ORDINANCESETTINGTHESEWERRATESFORSEWERSERVICEUTILIZEDBYINTERNATIONALTITANIUM,INC.
THE CITY COUNCILOF THECITY OF MOSESLAKE,WASHINGTON,DOORDAINAS FOLLOWS:
Section 1.Sanitary wastewater shall be charged at the existing commercial rateasfollows:

0 to 1,000 $6.20 per month minimumover1,000 0.39 per 100 cubic feet or portion thereof
In addition,there is an accessed twenty five (25%)percentsurchargefortheservicebeingoutsidethecorporatelimitsoftheCityofMosesLake,pursuant to MLMC13.12.050
Section 2.Processed wastewater shall be charged a flat rate of $1,585 per month,based upon a 100,000 gpd maximumdischarge.There shall be also charged a sum of$853.00 per month to cover the cost of capital replacement due to InternationalTitanium,Inc.'s corrosive processed wastewater discharge.Additionally,there willbeassessedatwentyfive(25%)percent surcharge pursuant to MLMC13.12.050 for theservicebeingoutsidethecorporatelimitsoftheCityofMosesLake.The totalchargepermonth,including the basic fee,the fee for capital replacement and the25%surcharge shall be $3,048.
Section 3.Testing and monitoring shall be charged at the actual cost plus fifteen(15%)percent for overhead expenses,such as but not limited to office space andcomputortimecharges.
Section 4.A maximum penalty per occurance may be assessed as follows for non-compliance with International Titanium,Inc.'s wastewater discharge permit.
I First Day $5,000.00SecondDay7,500.00ThirdDay10,000.00
Each day thereafter until corrected or service is terminatedshallhaveanadditionalmaximumpenaltyassessmentof$2,500addedontothepreviousdaysmaximumpenalty(for example,4th day,$12,500,5th day,$15,000,etc.
The penalty provisions are provided in addition to the City's reservation of therighttodiscontinueserviceatanytimeasoutlinedintheWastewaterDischargePermit.
International Titanium,Inc.has the same opportunity for a hearing regarding thepenaltyassessmentasisoutlinedinPermit#1,Item 6,Page 3,dated March 29,1982.
Section 5.This rate structure for International Titanium,Inc.shall run con-currently with International Titanium,Inc.'s Permit #1 and shall terminate withtheterminationofthepermit.Further rate structures will be negotiated inconjunctionwiththenegotiationoftermsforanewWastewaterDischargePermit.
Section 6.This ordinance shall take effect and be in force five (5)days afterdopptaessabyeanedublco
