AN ORDINANCEREPEALINGCHAPTER17.12 OF THEMOSESLAKEMUNICIPALCODEENTITLED"SUBDIVISIONS"IN ITS ENTIRETYANDESTABLISHINGANEWCHAPTER17.13 OF THEMOSESLAKEMUNICIPALCODEENTITLED"SHORTSUBDIVISIONS"
THECITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTONDOORDAINAS FOLLOWS:
Section 1.Chapter 17.12 of Title 17 of the Moses Lake Municipal Code is herebyIrepealedinitsentirety.
Section 2.Chapter 17.13 of Title 17 of the Moses Lake Municipal Code is herebyestablishedtoreadasfollows:
17.13.010 Purpose:The procedures regulating short subdivisions are establishedtoprovidefortheorderlyandefficientdivisionoflandonasmallscale;to promote the public health,safety,and general welfare,andtosubstantiallycomplywiththeprovisionsofRCWChapter58.17.
17.13.020 Scope:The division or redivision of land into nine (9)or fewer lots,tracts,parcels,sites,or divisions for the purpose of sale or lease
or transfer of ownership not exceeding four (4)acres in total area andwhichhasnotbeendividedintoashortsubdivisionwithinaperiodoffive(5)years is subject to this chapter.
17.13.030 Preliminary Plat Conditions and Requirements:
A.General Conditions and Requirements:
1.The subdivision shall make adequate provision for roads,streets,curbs,gutters,sidewalks,street lighting circuits,alleys,extension of municipal utilities (sewerand water),drainage
ways,irrigation water rights-of-way,other public ways or anyImunicipalimprovementsasdeemednecessaryinconformancewithcityCommunityStreetandUtilityStandardsandcitydesignstandardsineffectatthetimeofplatapproval.
2.The subdivision shall front on an existing street.There shallbeadequateaccesstoallparcels.Streets shall be improvedtocitystandards.
3.The subdivision shall comply with all zoning and health regu-lations.
4.The subdivision shall be consistent with the city's Compre-hensive Plan.
5.The subdivision shall provide for irrigation water rights-of-way pursuant to RCW58.17.310 as now enacted or hereafteramended.
6.The subdivision shall not have been previously divided in ashortsubdivisionwithinthelastfive(5)years and will notbefurtherdividedinanymannerunlesssuchproposedresub-division complies with all provisions relating to major subdi-visions in effect at the time the further subdivision is com-menced.
I 7.Unless an applicant for a preliminary plat approval requestsotherwise,and the Plat Administrator agrees,a preliminaryplatshallbeprocessedsimultaneouslywiththeapplication forrezones,variances,planned unit developments,site plan ap-provals,and similar quasi-judicial or administrative actionstotheextentthatproceduralrequirementsapplicabletothoseactionspermitsimultaneousprocessing.
8.Every decision or recommendation made under this Chapter by theCouncilorPlanningCommissionshallbeinwritingandshallincludefindingsoffactandconclusionstosupportthedeci-sion or recommendation.

9.Preliminary plats of any proposed short subdivision shall beapproved,disapproved,or returned to the applicant for modi-fication within ten (10)calendar days of filing of the shortplatandapplicationwiththePlatAdministrator.
10.In the event that the short subdivision does not border uponadjacentpropertytowhichmunicipalutilitieshavebeenex-tended or upon adjacent property fronting upon improved streets,the property owner may request a variance to the short subdi-vision provisions for municipal improvements as deemed neces-
sar.y.In lieu of the completion of the extension of municipalutilities(sewerand water)and the completion of street im-
provements,a covenant to the land title may be created.Said
covenant shall pledge the property owner to install municipal
improvements as deemed necessary at such time as the adjacentpropertyisimprovedbytheinstallationofmunicipalutilitiesand/or at such time as the improvement of streets upon whichtheadjacentpropertyisfrontingoccursasanysucheventisdeemedtooccurinthesolediscretionofthePlatAdministra-
tor.Said covenant shall also pledge the property owner toparticipateinanyfuturelocalimprovementdistrictsforsuchimprovements.
