblewiththefullexerciseandenjoymentofthepublicusestowhichthepropertyhasbeendevoted.The inten-tion to dedicate shall be evidenced by the owner by the presentment forfilingofafinalplatorshortplatshowingthededicationthereon;and the acceptance by the public shall be evidenced by the approval ofsuchplatforfilingbytheappropriategovernmentalunit. I 17.09.100 Division of Land:Division of land means the division of any parcel oflandintotwo(2)or more parcels. 17.09.110 Easement:Easement means a grant of one (1)or more of the propertyrightsbythepropertyownertoand/or for the use by the public,thecity,a corporation,or another person or entity. 17.09.120 Final Plat:Final plat means the final drawing of the subdivision anddedicationpreparedforfilingforrecordwiththecountyauditorandcontainingallelementsandrequirementssetforthinthistitle. ord.1063/Pg.2 -5/25/82 17.09.130 Improvements:Improvements mean any street and utility (sewerandwater)required in granting short plat,major plat,or binding siteimprovementplanapprovalinconformancewithCommunityStreetandUtilityStandardsandcityDesignStandards. 17.09.140 Land Surveyor:Land surveyor means an individual registered in accord- ance with the provisions of RCW18.43 and licensed to perform land surveys. 17.09.150 Lease:Lease means a contract or agreement whereby one party grants toanotherpartygeneralorlimitedrights,title or interest in real property.This definition is intended to apply to those agreementswhichareordinarilyconsidered"groundleases"and shall not apply tothosewhichareordinarilyconsidered"spaceleases." 17.09.160 Lot:Lot means a fractional part of divided lands having fixed bound-iries,being of sufficient area and dimension to meet minimum 2oning requirements for width and area.The term shall include tracts orparcels. 17.09.170 Maintenance Bond:Maintenance bond means any security or surety approvedbytheCityAttorneythatmaybeacceptedbytheCouncilasaguaranteethatimprovementsrequiredasapartofanyapplicationfordevelopmentwillfunctionasrequiredforaone(1)year period of time followingacceptancebytheCouncil. 17.09.180 Major Subdivision:Major subdivision means the division or redivisionoflandintoten(10)or more lots,tracts,parcels,sites,or divi- sions and/or the division or redivision of land into lots,tracts,parcels,sites,or divisions exceeding four acres in total land areaforthepurposeofsale,lease,or transfer of ownership. 17.09.190 Performance Bond:Performance bond means any security or surety approvedbytheCit.y Attorne.y that may be accepted by the Council as a guaranteeathre s sfa nr yrcom dtedaswt nrta peancf edplicear donfor deevelopment 17.09.200 Planning Commission:Planning Commission means the body created pursu-ant to Chapter 2.48. 17.09.210 Plat:Plat means a mapor representation of a subdivision showingTEireonthedivisionofatractorparceloflandintolots,blocks, streets,and alleys,or other divisions and dedications. 17.09.220 Plat Administrator:Plat Administrator means the Community Development Department Director,or the Community Development Department Director's designee charged with administering land development regulations. 17.09.230 Preliminary Plat:Preliminary plat means a neat and approximate draw- ing of a proposed subdivision showing the general layout of streets andalleys,lots,blocks,and other elements of a subdivision consistent with the requirements of this chapter.The preliminary plat shall be the basis for the approval or disapproval of the general layout of asubdivision. 17.09.240 Principal Building:Principal building shall mean the principal struc-ture on a lot or building site designed or used to accommodatetheprimaryusetowhichthepremisesaredevoted. 17.09.250 Right-of-Way:Right-of-way means a permanent dedication to public useofastripoflandtobeusedforpublicroads,bikeways,sidewalks, mass transit,utilities,or similar related public uses. 17.09.260 Segregation:Segregation means the division of land into two (2)or ore leasehold agreements. 17.09.270 Short Plat:Short plat means a map or representation of a short subdi- vision. ord.1063/Pg.3 -5/25/82 17.09.280 Short Subdivision:Short subdivision means the division or redivisionoflandintonine(9)or fewer lots,tracts,parcels,sites,or divi-sions for the purpose of sale,lease,or transfer of ownership notexceedingfour(4)acres in total area. 17.09.290 Subdivider:Subdivider means a person,firm,or corporation thatundertakestocreateamajorsubdivision,a short subdivision,or abindingsiteimprovementplan.When improvements are involved and theCommunityStreetandUtilityStandardsarereferredto,the subdividershallbeconsideredtobethesameasthecontractor.I 17.09.300 Subdivision Bond:Subdivision bond shall mean any security or suretyapprovedbytheCityAttorneythatmaybeacceptedbythecouncilas aguaranteethatimprovementsrequiredasaconditionofpreliminaryand/or final plat approval are satisfactorily completed. 17.09.310 Tract:Tract means a parcel of land prepared for subdivision or subdi-viding. Section 3.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasrequiredbylaw.