11.At the discretion of the Plat Administrator,the requirementthatapreliminaryshortplatbesubmittedmaybewaived.Subject to the approval of the Plat Administrator,a short plat
without improvements may be submitted as a final plat forreviewandapproval.
B.Specific Conditions and Requirements:
1.Prior to submission of a short subdivision preliminary applica-tion and preliminary plat,the subdivider or the subdivider'srepresentativeshallscheduleapre-application conference withthePlatAdministratorandrepresentativesofotheraffectedcitydepartments.The subdivider shall present a conceptualideaoftheplat.The Plat Administrator and representatives
of affected city departments will respond informally and ad-dress potential items of concern to aid the subdivider inpreparingtheshortsubdivisionpreliminaryapplicationand
preliminary plat.
2.The preliminary short subdivision application and plat shall be
filed with the Plat Administrator on forms prescribed by thePlanningDivisionoftheCommunityDevelopmentDepartment.The
application shall be accompanied by eleven (11)copies of thepreliminar.y plat.At the discretion of the Plat Administrator,
the requirement that eleven (11)copies of the preliminary platbesubmittedmaybewaived.Processing of the preliminary plat
may require fewer than eleven (11)copies of the plat.
3.The preliminary plat shall be a neat and accurate drawing,
stamped and signed by a registered professional land surveyorlicensedbytheStateofWashingtononreproduciblematerial at
a decimal scale.The plat map shall measure eighteen inches(18")by twenty-four inches (24").The preliminary plat shallbedrawnontwo(2)or more sheets if the scale necessary toaccommodatethemaponone(1)sheet would unduly congest thedrawing.
4.A non-refundable fee of $50shall accompanyeach and everyapplicationforapreliminaryshortsubdivisionwithoutim-
provements.A non-refundable fee of $70shall accompany each
and every application for a preliminary short subdivision with
improvements.
5.The preliminary plat shall contain the following:
a.Name of proposed subdivision
b.Boundaries of proposed subdivision established by the
preliminary survey.

c.Location and dimension of all existing and proposed streets,alleys,and utility and rights-of-way and/or easements onandadjacenttotheproposedsubdivision.
d.Location and dimensions of all existing and proposed irri-gation water rights-of-way on and adjacent to the proposedsubdivision.
e.Legal description of land within the proposed subdivision.
I f.Any proposed land dedications.
g.Name,address,and seal of the registered land surveyor whomadethepreliminarysurvey.
h.The date of the preliminary survey.
i.Horizontal scale of the proposed plat shall be one hundredfeet(100')to the inch.
j.Monuments found and established during the preliminarysurvey.
k.Date map is prepared,scale,and north point of the map.Approximate proposed lot lines with their dimensions,including lot numbers and block numbers.
1.If any of the parcels can be further divided or if only aportionofatractisbeingdivided,location of futurestreets,alleys,and lot lines shall be shown by dottedlines.
m.A vicinity map at a scale of not more than four hundredfeet(400')to the inch.The vicinity map shall show alladjacentparcels.It shall show how the streets andIalleysintheproposedsubdivisionmayconnectwithexist-ing and proposed streets and alleys in neighboring sub-divisions or unplatted property to produce an advantageousdevelopmentoftheentireneighborhood.
n.Provide recommended street names for approval.
o.United States Bureau of Reclamation horizontal and verticaldataincludingbenchmarks.
p.A site plan on a separate sheet showing the followinginformation:
1)Location and sizing of existing and proposed utilitiesincludingwater,sewer,storm drains,electricityandgas,telephone,and cablevision lines.Minimumsizeandscaleshallbethesameasthepreliminaryplatmap.
2)Existing and proposed structures and natural featuresandallproposedimprovementswithinandadjoiningthetheproposedsubdivision.
3)Topography of the area with a maximum of two foot (2')i intervals of contours as required by the City Engineer.
4)Present zoning classification on and adjacent toproperty.
5)Any proposed dedications for park land subject totheapprovalofthePlanningCommission.
6)Name(s)of owner(s)of the proposed subdivision.
q.Any deed restrictions or covenants existing or proposed
shall be drawn on the site plan and preliminary plat map.
T7 40 Referral to Other Departments,Agencies,and Offices:
A.Upon receipt of a complete and satisfactory preliminary plat appli-cation,the Plat Administrator shall distribute copies of thepreliminaryplattoeachofthefollowingoffices,departments,oragencieswithintwo(2)working days from receipt:
1.Public Utility District
2.Gas Company
3.Te1phone Company
4.Public Works Department (three copies)
5.Fire Department
6.Building and Planning Divisions of the Community DevelopmentDepartment
7.Grant County Health District
8.Moses Lake Irrigation and Rehabilitation District
B.The Plat Administrator shall further notify the Police Department,Park and Recreation Department,and City Manager that a preliminaryplathasbeenreceived.
C.Notice of the filing of a preliminary plat of a proposed subdivi-
sion located in the city and adjoining the municipal boundariesthereofshallbegiventotheGrantCountyPlanningDepartment.
D.Notice of the filing of a preliminary plat of a proposed subdivi-sion located adjacent to the right-of-way of a state highway shallbegiventotheStateDepartmentofHighways.
E.Each office,department,or agency shall file written recommenda-
tions with the Plat Administrator within eight (8)calendar daysfromthedateoffilingofthepreliminaryplatandapplicationwiththePlatAdministrator.
F.If the preliminary plat is found to be unacceptable,a certifiedlettershallbemailedtothesubdividerwithinten(10)calendar
days of receipt of the application.
G.The Plat Administrator maydetermine that a meeting shall be held
to resolve major issues identified as a result of the recommenda-tions of other offices,departments,or agencies.Such meetingshallbeattendedbythoseoffices,departments,or agencies re-sponsible for the recommendations and must include the applicantandthePlatAdministrator.The proceedings and results of the
meeting shall be documented by minutes.
17.13.050 Variances:
A.The subdivider may make application to the Plat Administrator onformsprescribedbytheplanningdivisionoftheCommunityDevelop-
ment Department for a variance of any provision contained in thistitle.Provided that the request is received prior to preliminary
short plat approval by the Plat Administrator.
B.The Plat Administrator shall forward the variance application tothePlanningCommission.The Planning Commission shall review the
variance request at its next regular meeting and shall recommend
that the Council approve,conditionally approve,or disapprove the
variance application.

C.A variance may be granted in conformance with all of the following
conditions and réquirementsi
1.There are special physical circumstances or conditions affect-ing said real property such that strict application of theprovisionsofthistitlewouldcauseanunusualandunnecessaryhardshiponthesubdivider.
2.The granting of the variance will not be detrimental to thepublicwelfareorinjurioustootherpropertyinthevicinity.
I 3.In granting variances,the Planning Commission may require suchconditionsaswillsecure,in so far as practicable,the objec-tives of the requirement varied.Any variance authorized shallbeenteredintheminutesofthePlanningCommissiontogetherwiththecircumstancesthatjustifythevariancegranted.
D.Upon receipt of a Planning Commission recommendation the Council atitsnextregularmeetingshallconsiderandadoptorrejectthePlanningCommission's recommendation with respect to the varianceapplication.
E.A preliminary short plat accompanied by an application for a vari-
ance shall not be approved by the Plat Administrator until suchtimeastheCouncilapproves,conditionally approves,or disap-
proves the application for a variance.Application for a variancetotheprovisionsofthistitleshallconstituteapprovalinwrit-ing by the applicant for a sixty (60)day extension of the shortsubdivisionpreliminaryplatapprovalperiodassetoutinSection17.13.030 (A 9)of this chapter.
F.If the short plat has not been completed and has not been recordedandfiledwiththeGrantCountyAuditorwithintwelve(12)monthsofthedateofpreliminaryshortplatapproval,the variance shallbecomenullandvoid.If an extension of the preliminary shortiplatisgranted,said variance shall run concurrently with theshortplatextension.
17.13.060 Dedications:In the event that the short plat includes a dedication ofstreets,rights-of-way,parks,playgrounds,easements,reservations,irrigation water rights-of-way,or any area to be dedicated to publicuse,the Plat Administrator shall forward the instrument of dedicationtogetherwithanyrestrictionsorlimitationsthereontotheCouncilforapproval.The Council shall approve the instrument of dedicationpriortoanyshortplatapprovalbythePlatAdministrator.Submissionofaninstrumentofdedicationshallconstituteapprovalinwritingbytheapplicantforasixty(60)day extension of the short subdivisionpreliminaryplatapprovalperiodassetoutinSection17.13.030 (A 9)of this chapter.All dedications shall be recorded as part of theplat.
17.13.070 Preliminary Short Subdivision Application Review Procedures:
A.The Plat Administrator shall within ten (10)days of receipt of theshortplatapplication,respond to the applicant in one of thefollowingmanners:
1.Preliminary approval is granted as submitted.
I 2.Preliminary approval is granted with modifications requested.
3.The proposed subdivision is denied and reasons stated.
4.Preliminary approval is withheld until Planning Commissionand/or City Council approval of dedications or variance re-quests.
B.The short subdivision preliminary application shall require ap-proval of the Plat Administrator and the Cit.y Engineer indicated bytheirdatedsignaturesthereontobevalid.
C.The decision of the Plat Administrator shall be final,unless anappealbyanyaggrievedpartyismadetothePlanningCommissionwithinten(10)calendar days of the date of decision of the PlatAdministrator.Said appeal shall be in writing to the PlanningCommissionandsubmittedthroughthecommunityDevelopmentDepart-ment.The Community Development Department shall record and datethereceiptofthatappeal.The Planning Commission shall act onthatappealwithinforty(40)days unless an extension is agreed toinwritingbytheapplicant.The decision of the Planning Commis-sion shall be final and conclusive unless,within ten (10)days,
any aggrieved party files with the city Clerk a written appeal.The Council shall hear that appeal within twenty (20)calendar daysofthedateofappeal.
D.Approval of the preliminary plat shall constitute approval for theapplicant/subdivider to develop construction plans and specifica-tions for all facilities and improvements and to prepare the finalplat.
17.13.080 Expiration of Preliminary Plat:
A.Approval of any preliminary short plat shall expire and become null
and void one (1)year after the date of preliminary plat approval.
B.The Plat Administrator may grant one (1)extension of the prelim-inar.y plat approval for a period not to exceed one (1)year pro-vided that the request for an extension is filed at least thirty(30)days before the expiration of the one (1)year period from thedateoftheplat's preliminary approval.
17.13.090 Appeals:Any decision approving or disapproving any preliminary shortplatshallbereviewableforunlawful,arbitrary,capricious or corruptactionornon-action by writ of review before the Superior Court ofGrantCount.y.Said application for a writ of review shall be made tothecourtwithinthirty(30)days from any decision to be reviewed.The cost of transcription of all records ordered certified by the courtforsuchreviewshallbebornebythepartyseekingreviewintheSuperiorCourtandnotranscriptsorrecordsshallbepreparedorprovidedpriortoreceiptofpaymentforthem.
17.13.100 Improvements:
A.Following approval of the preliminary plat by the Plat Administra-
tor,the applicant shall file with the Plat Administrator three (3)complete sets of preliminary construction plans and specificationspreparedbyaprofessionalengineerlicensedbytheStateofWash-ington showing all street and utility improvements as required by
the Plat Administrator in granting approval of the preliminary
plat.The construction plans and specifications shall be accom-panied by a minimum plan check fee of $150.All construction plans
and specifications shall be in conformance with city Design Stand-
ards and the Community Street and Utility Standards.Sheet sizeshallbe24"x 36"and shall have a border of one inch (1")on theleftmarginandonehalfinch(½")on the remaining three margins.The scale shall be five feet (5')or ten feet (10')vertically and
forty feet (40')or fifty feet (50')horizontally.
B.The preliminary construction plans and specifications shall beforwardedtotheCityEngineerwithintwo(2)working days of
receipt by the Plat Administrator.Within twenty (20)calendardaysoffilingoftheplanswiththePlatAdministratortheCity
Engineer shall approve,conditionally approve,or disapprove theplans.The subdivider shall submit one (1)set of reproducable
nylar and three (3)sets of specifications which have been approved
for the City Engineer's signature,records,and use.

C.After the City Engineer has approved the construction plans andspecifications,the subdivider shall complete and install allstreetandutilityimprovementsrequiredbythePlatAdministratoringrantingpreliminaryplatapprovalpriortofilingofthefinalplat.A one (1)year maintenance bond shall be required in theamountof100%of the construction cost.
D.The Engineering Division of the City of Moses Lake's Public WorksDepartmentoralicensedprofessionalengineerorengineeringfirmhiredbythecityshallberesponsiblefortheinspectionofallsubdivisionimprovementstoinsureconformancewiththeapprovedIplansandspecifications.The subdivider shall deposit an inspec-tion fee in the amount of two and a half percent (2½%)of theestimatedconstructioncost.The inspection fee shall be based ontheactualcostoflabor,materials,and equipment plus fifteenpercent(15%)for overhead.If the final cost is less than theamountdeposited,the difference will be refunded.
E.In lieu of completing and installing all required street and util-ity improvements prior to filing of the final plat with the PlatAdministrator,the subdivider may post a subdivision bond or otherapprovedsecurityinaformsatisfactorytotheCityAttorney.Thesubdivisionbondorapprovedsecurit,y shall be in an amount equaltoonehundredfiftypercent(150%)of the estimated cost asdeterminedbythePublicWorksDirector,of such improvementsrequiredbythePlatAdministratoringrantingapprovalofthepreliminaryplat.In the event that all street and utility im-provements are not completed within the time limit specified in thesubdivisionbondorapprovedsecurity,the bond or security may beforfeitedandthecitymayundertaketheinstallationandcomple-tion of all required street and utility improvements.
1.All street and utility improvements listed in the subdivisionbondmustbeinstalled,completed,and accepted by the citywithinone(1)year of approval of the final plat by the Plat
i Administrator.
2.The Plat Administrator may grant one (1)extension of thesubdivisionbondforaperiodnottoexceedone(1)year pro-vided that said request for an extension is filed with the PlatAdministratoratleastsixty(60)calendar days prior to theexpirationdateofthebond.
3.In the event that a time extension is granted,a new subdivi-sion bond or other approved security shall be submitted in anamountsufficienttocoveronehundredandfiftypercent(150%)of the cost of completing utility extensions and streetimprovements.The bond will be updated with new estimates ofcostonalluncompletedimprovementsandallincreasedcostestimatesshallbepassedontothebond.If these increasedcostsarenotacceptedbythesurety,then the city shallforecloseonthebondandtheplatwillbeheldinabeyance.Departments issuing recommendations for new subdivision bondsorotherapprovedsecurityshallnotmodifythetermsandrequirementsofthebondorsecurityotherthantopassonallincreasedcostestimatesasdeterminedbythePublicWorksDirectortothebondorsecuritytocoverthecostofcomplet-ing utility extensions and street improvements without the

written consent of the applicant.
17.13.110 Final Short Subdivision Plat Application:
A.General Requirements:
1.The final short subdivision application and plat will be filedwiththePlatAdministratoronformsprovidedbythePlanningDivisionoftheCommunityDevelopmentDepartment.
2.All required street and utility improvements must be construc-ted by the applicant and must be accepted by the City of MosesLakeorasubdivisionbondorotherapprovedsecurityshallbesubmittedinanamountsufficienttocoveronehundredandfiftypercent(150%)of the estimated cost of completing all
required utility extensions and street improvements as deter-mined by the Public Works Department.Upon completion of therequiredimprovementsandpriortoacceptancebythecity,thesubdividershallsubmitamaintenancebondintheamountof100%of the cost of construction.Said bond shall be in effectforoneyearfromthedateofacceptance.
3.The instrument of dedication of all streets,rights-of-way,
parks,playgrounds,easements,reservations,irrigation waterrights-of-way,and any area to be dedicated to public use,together with any restrictions or limitations thereon shall besubmittedasapartofthefinalplat.
4.The application shall be accompanied by the following:
a.A title report from a title companylicensed to do businessinthestatedatedwithinthirty(30)days of the date offilingofthefinalplatandapplicationwiththePlatAdministratorconfirmingthatthetitleofthelandsasdescribedandshownontheplatisinthenameofthe
owners signing the subdivision plat or instrument of dedi-cation.
b.A certificate from the Grant County Treasurer indicatingthatalltaxesandassessmentsonthepropertyincluded inthefinalplat,subdivision,or dedication have been paidaccordingtotheprovisionsofRCW58.08.030 and RCW58.10.040 as now enacted or hereafter amended.
c.A certificate from the city Finance Director indicatingthattherearenodelinquentspecialassessmentsorliens
on the property included in the final plat,subdivision,ordedication,
d.A check payable to the city in the amount of $130to coverthecostofcheckingthefinalshortplatwithoutimprove-
ments.A check payable to the city in the amount of $50 tocoverthecostofcheckingthefinalshortplatwithim-
provements.
e.All covenants proposed to run with the land.
5.The final short plat (eleven [11]sets of prints plus theoriginaltracingandareproducablemylarcopy)shall include
all items in Section 17.13.030 (B 4)and any additional infor-
mation and modifications requested in the preliminary approval.At the discretion of the Plat Administrator,the requirementthateleven(11)copies of the final plat be submitted may be
waived.Processing of the final plat may require fewer thaneleven(11)copies.The final plat shall be prepared in a neatandlegiblemannerinblackpermanentdrawinginkonmylardraftingfilm.All documents,maps,and survey notes shallcontainthenameofthesubdivision,the name(s)of the subdi-vider(s),and the name of the registered land surveyor respon-sible to the subdivider(s).The trimmedsize of the final platshallbeeighteeninches(18")by twenty-four inches (24")with
a one and a half inch (1½")margin on the top or left margin
and a one half inch (½")border on the remaining three (3)margins.The final plat shall be recorded on two (2)or moresheetsifthescalenecessarytoaccommodatethemaponone(1)sheet would unduly congest the drawing.

6.The final short subdivision:plat shall be approved or disap-proved within twenty (20)days from the date of filing of thefinalplatwiththePlatAdministrator.This time period shallbebindingunlesstheapplicantconsentstoanextensionoftimeinwriting.
7.No final short subdivision plat may be approved unless the citymakesawrittenfindingoffactthattheproposedsubdivisionisinconformancewithanyapplicablezoningordinances,orotherlandusecontrolswhichmayexist,I 8.No final short subdivision plat shall be approved for anysubdivisionwhichliesinwholeorinpartinanirrigationdistrictorganizedpursuanttoChapterRCW87.03 unless therehasbeenprovidedanirrigationwaterright-of-way pursuant toRCW58.17.310 as now enacted or hereafter amended.
B.Specific Requirenents:
1.The final plat shall clearly show the following information:
a.The lines and names of all streets or other public ways,parks,playgrounds and easements intended to be dedicatedforpublicuse,or granted for use of inhabitants of thesubdivision.
b.The lines and names of all existing or platted streets orotherpublicways,parks,playgrounds and easements adja-cent to the final plat,subdivision,or dedication,includ-ing municipal boundaries,township lines,and sectionlines.
c.The lengths and bearings of all straight lines,curveradii,arcs,and semitangents of all curves.
I d.All dimensions along the lines of each lot,with the truebearingsandalsoanyotherdatanecessaryforthelocationofanylotlinesinthefield,
e.Suitable primary control points,approved by the CityEngineerordescriptionsandtiestosuchcontrolpoints,to which all dimensions,angles,bearings,and similar datagivenontheplatshallbereferred.
f.The location of all permanent monuments.
g.The names of all subdivisions immediately adjacent thereto.
h.The date,true north point,scale,datum plane,and date ofsurvey.
1.The boundary of the tract,the courses and distances markedthereon,as determined by a field survey made by a regis-tered and qualified land surveyor of the state and to closewithanallowableerrornottoexceedonefoot(1')in fivethousandfeet(5,000')and not to exceed one foot (1')intenthousandfeet(10,000')in the Central Business Dis-trict.
I j.The elevations of all corners on the boundaries of thesubdivisionbasedonadatumplainapprovedbytheCityEngineer.
k.A vicinity sketch map of not more than four hundred feet(400')to the inch.
1.Street names.
m.Certification by licensed land surveyor of accuracy of platandsurvey.
n.Statement by owner dedicating streets,right-of-ways,and
any sites for public use.
o.Location and dimensions of all irrigation water rights-of-
way.
p.Provide legal description of the plat boundaries.
2.All linear dimensions shall be given in feet and decimals of afoottothenearesthundredth.
3.The scale of the final plat shall be one hundred feet (100')totheinch.
4.If the plat constitutes a replat,the lots,blocks,streets,
etc.,of the original plat shall be shown by dotted lines intheirproperpositionsinrelationtothenewarrangementoftheplat,the new plat being so clearly shown in solid lines astoavoidambiguity.
5.The final plat shall be accompanied by improvement plans andspecificationsincludingutilities,streets,grades,and appur-tenances as provided for in Section 17.13.100,Improvements.
6.The subdivider's land surveyor shall set all required monumentsandshallstakealllotcornersasshownonthefinalplatbeforetheplatissubmittedforfinalapproval.
7.The final plat shall contain the legal description of thesubdivisionandthefollowingdedication,acknowledgment,andendorsementstatementsshallappearinthefollowingsequenceinblackpermanentinkeitherbyhandormechanicaldevice:

17.13.120 Final Plat Review Procedure:
A.Upon receipt of the final subdivision application and plat,thePlatAdministratorshall,within two (2)working days of receipt,distribute copies to all offices,departments,and agencies re-ceiving the preliminary plat.Each office,department,or agencyshallfilewrittenrecommendationswiththePlatAdministratorwithinfifteen(15)calendar days from the date of filing of thefinalplatwiththePlatAdministrator.
All offices,departments,and agencies issuing recommendations forfinalplatapprovalshallnotmodifythetermsofpreliminaryplatrecommendationswithoutthewrittenconsentofthesubdivider.
B.Within fifteen (15)days of filing of the final plat the CityiEngineershallreviewthefinalplatandsubmittothePlatAdmin-istrator a written report with respect to the following conditions:
1.That the proposed final plat bears the required certificatesandstatementsofapproval.
2.That a title report furnished by the subdivider confirms thetitleofthelandandtheproposedsubdivisionisvestedinthenameoftheownerwhosesignatureappearsontheplatcertifi-cate.
3.That the facilities and improvements required to be provided bythesubdividerhavebeencompletedoralternativelythatthesubdividerhassubmittedwiththeproposedfinalplataper-formance bond or other security in conformance with Section17.13.100 of this Chapter.
4.That the plat is technically correct as certified by the landsurveyorresponsiblefortheplat.
C.Within fifteen (15)days of filing of the final plat,the GrantCountyHealthDistrictorotheragencyfurnishingsewagedisposalandsupplyingwatershallreviewthefinalplatandsubmittothe .Plat Administrator a written report recommending approval or dis-approval of the final plat as to the adequacy of the proposed meansofsewagedisposalandwatersupply.
D.Within fifteen (15)days of filing of the final plat the appropri-ate irrigation district serving or from which the real property isentitledtobeservedwithirrigationwatershallreviewtheftnalplatandsubmittothePlatAdministratorawrittenreportrecom-mending approval or disapproval of the final plat as to the ade-quacy of the proposed means of the delivery of irrigation districtentitlementwaterandastotheadequacyoftheproposedmeansofremovalofirrigationwastewater.
E.Final Plat Approval:
1.The Plat Administrator shall,within twenty (20)days from thedateoffilingofthefinalsubdivisionapplicationandplat,
approve or disapprove the final plat,unless the subdividerconsentstoanextensionofthattimeperiodinwriting.
2.If the Plat Administrator finds that the subdivision proposedforfinalplatapprovalconformstoalltermsoftheprelim-inar.y plat approval,the requirements of RCWChapter 58.17,other applicable state laws,and any other requirements,thePlatAdministratorshallapprovethefinalplat.
3.The decision of the Plat Administrator shall be final,unless
an appeal by any aggrieved party is made to the Planning Com-mission within ten (10)days of the date of decision of thePlatAdministrator.Said appeal shall be in writing to thePlanningCommissionandsubmittedthroughtheCommunityDevel-opment Department.The Communit.yDevelopment Department shalldateandrecordthereceiptofsaidappeal.The Planning
Commission shall act on that appeal within forty (40)calendardaysunlessanextensionisagreedtoinwritingbytheappli-cant.The decision of the Planning Commission shall be final
and conclusive unless,within ten (10)days,any aggrievedpartyfileswiththeCityClerkawrittenappeal.The Councilshallhearthatappealwithintwenty(20)days of the date ofappeal.
17.13.130 Final Plat Fees:Upon approval of the final short plat by the PlatAdministrator,the subdivider shall remit the following fees prior totheplatbeingofficiallysignedandrecordedwiththeCountyAuditor:
A.A check payable to the Grant County Auditor sufficient to cover therecordingfee.
8.When applicable,parks and public lands fee of $.0025per squarefootofplatincludingalldedicationsunlessthePlanningCommis-
sion agrees to accept donations of land for public use in lieuthereof.
C.When applicable,a certificate from the Grant County Auditorcertifyingthatcovenantstothepropertytitlehavebeenrecorded
and filed shall accompany final plat fees.

17.13.140 Filing Final Plat:
A.Upon receipt of all required final plat fees the plat shall besignedbythefollowingofficials:
1.City Engineer
2.City Manager
3.City Clerk
i B.The Plat Administrator shall transmit the original mylar plat tothecountyAuditorforfinalfiling.One reproducable copy shallbeforwardedwiththeoriginaltobeconfirmedandreturnedtotheCityEngineerfortheCityEngineer's record.One paper copy shallbefiledwiththeCountyAssessor.
17.13.150 Vested Rights:A subdivision shall be governed by the terms of approv-al of the final plat,and the statutes,ordinances,and regulations ineffectatthetimeofapprovalpursuanttoRCW58.17.150 (1)and (3)for a period of five (5)years after final plat approval unless theCouncilfindsthatachangeinconditionscreatesaseriousthreattothepublichealthorsafetyinthesubdivision.Any lots in a finalplatfiledforrecordshallbeavalidlandusenotwithstandinganychangeinzoninglawsforaperiodoffive(5)years from the date offiling.
17.13.160 Appeals:Any decision approving or disapproving any final short subdi-vision plat shall be reviewable for unlawful,arbitrary,Capricious orcorruptactionornon-action by writ of review before the SuperiorCourtofGrantCounty.Said application for a writ of review shall bemadetothecourtwithinthirty(30)days from any decision to bereviewed.The cost of transcriptions of all records ordered certifiedbythecourtforsuchreviewshallbebornebythepartyseekingreviewintheSuperiorCourtandnotranscriptsshallbepreparedoriprovidedpriortoreceiptofpaymentforthem.
Section 3.This ordinance shall take effect and be in force five (5)days afteritspassageandpublicationasprovidedbylaw.
